This is a false 911 call, assault and a couple other crimes by the business owner.

False reports are very serious. The false report could have had resulted in a rebus police response, with guns drawn. With out a doubt the woman making the false report should have been arrested. Her 911 call was a clear and conscience ploy of using dogwhistle terms such as "schoolchildren" and "guns" to punish the auditor. Consequently, the auditor could have been tased or shot. I give the police two grades; The first grade, I give the police a FAIL for letting the caller of the false alarm off with a simple reprimand. She was the the only one who put people in danger! In essence her false 911 call was an attempt to weaponize the police. The second grade, I give the police an A for a maintaining their poise when engaging with the auditor after a gun reported complaint.

That crazy woman who claimed that he had a gun could've got him killed. These people are batshit crazy

Certain people, including this woman, never experienced consequences for their actions, so they continue to try to manipulate people and situations because they've never had to face repercussions for their insane actions.

"He's recording a school and has a gun!" "Get here faster or I'm calling every news station!" "I never said he had a gun..." She should be in jail. She put so many people in jeopardy and caused a massive police response for nothing.

I honestly didn't watch all of this because I have seen it but imagine if the 911 operator was in training and called out the SWAT because she took the " He's watching and recording kids and has a gun" serious. at least should have cited her or something.

I'm extremely hesitant to posit jail/prison as a solution to *anything* (especially given the current state of the criminal "justice" system) and this is no exception. However, a severe reprimand, emergency services education, and community service of some kind would be very much appropriate.

its such a gray area, cops responding to call about a gun. they have to investigate when they show up to a call but that gray area is crazy as far as detaining/identifying etc, its all about ''suspicion'' which gives cops a great deal of power in general. One of the few things that need to be worked on in our justice system, cops love minor infractions that lead to ID'ing people for warrants etc, smell of ''weed'' in the car resulting in searches that lead to gun possession charges etc

I can visualize exactly how the situation would’ve instantly flipped if one of the officers while they were surrounding her had called dispatch & heard the part about threatening to call every news channel. Actually it would’ve made for an amazing video for us as viewers to see that unfold as they were scolding her already. “Wait u threatened to call every news channel saying a guy has a gun out here and the police aren’t coming??? Lady put your hands behind your back.” Then would come the tears

Female caller should’ve been charged. She was inside the business and the sidewalk was at least 200 feet from their front door. Absolutely 0% chance you can identify a gun handle in a back pocket at 200ft.

I used to work for the emergency services using the same MPDS system used in America. It was infuriating the amount of false calls and blatant lies that were told by callers like her which generated an emergency response. To my knowledge, none were ever punished.

If i was the police officer, i would have asked her to describe everything that happened in detail just to see how believable her story is. I would have let her incriminate herself first, then scolded her. And maybe would have gotten probable cause for an arrest too...

Sadly, Lawyers would argue that their client was overreacting to a stressful situation and would drag out the process. The officers did not wish to waste the court’s time. But I do agree with your standing on this.

I bet that guy called that lady off camera and asked her to make something up to bring the police down there, since the dispatcher did her job by identifying he had no legal ground in harassing the dude with the camera. That lady 100% made a intentional false call of a potential shooter....in a country with that type of problem. She wanted that dude dead.

if he was ON his property, I could see him feeling entitled to identify people on his property--- but he cannot FORCE them to do so, and his only recourse would be to demand they leave his property--- at which point refusal would constitute criminal trespass if he refused to leave... but in this case, dude clearly needed a little "EDUCATION" about how little power he actually has in this situation :)

@@simonspacek3670 yea as citizens we have rights that we have to uphold everyday as a whole or they can go away fast. But there are circumstances when we should consider ceding a right or two temporarily for good of all. Like in the video he let them search and seize so that the situation could be deescalated immediately. It definitely helped that these cops seemed to be very well trained with quality supervisors.

@@nanook6620 I like driving examples. Let's say that you just stopped on one of those all-way-stop crossroads. And you can see that there is a car coming from left side. It has to stop. but it is going fast. Really fast. You are in the right to go, you came first and stopped first. The other one broke a rule. But if you will insist on going, it will hit your car from left, so most probably right in your door. Is this the hill you are willing to die on? Maybe it is because I spent a lot of time with historical fencers and more than once we met cops, so we knew that step one is putting down all swords, axes, polearms and removing gauntlets. Of course we didn't have to, but it made everything much easier.

Where the cops failed, IMHO, is in not arresting that *KAREN!* With the several 911 calls, her hanging up, her yelling at the dispatcher and LYING about a g'u'n', *SHE SHOULD HAVE BEEN ARRESTED AND CHARGED WITH A FELONY* Perhaps some comments on their FB and Twit accounts would be a good thing.

Yeah, that was really heartening. And ALL of these cops were in agreement. This gives me some hope that MAYBE things MIGHT start to change with how the US police force treats our constitutional rights.

She was also very calculated. If I'm terrified because I think someone has a gun, I'm saying "he has a gun", she kept saying "it looks like he has a gun", "he has something that looks like a gun". Terrified for her life but still had the wherewithal to pick her words carefully in case it went south. She's awful, she knew exactly what she was doing and how her multiple faked panic calls were putting this guys life at risk.

My favorite part was when she hung up at the end of the first call when the dispatcher asked her her name.

The cops here deserve kudos for being calm, professional, and trying sort out what's actually going on.

"you're free to record me. I'm recording you" i love to hear that. Also. If i call 911 and I'm not getting actively chased by a serial killer that I'm hiding from and I need to be quiet I'm not hanging up until i have given all the info they need. These folks just hung up. "THERE'S A SERIOUS ISSUE" *CLICK*

That Karen should have been arrested for filing a false police report and harassment. Unacceptable behavior.

She literally swatted him. Under California law, swatting is considered a crime against public justice. California Penal Code (California's criminal code) section 148.3 states, “Any individual who reports, or causes any report to be made, to any city, county, city and county, or state department,… that an “emergency” exists, knowing that the report is false, is guilty of a misdemeanor.”

Just watched again after some time, and thinking the same thing. I’d love to see a prosecutor try to throw the book at her. Her changing statements, the post-call story, the threat to call the media if the Karen wasn’t satisfied with an immediate response, etc, could all paint a very convincing story to a reasonable person that she knew her statements were false and was just trying to escalate the response.

And yeah, first she says he's got a gun in his backpack, then his back pocket, saying there is something black sticking out, when there isn't.

It’s one thing in a car. You must identify yourself. But doing a constitutional act you do not need to do so unless they’re is probable cause. You can’t fight it at that moment but you can sue for violating rights.

Definitely. The 911 operator(s) did an amazing job of trying to get the best facts possible for the cops, so the cops could respond more appropriately to the real situation and not some inflated threat scenario built up on lies.

When the cop yelled “This is ridiculous!” Made my day! Kudos to those cops man

To be fair. I hate cops, etc. But the amount of shit they have to take by any Dick, Tom and Harry is ridiculous. That is why I call for mandatory psychiatric evaluations every year and mandatory visits to a therapist at least once per month. Civil officers with guns should be strictly regulated and highly educated so that they would not become bullies with guns... as is the case in the US.

@@timduncan2981 That's the only reason why in my book, the police would get a 90 instead of a 95, still an A, but a slightly lower grade. That should have been left to the prosecutor and judge to figure out.

These stories are addictive. You should play more like this one. That way people are not only watching stories of bad cops and bad people but are seeing the good in people too.

I somewhat agree. But I do think its slightly more important to expose bad cops than it is to show cops simply doing the job they're hired to do. The fact that these sort of videos are a "breath of fresh air" says a lot. Bad cops are a danger to everyone, good cops are doing what they are simply supposed to do. 1 bad cops will ruin it for 20 good cops. And for obvious reasons, the bad cops should always be exposed. I give these cops a lot of respect, and its nice to know good cops still care about the law and doing their jobs correctly, but its the bad cops that are a threat to citizens and need to be exposed as so, in every instance its recorded/documented. No logical person thinks ALL cops are bad, but it only takes a few bad ones to ruin it for every other cop.

The fact that we're so starved of seeing "good cops" is pathetic. And just seeing cops do their job properly still doesn't make them good cops. These same cops will be silent and protect bad cops who are criminals. The culture of the police and their thin blue line goes deep and it means that there are no good cops because those that do speak out are often not cops for much longer.

If someone lies deliberately lies on a 911 call to prosecute somebody illegally that caller should be arrested immediately.

That lady should be arrested. What she did could've cost this man his life.

At a minimum, the cost of sending 12+ police officers to the scene, she should get the bill. I wish they had at least handcuffed and discussed if they were going to charge her (in front f her) and then let her off with a written warning.

This is what happens when a cop "tries to understand the situation" rather than "assuming of the situation." A lot of cases in the ATA would never exist if only cops used their common sense like this. Upon arrival: 1. Asked about the situation 2. Told the camera guy why they are there 3. Get the sides of the caller and the other person having issues with the camera guy 4. Reprimanded those who are really at fault without assumption. Lot of videos here bypass the #1 and #3 then proceed with #2 then #4.

Good job San Jose PD for a great response, being respectful, and not escalating the situation stupidly, quickly getting to the bottom of the situation, and having enough constitutional intelligence to safe guard the photographer.

The woman purposely sounded frantic, mentioned children and a gun and then hung up hoping to create panic and cause cops to arrive ready to shot. This is why they were so angry when they showed up - I'm sure it's not the first time someone has done this.

I've seen other audit the audit tapes where the call to 911 was way off base. The cops arrived expecting a home invasion in progress when it was a realtor showing the house. "For Sale" sign prominently displayed in front yard. That should have been a clue. The realtor and his client got a settlement from the city. I hope they got an apology from all involved, too.

She literally tried to swat him. Under California law, swatting is considered a crime against public justice. California Penal Code (California's criminal code) section 148.3 states, “Any individual who reports, or causes any report to be made, to any city, county, city and county, or state department,… that an “emergency” exists, knowing that the report is false, is guilty of a misdemeanor.”

The burden of proof for putting her in jail might be too large a hill to climb, but SHE should be billed for the cost of the police response. If her employer wants to help cover the cost, that's on him.

To me, that is exactly what the officer did by sending out that message, basically told his backup/other officers to chill out. In case you were not aware of what code 3 is: CODE 3 EMERGENCY RESPONSE A “CODE 3” response is defined as an emergency response determined by factors such as immediate danger to officer or public safety that require an expedited priority response utilizing lights and sirens.

While it would have been cathartic, I do not think they had a reason to arrest her on the scene. If they DA decided, upon reviewing the situation, that she should be charged that can happen at a later date. These police did a phenomenal job, and part of them doing that was realizing that instantly detaining people for everything is bad police work. Further, at this point they would not have heard what was on the call word for word, only what dispatch told them, so they were clearly operating in good faith. People really should only be detained if they are an imminent risk for some reason or if they have to be detained for the purposes of investigation or due to the possibility of flight.

If you would tell me this guy is normally a pretty good and chill dude, but simply had a very bad day I might believe. Does not excuse his actions of course. What the woman did is just vile. Being ashamed is not enough. I feel she tried to weaponize school shootings to get what she want. She needs help. That is not just a bad day. I mean do not even blame the dude for having a bad day if you have to work with such a creature. However, that said I do agree that filming for reactions is just bad behavior. I can understand the urge to audit the government, but just random businesses? You are just doing that for content. You are not making the world a better place by teaching a company that you can do something that hardly ever happens in the first place.

The callers who are claiming there is a gun should all be charged with misuse of emergency services and false reporting.

Cops are just people man youd be surprised how many of them would make a simple slip up like telling someone to stop filming a government building from a sidewalk or something like that. Departments know its easy and as sad as it is they also know not every single one of their officers memorized the bill of rights. I can totally see how i came across as an ACAB moron but im just saying it happens

Lets say the guy did die, well it could be argued that, because he was innocent, and because the caller lied, she is in fact a murderer because her actions caused the death of someone, and her intent was to get that person hurt.

It is so disgusting that people are so willing to lie in order to violate someone else.

Let's give a shout out to the amazing dispatchers who take calls like this on a daily basis. Those officers are simply amazing !!

Yes, a rare cop who actually knows people's rights. I'm SHOCKED by the cops who don't, and who even arrest people because they won't give their name or even speak to them. Somebody has to go and listen to the training these cops get, and ask the trainer if people have to identify themselves when they're standing on a sidewalk, and see what he says. Because it's clear, the training these people get is horrible. They need to be told the difference between obstruction and choosing not to aid an investigation by talking to a cop, which is 100% within their right. It's really nice to see a cop who respects his job enough to actually know the law.

thing is though this takes place in California, the camera man needs consent of all parties being filmed, even in a public space. yes maybe if they got it brought up to a federal court then something else could happen, but if it stays in California court the businessman does have legal rights. I have firsthand experience in this, a boss was sexually harassing me, I recorded him as evidence, then got fired and the court said the evidence was not admissible due to me not having his consent to record.

Wow...the woman falsely claimed he was taking pictures of kids and falsely claimed he had a gun. She needs some kind of charges filed against her.
