College Professor Censors Anti-Obama Comment on Free Speech Wall

Last year, college censorship took a turn for the ridiculous when a professor at Sam Houston State University vandalized a student-sponsored "free speech wall" with a box-cutting knife to remove anti-President Obama speech he didn't like. When the students complained about the vandalism to the campus police, the police took the professor's side and demanded still more censorship, leading students to dismantle the wall. Morgan Freeman, the student who organized the protest, recounts this amazing and disturbing story in FIRE's latest video.

    +Og maco Sheesh Agreed: if you have to ask a government permission to exercise a right, you are not free and it is no longer a right but a privilege granted by the people in power. All those who claimed that the 2nd Amendment was no longer relevant and wanted all the gun control laws passed were warned by the pro-gun rights people that if we allowed the government to control this one right, free speech would be attacked next. After which comes the infringement of our right of protection against unwarranted searches (which has now been declared LEGAL by our WI state supreme court!). And so the blatant erosion of our first and forth amendment rights begins, just as predicted. Why am I not surprised?

    +otm1942 I blame the school system cause when I was in history class kids thought there where 52 states and had NOOOOO CLUE what Congress was or the bill of rights so...... I blame common core 100% I had to be a little bit of a rebel to stand up for what was American and moral in school cause (liberal) teachers would try to teach us half assed history and common facts.... it's so annoying seeing so many people of my age group voting for Bernie they simply have no understanding or pride for the country they live in BTW I got a 95% on my citizens test when everybody else fucks of getting 60%s all over the place soory for the rant but politics pisses me off but I feel like I have to stand up for what's right

    That professor committed vandalism. He should be arrested and sentenced to 15 years in prison. The police officer should be arrested for corruption and abuse of authority. The college administration should be sued into bankruptcy.

    They should have blocked the professors path to keep him away from the sign. If he tried to get through them while holding a boxcutter he'd be guilty of assaulting students with a deadly weapon. That would have really taught him a lesson.

The Supreme Court in multiple cases has deemed it legal for schools to limit free speech and while the way said professor went about using that to his advantage is bullshit there is not much one can do.     The first time I went to college I had a similar thing happen. The difference is I had the balls to force their hand and made them try to arrest and charge me. It backfired on them big time. The college tried to have me expelled, the police brought me to the station and tried to intimidate me but when they both realized I was in it for the long haul the harasment ended quickly.

    1ForAllandAllForAll No, assuming the professors act was accurately reported (which I believe it was), it is he who acted like a child. Or, to use a more accurate term for an adult: fascist. Vulgarity, as in, swearing, has its place and is in no way less intellectual when used properly. Swear words are words just as much as other words are words. Sounds simple, right? I understand your point, but your point is besides the point. The point is a professor chose to deliberately vandalize a specific portion of a wall because he likely disagreed with it. This is antithetical to the founding principles of this country, let alone the supposed mission statement of every university out there. *Most of all*, I think you're ignoring that fact that the visceral nature of the "Fuck" in the "Fuck Obama" writing is what caused this professor to show his true colors. Not only does he have an antipathy toward those who disagree with him, but such language makes him take fascist action toward it. In this respect, the use of "vulgarity" served a fine purpose: exposing a person who does not believe in real freedom of expression.

    There is a huge difference between "Liberal" and "Leftist". The dictionary definition of liberal is tolerant, free, etc. What you're seeing here is Leftism. Remember the word: Leftism. Virtually all colleges are controlled by Leftists (when they were free they were controlled by liberals). The Democratic Party has been taken over by the Left and the leaders are indistinguishable: Obama, Hillary, Reid, Feinstein, Bernie, etc. They are interchangeable. Example of a liberal: John Kennedy (read his inaugural speech - "Ask not what your country can do for you ..."). Today's Democrat would choke on those words. The Left does not tolerate free speech.     The school can not protect students from You Tube. Cable TV. Movies. Comics. Anime. Sports fan talk. Talk Radio. AND any other media/entertainment out there. The liberal SJW, PC crowds are the problem. They define what is hate. They define what is offensive. Was it offensive when Sarah Palin and her family were humiliated years ago? Liberals ate it up.     I'd say the opposite. I went to college in 2004 and got a nonsense degree so 13 years later I'm back in school at the young age of 31. Watching young people argue is cute, it's all emotion and passion. We see the extreme on KZread every day but 90% aren't like that. However I visited my brother persueing a masters at Scad (savanna college of art and design) and that's where I ran into the extreme. They even took the day off after the election due to emotional trauma (brother said he saw professors literally crying in the halls). I derailed any political talk with them by saying all the poc I knew voted for Trump, which was true. Most of these people had never had a non white friend in their lives so telling them what real people of color thought blew their mind and narrative.

    Wow! Can you believe youtube steered me toward this? KZread, like Google, seems to me to be the last place you are going to be steered toward anything Constitutional, and more particularly things pro-1st Amendment or pro-2nd Amendment... I've been slapped down by youtube without explanation (they took away my long video ability for no reason and no explanation) because, almost certainly, that I am a conservative. Has this happened to anyone else?... no explanation, just downgrade an account? College kids FOR free speech? I'm extremely proud of this group. This young lady GETS IT and gets it exactly right, that is, free speech isn't free speech if we're not allowed to speak freely. Can I say GOD BLESS you guys? I think so.... oh yeah, I can, that's in the same Amendment.... ;-)

    +mollesjohn I think you may have had your upload length reduced and some of your videos taken down due to automatic copyright complaints. There's a draconian system of detecting copyright infringement, and to prevent exposing themselves to liability they set the bar very low for automatic removal. This doesn't mean you've infringed on any copyright, the automatic system can't tell whether you have, it just tries to make a guess. Though I can't blame you for suspecting it's because of your conservatism, you guys are being very, very unfairly treated these days. If you're interested in restoring your account/videos, there are videos on KZread describing the process. Just be aware that going through the process may expose you to liability if the original copyright claim was valid. Best of luck from Canada, we admire your great republic : )

    +Joshua Brooks No... when I had my length reduced, it just happened, I had no notices or warnings at all from anyone anywhere... they just did it. It was much later that I got one of those messages and other things were inhibited, like unlisted and private youtube videos would no longer be allowed. I'm saying that they increased my original length time without any explanation and reduced it later without any explanation. They do it just because they can, and I'm sure it's in the fine print that they may do things to your account without any explanation whatsoever, I have just never read the fine print, but I'm sure it's there.

    I disagree. The Miller Test wouldn't be nearly that cut and dry here. You have to fail _all three_ prongs. The students have a solid defense that they pass the third prong, which states that in order to be obscene, the work as a whole can not be a serious artistic or political statement. Their work was clearly political in nature, and by trying censor them the university played right into their "right to free speech" narrative. It would be hard to argue there was no political merit here in court, and it actually seems to be where the school was overturned. The students were correct in arguing that their free speech is protected. However, the school might argue that they don't want to do away with the whole wall just the "fuck"s, so this isn't a problem. Even here though they'd run into issue with the second prong, which says the work must depict or describe sexual or excretory functions in a patently offensive way. From what I understand there are further laws about what qualifies at a state level, and I don't know whether the word "fuck" counts where this lawsuit was held. I _highly_ doubt it though. Even exposed genitals aren't ipso facto violations of the Miller Test because it's held to community standards. If the sale of porn has been allowed, "fuck you" is hard to oppose. You'd have to argue that by saying "fuck Obama" (and fuck whatever else was on that wall), the students were literally calling for the President to be sodomized. That or invoking sex or bodily function in another way that would be clear to the current community. In 2016, you'd have a hard time convincing anyone that "fuck" was inherently sexual or excretory. It's become a very generic, versatile insult. The first prong is also about sex so I doubt it would be an issue in terms of "fuck Obama" either. Or even the whole work. It states that in order to be deemed obscene, the average person must find the work as a whole to be lustful. This is usually where racy music videos are flagged only to be cleared as "artistic". From what I saw of it, their wall definitely didn't qualify. Now, I wouldn't be surprised if the students _had_ written or drawn something explicitly sexual somewhere else on the wall, but the schools reaction seemed to stem from the statement against Obama. As Morgan pointed out, criticizing your leaders has consistently been one of the most upheld interpretations of the first amendment, so the school was fighting a losing game by staking their reaction on that section of the wall. The statement might have been very crude and insubstantial -- fuck you is hardly constructive criticism -- but it DEFINITELY passes the Miller Test.

    Also don't forget that the first two prongs rely on _community standards_. If the college campus is the community (as there's very little reason for non-students from the surrounding city to be on campus where the work is visible), do you really think a majority of those 18-22 year-olds would claim "Fuck you" was obscene enough to be censored? Even if they said they did, it might be thrown out in court if you could prove the students used worse langue on a daily basis. Consider the famous 2000 Utah case where a video store owner was allowed to continue selling pornography when it was illustrated that pay-per-view porn was rented at even higher rate from the the local Marriott and cablevison providers than purchased from his store. The conservative Utah community could not argue the films violated their _practiced_ standards. The only standard of the Miller Test held to a national level is the political/artistic leg and these students appeared to receive widespread support for their protest across the country. Ultimately, the Miller Test is very vague. It doesn't define any of it's terms very well at all, which is why Free Expression vs. Obscenity continues to be an ongoing battle in the American court system. Plus the Miller Test isn't the only Supreme Court ruling that's relevant. As other comments have stated, the Falwell v Flynt ruling protects political cartoons and parodies. Compared to the works they've upheld, "Fuck Obama" is practically saintly. And most importantly, *the Miller Test is usually used to consider x-rated video not words on a poster!!* It's a bit ridiculous to use it to rate "Fuck Obama" as obscene. "Fuck Obama" wins!

    Even if they would have been charged for misdemeanor, they could have appealed to it and ultimately won the case. The government is only allowed to limit and punish for speech that has the likelyhood and intent to incite violence, and quite frankly, "fuck obama" would not fall within this definition. Even if the policy on free speech within this campus is of such regressive nature, I don't think such limitations to free speech (U.S constitution) can be trumped by mere "house rules".

    ^^ Exactly! Show me someone in the US criminally convicted for saying "fuck". He doesn't exist! You'd be hard pressed to find someone _arrested_ *just* for saying fuck. I suppose obscene language might be listed as part of a larger "public indecency" arrest, but it would never be the sole reason. Not even if you screamed it in the middle of a church or kid's playground. Greg seems to have a very distorted view of how the Miller Test is used.

    ***** I will concede that my first comment might have been too hyperbolic, but you're not making any sense. First of all you already made my point by saying their are no specific laws on the books about specific curse words. Then you try to claim most have said it falls under disorderly conduct. This isn't true though. The only time profane language is upheld as disorderly conduct is when someone is goading another person in a clear effort to _incite violence_. This kind of action is deemed "fighting words". This poster was not likely to incite violence. Simple public displays are exempt from this law. For instance, wearing a "Fuck the Draft" jacket to court was ruled legal by a high court in '71 because it was not a direct threat of violence. No reasonable person would take these types of slogans as encouragement to fight. (Also fight who in this case? Obama? He wasn't there.) Nearly every other instance of profanity has been upheld as free speech. There's a difference between being rude and breaking the law. As the original comment stated, it's one thing for campus police to react against curses that lack the threat of violence, as your school or employer can have stricter behavioral standards. But it's another matter for the local police to do so. I do think the students were right to obey the officer, but it's unlikely any arrest would have held up in court. In fact, the schools policies _were_ all overturned in court! So really why are we arguing?

    Getting falsely arrested is still a pain in the ass; the appeals process is not designed to work around your busy school and work schedule. The average person does not have the time and money to fight, so they plead no contest and move on with their lives. That's why a civil rights activist who's not willing to be arrested is not worth their salt. College kids these days are so anxious to avoid anything that might blemish their precious personal records, that even the activists will stop their protesting when asked to by the police. Just with the threat of being falsely arrested hanging over their heads. It's a damn shame.

    pmlking, unless you're doing a dual degree in Teaching with Philosophy or Journalism with Philosophy or English with Philosophy, then the degree holds some value. A very niche employment option, but it still holds some value. That said, I suppose she'll enter the media industry in the future or become a worker in a NFPO, if she's solely studying Philosophy that is.

    Tary88 Can you atleast admit using the duck dynasty guy as an example of a victim of lack of free speech was not intelligent? The guy lost hos job because of freedom of speech not in spite of it. The people spoke and wanted him fired from his job and they got their way. He did not work for the government.

    In today's society this isn't censoring... Even if this didn't go viral on KZread everybody who is socially connected at the event and their family and friends that they tweet to would have found out through a facebook or twitter post that the professor did this. The professors aren't morons, they know it will go viral that they did this. This isn't censoring, it's making a public statement the smart way. That's all anyone cares about, getting their personal zeitgeist heard by everyone and making a social impact

    I am a politically conservative college professor, and I must say that I am shocked by the behavior of the professor, the police, and the college administration. If we only allow speech we agree with, then there is no need for the 1st Amendment. The very point of the 1st Amendment is to protect speech (and the speaker) we disagree with from actions by the government.During the Vietnam conflict, a reporter asked John Wayne what he thought about Jane Fonda's virulent criticism of everything and everyone involved on the US side of the conflict. His reply is noteworthy: "I disagree with everything she says, but I will fight and die to protect her right to say it."
