DRAINED: City sues consultant, engineer, builder over "complete failure" of $3M stormwater system

DRAINED: "Negligent, defective, careless, reckless"
The City of Darlington, SC has sued a Monroe, NC-based contractor, a SC engineering company, and its former stormwater consultant over what the city calls a "complete failure" of a $3 million taxpayer-backed stormwater drainage system built in 2019.
Hanna Engineering, Landsdown Earth & Pipe, and Lathan Consulting Corporation have 30 days to file an answer to the lawsuit.
This is an update to our 'Drained' investigation from November.

    Hubris when cornered with evidence! 🤯 Sadly, RFP process is iften deeply flawed/rigged without contractor's history research. At least onr ticked all the "right boxes" which were set up to help small businesses, but are used like Trojan Horses with disastrous consequences. How these contractors were selected is highly suspect and those who signed off on it and entire project has to be forensically analyzed. It reeks of corruption from the RFP responses. 🤬‼

    I am no engineering expert, but I would hope when city officials look for expertise they go LOOK at a similar project that works, find those involved and ask questions. Kind of like any normal citizen would do, if spending their own money. Hope you guys get things fixed.

    Unable to locate any principle for the insurance company? They have to be licensed in the state. State requires such information. Man if it turns out there is no insurance company, or the company is not licensed for the state... That is going really open things up.

    I don't understand why they couldn't find a phone number for the company. It took me only 5 seconds doing a Google search on "Developers Surety And Indemnity Company" to come up with a contact name, phone number and address in Irvine, CA.

    They have to sue everyone that _could possibly be_ responsible, no mater how unlikely. So the guilt can be properly split. My father once made me sign a lawsuit where _I sued him_ for alimony. He just needed a court to decide on the proper amount he owed my mother. Just because you sue each other, does not mean you can't work or live together.

    Legislators are pros at spending other people's money. It's their specialty. My first thought wa, "Whose buddy received tbe initial contract?" Then, "Whose other buddy's company was expecting the contracts for the repairs?". Who is making additional money from this failure? I'm actually impressed that they are going after the original contractor's work failures and not adhering to industry standards.

    Lathan asking Mr Barr "What was he trying to do" was comical at best and unsurprising at worst. Mr. Barr is the bar (no pun intended) when it comes to reporting. I love how the city put cones up at the edge of the holes like it was going to stop the erosion.

    We NEED a Jody in Cobb and Fulton Counties (Metro Atlanta) ! This is what Freedom of tPress looks like -- accurate reporting without fear of repercussions from a government entity. Surely, the bids required each contractor to ne bonded and insured for the job? Although, ive seen more than a couple of "Fly-by-Night" bonding companies, and even a falsified Surety Bond sunmitted by a contractor.

    The city needs to get out there, dig up some pipe and see for themselves if the contractor pushed the pipe connections together properly. I have seen jobs where the contractor didn't bother to even push the pipe seals together. They just laid the pipes end then buried them.

    You send a camera down the pipe far cheaper than digging. Then you can inspect multiple runs in a day. There are obviously problems with the pipes 7:30 as well as the entries into the chambers. Probable that the works were undertaken with no supervision, or the supervision never got out of their vehicle. Here in the UK it is a legal requirement to give design calculations too the client. Makes it far easier too modify the system in ten years time.

    @@johnclements6614 From what I saw in the video, it looks like the contractor failed to properly seal the connection between the pipe and the basin, allowing water in around the outside of the basin. Possibly the inlet to the basins is too high, which would only exasperate the erosion caused by the leaking pipe connections. The video didn't show any sink holes in the middle of the pipe run. But the holes they did show were all around basins.

    @@scottbc31h22 There is a hole shown at 7:30 in the video and I think the same or other holes in the middle of the run (s) is shown earlier. There are problems between the chambers as well as at the chambers. This could be caused by a problem at the joints, missing or incorrectly installed seals, pipes inserted too far or not far enough; or a hole in the pipe caused by machinery or large sharp objects in the backfill material. It is also possible that there is a y junction there that is leaking. It is probable that they cut a hole in the chamber for the pipe put the pipe in and did no work whatsoever to seal it. The contractor wants to keep the excavation machinery working so the making good around the pipe is normally done by a separate crew. With inadequate supervision by the client or contractor it was then missed.

    Lots of finger pointing. But where were the City's inspectors? How did they miss all this defective work? Seems like gross negligence inside the town itself. Small towns are notoriously corrupt and incompetent - the best and brightest don't apply.

    Undersized pipes are the designer's responsibility. The contractor is ultimately responsible for the quality of the craftsmanship.

    Have to just say that a lot hinges on the way the specs were written for the project and the how the inspections were to be preformed! The other thing is, if the system was deigned the way it was shown at 7:19 of the video with an open ended round pipe, flowing across open ground into a slotted opening in the 'catch basin', then it was probably doomed from the start!

    It was all approved by the city and their engineers. As a person that worked construction. We build to a print of specs. We don't add and subtract to a blue print.Where was the city's inspectors? Who went over the job proposal? The proposal of work has to be submitted in writing. This will be expensive for both sides.

    City Inspectors had to sign off on the project along the way, plans had to be approved by the City, so the city has liability in this too.

    Usually it's rather easy to find the culprit in this case. First case: The plans are inadequate and the contractor just built according to the plans, because if built different to the plan that could come back as a boomerang. Second case: The plans were good, but the contractor knew it better... Third case: Both messed up... So someone just needs to verify the plans the town got for the approval process with what has really been built and with what was necessary to be built. But I'll take a guess: The engineer and the insurance will put the blame on the conteactor alone and the contractor has to eat it. It always the smallest link in the chain which has to take the brunt of the force.

    Aren't they supposed to be permitted and inspected by the city or county during construction? Sounds like to me this is where the failure is. Here in Georgia you can't cover something with dirt without it being inspected if you do they'll make you dig it up! I believe I it is safe to say we don't have those kind of problems here, our building codes are very strict especially on government projects.

    Was the design not checked over and approved before construction started ? Was there no inspections during the work ? If soil tests etc werent turned over why was the construction allowed to begin ? smdh

    It sucks the contractors get pulled into these things because it was inspected work and had to have obviously passed all inspections. So the contractor is not at fault, this is likely a result of a poor design. The engineer or record was paid $75k for project quality control and so she signed off too. Project is 3 years old and a few heavy storms and the failure begins 3 years later. This is on the city engineer and the design engineer but lawyers always rope the contractor in and the engineers will point fingers. Civil engineering is a dead art, all the great ones are retiring and most of the people who know how to design infrastructure in the US aren’t licensed engineers it’s the contractors. Unfortunately the contractors have to listen to the egg heads from the university who don’t know what they are doing because paper and reality are not the same.

    Contractors are paid to do a job. If there is no inspection many will cut corners. If you cut corners you are responsible. The person who signed off the inspections is also responsible but the job should be done correctly without inspection.

    Exactly! In NY State, DOT is incapable of building/ repairing roads and bridges. We had a local bridge last 3 months after a complete tear-out, and rebuild.😡😡😡The engineers are young punks that only know how to do things on a computer, not the real world. Beep!Bop!Boop!😡😡😡

    Did the city receive multiple bids? And approve the design? And the permits were granted? Did the city inspectors inspect the work to close the permit, issue green tag? Unless the contractor installed it differently than approved…the city approved the project from start to finish…and now they want to say it’s everyone else’s fault. Hmmmm…normally building inspection dept is all powerful…I guess, unless they make the mistake.

    Watch out for the contractors trying to sequester assets like equipment before any bankruptcy. It's dead easy to sell off equipment to a proxy who can store it for future use. Get an idea of their major assets so the corporation isn't reduced to minor, sacrificial assets.

    So let’s talk reality for a second, does the city not have its own engineers and staff that reviews submitted plans and inspect the work? What was the ultimate criteria for awarding the bid off the RFP to these firms. I find it hard to believe the city doesn’t have proper staffing to evaluate the bids of an RFP. Sounds like the city hired the cheap guys and got burned because the city didn’t know what they were doing either.

    Just remember. When dealing with contractors and you've got one who's estimate is a lot lower than the others you have to ask . Why is that? Am I just the luckiest person on earth or is it more likely somebody's going to be cutting corners . Now unless the person who hired all three of these contractors didn't do any research all three times it seems like they just went with the lowest bidder without doing any research past that. There's a reason some contractors are a little more . We use better materials and there's a higher quality of workmanship. We're worth what we're charging and we know it. That's how we've stayed in business . Especially when you see a stack of estimates in front of you and four out of five are basically in the same ballpark that should tell you something. If you don't have multiple estimates that tells me something

    Typical? Are you referring to how they immediately began to remedy what their contractor messed up, by holding them accountable? That's exactly what my government should do. Check it by another firm? Why? The liability is on the firm that signed the contract, in which they certify to perform an adequate job and create an adequate design. So, a double check is a completely unnecessary step, as that's what hiring a professional under contract is for. I do not see what your complaint with the municipality is.

They should have been responsible and they weren't. The taxpayer pays and the taxpayer suffers because of their bad decisions. Of course, the taxpayer got what they elected. These projects are rife with favoritism and this is no different.

Just because they sue, doesn't mean they will LOSE, and you can't fix the faulty construction, without holding the builder of that fault, accountable, as per legal contract, and as obligated by the law, and the tax payers. They were, and therefore ARE, responsible, and they are DEMONSTRATING it. The taxpayer paid for a service, the builder agreed and signed a contract for that service, which was demonstrated to not be delivered, so the fault is with the builder, and the tax payer WILL NOT suffer, due to both the contract, and the suit, from their elected government, holding the builder accountable to recover the funds, as they are required to. Of course, the tax payer demands this course of action, just as they would, if a builder did this in their private lives. This project, and your conspiracy woo woo accusations, have literally ZERO empirical evidence of favoritism or existence, and you have failed to show this is different.

    @@geelee1977 The taxpayer SHOULD suffer because they elected morons to oversee their money. This was an inside job, no doubt. They got fleeced and deserve it. I've seen reports done on this particular fiasco and it is a pay to play situation.
