I find it really hard to grasp the procedure, especially since it is offered simultaneously with civil law, unlike the old curriculum. Atty. may know after the trial of both parties. How long would the judgement of the court be released?

Atty may civil case po ako na ipinile noong 2018. Nag mediation na po kami at Jdr. Problema ko po, 2019 pa lagi napo postpone ang pre trial. Isineset po nila ng almost 5months at pagdating ng hearing postpone reset n nman po ng halos kalahati g taon. Ang hearing po ay sa Cauayan Isabela at ako po ay nanggagaling pa sa Nueva Ecija..Feeling ko po sobra ng nadedwlay ang justice..😢 tama po b ung ganong sostema atty, laging postpone at matagal palagi ang schedule? Hihingi na din po ako sainyo ng advice atty.. Maraming salamat po ang God bless you po Atty❤

Atty good evening, how long po ba would the judgement of the court will be released? umaabut po ba talaga ng ilang taon? kasi ang nakasaad 30 days, eh mag iisang taon na wala pa ring judgement from the court. Thanks po.
Atty. Olivas, what if the appellees won the case (motion for reconsideration) at the level of the Office of the President, and there was no appeal case filed in the Court Of Appeals by the appellants within the 15 days, can the appellants still go to the Supreme Court?

Generally no. Exception, if there are grounds for a Rule 65 Certiorari petition, but that is not really an appellate remedy, and it is an extraordinary remedy.

Atty, what is the difference between preliminary conference and pre-trial po? medyo confused po ako - is preliminary conference only under summary procedure while pre-trial is under ordinary civil procedure?

Pretrial is for ordinary civil actions. Preliminary conference is similar but it is for summary procedure cases and also for actions to annul judgment (Rule 48)

@@kenvlog6547 pano po mag file ng civil case kasi ayaw mag bayad ng danyos yong pet owner nakagat kasi anak ko ng aso nya ayaw nya e refund yong nagastos namin sa pagpapaturok ng anti rabies
Maam what would happened if the defendant does not attend in the partial trial and even the trial, can the judge file a warrant of arrest in this situation to the civil case?

Thanks for asking. If the defendant fails to attend the pre-trial for no valid reason, he/she will forfeit the right to present evidence. The plaintiff will be allowed to present evidence ex parte (without the defendant's participation). It's as if he has been declared in default. No, he cannot be arrested on this basis.

The parties' presence is mandatory during pre-trial. However, they are not required to be present during trial, in a civil case, unless the court issues an order requiring their presence, or unless they are scheduled to testify. If the defendant is required to be present in order to testify, and his absence is without a valid cause, he may forfeit his right to testify, unless there is another witness available to testify on that date. He may be allowed to testify on another date as long as there are still days allotted to the defendant for evidence presentation; these dates are agreed upon during the pre-trial.
