Nate, You get negative emails at times, saying you talk about your family. I would like to give you a positive message….you, sir, are the most professional, human, empathetic, real, kind reporter I have ever seen IN MY LIFE. I had truly given up on “journalism”. You changed that, and I never thought I would say that. Please, never change-those very things are what makes you a great reporter! You have a beautiful family, and I enjoy you sharing them with us! I find myself so glad you’re going to cover another case! Why? Because I love the way you bring a human touch to the things you cover. Thank you, please never change! When you spoke about crying when the kids were found, that sealed the deal for me. Most “reporters” would just want to get the story, you go home and care about the kids! You watch portions of the trial on the beach! Not many people would care enough to do that! You are an amazing reporter! Keep shining!

The time that you take to answer so many questions about so many different topics is so helpful and so different than anything we get from other journalists. We also heard from Tammy's cousin, Chad said in his eulogy that Tammy was LAZY and DIFFICULT to live with. His children would probably had seen his eulogy to see if parts could be left out or more added. I believe Chad skillfully GASLIGHTED Tammy, always saying to the children that she was lazy. As a result they saw no reason to omit it. A manipulator who flew under the radar because masterly he projected to all that he was a passive man. Not a passive aggressive man which he was.

@@catlyn777 Yes. He also said she suffered from depression. The cousin added that she didn't think it was right that he should tell everyone of Tammy's depression. I wish Chad saying all this should be more highlighted with the various media channels who are giving us updates. On another note: The Prosecution may not have had enough information on the use of the attic and possibly research it more. I hope the team ask in some way to the children taking the stand about their father's Eulogy and was this an honest portrayal of their mother.

"Not for the truth of the matter" means that an out of court statement is not hearsay. It's not just an exception to the hearsay rule - it's not hearsay at all. Hearsay is "an out of court statement offered for the truth of the matter asserted." So an out of court statement can be entered to show something *other* than the truth of the matter asserted in the statement. For example, imagine if someone talked to Melanie Gibb and was going to come in and testify that Melanie "called someone a zombie." This statement would not be admitted to prove that someone was actually a zombie. It would be admitted for some other reason - to show motive, or effect on the listener, something like that. That statement could come in and would not be hearsay, as long as the person testifying was the one who heard the statement from the declarant. There you have it! Lawyer here. 😊

Atty John Pryor asking the witness if she was aware that the house was a one story home, is akin to lying! And notice that he did not say it was a one story home, which of course he couldn't testify to himself, but he asked her if she was aware. That'd be like asking if someone is aware that the sky is green to someone who doesn't know, or can't see, that would lead them to believe that the sky is green. John Prior also twists what people say into what he wants it to sound like. He is constantly rephrasing what people say and twisting the words to mislead the jury.

I was on the jury for a "nothing" civil case here in Louisiana. Even in that benign of a case, all it took was one juror who refused to agree with the others on their decision and the case was basically thrown out. And I was that juror. I tried and tried to make myself come to a compromise, but in the end (and we had to deliberate over a weekend no less because the judge wanted to start another trial case the following Monday), I simply could not vote against my conscience. After 3 days of deliberation (the judge would NOT accept our request to be a hung jury), I basically just put my feet up on the table in the jury room and said we are going to be here forever because I cannot agree with what the rest of you want. Trust me, some of those jurors were MAD at me, saying things like "I can't get a babysitter for more days" and several of THEM decided to change their vote in order to get to leave. And that, my friends, is how justice is sometimes served in this great country...one person on a jury CAN make a huge difference.

Prior owns the house. I have heard he is charging rent.

"Not for the truth of the matter asserted" is the verbage of a hearsay exception and the judge has the discretion to let it in. For example: Witness testifies they saw some defendant's mother at a bar the night before a crime occurred . The witness claims the mother was upset and said "I feel like he's gonna hurt me!". This would be hearsay but the exception could be argued that it goes to prove the mother's state of mind, not that he actually did hurt her. The truth of the matter asserted in her words is that "he's gonna hurt her" but the mother feeling this way is not proof he did hurt her, only is proof of how she felt at that time. TLDR: "I love you" said outside of court is hearsay. It also isn't proof I do in fact love "you". It could be allowed in under the exception that it's evidence of my "state of mind" not to prove my love for you which is the "truth of the matter asserted".

Although if it's not offered for the truth of the matter asserted, it's not actually hearsay at all.

@@jliving9999 technically, it's still hearsay though is it not? The court could choose to allow it under an exception or exemption, but really, aren't all out of court statements hearsay ? 💁🏻

Prior has zero intent on calling Heather Daybell. She would chew him up and spit him out. He just doesn’t want her at the courthouse everyday

In the early days of the idaho 4 I saw that same agent from CAST in footahe at the house. Recognized him from chads prilim. Prob why he doesn't want to be seen bc at the time a lot of ppl pointed it out.

I believe the cousin's daughter heard Chad say Tammy came down to his office (meaning down the hallway-unless there's a basement). She easily cld've imaged "down" as in a 2story home. Do we know if the Springfield home Tammy used to live in was 2 story or had basement office? Regardless, this was not an important fact in Chad's story BUT CHANGING TIME OF DEATH IS IMP and would be recalled well. Prior insinuated the daughter wasn't able to remember accurately. I think she was accurate & Chad changed times bc it wasn't a real event (& he didn't recall his story-vs remembering a real event). Plus why does Pripr go in hard on softer women- do not like.

Why don't we ask Prior if it's a one Story or 2 story house? He owns it.

A lot of homes in ID have basements but I don’t see any basement windows on that house AND that counts as a two story home does it not? Those basements have many bedrooms or huge family rooms. They’re not just cement floors.

Nate you're flipping amazing! I was in the hospital with my husband (4 scheduled appointments) wifi was iffy & filling out documents etc left me little time to listen in. Your recaps are the best! Just what i needed when i got settled at home! Today I'll be able to catch up in more detail if i want to. I really don't think i need to hear Mr Ballance again. He's what i got to hear in full yesterday less Mr Priors speaking with him. Color me intrigued! It may sound boring to some but man oh man i was super impressed with it all! What i need to listen to i think is Prior. Plus check in on the 2 lady witnesses. The 2 story house addition was interesting. Did Mr Prior think no one would catch that? I hope it comes out in recall! Keep up the great work Nate! You're such a valued human! Thank you for your sacrifices & please thank your Mrs & family! I haven't seen anyone else go to the extent you have for years!! Continue to do great things! We are here for the long haul! ❤🤗
