  Ma'am ako naman hihingi ng tulong or payo kung ano puede kong gawin kasi pinaampon ko si baby pero gusto ko syang bawiin na? Paano po ang gagawin ko at kinakailangang hakbang para makuha si baby.   Hello Atty Chato, thank you for your useful video. I have one question if you could please clarify. I live in Cebu and loaned to someone who lives in Davao. We signed a promissory note and I notice it says all legal action must be made in Davao. Does that mean I am legally required to lodge a small claim where the defendant lives? Or do the rules still allow me to lodge where I live? Thank you.

  Hi. It depends on whether the PN states that all legal actions must be filed exclusively, solely or only in Davao (or similar words of exclusivity). If it doesn't use words of exclusivity, you may file where you live.

  @@easylawonline Thanks for your information. Yes, it does says exclusively in Davao. However, I read this from FAQs of the revised rules which state "If the contract of loan between the plaintiff and the defendant has an express provision that venue is stipulated in a specific area, which is controlling - the stipulated venue or 2nd paragraph of Section 7? Section 7 shall apply. Since the Revised Rules is a special rule of procedure, the same is controlling over stipulations in a contract. Section 7 states that the regular rules on venue shall apply, but “if the plaintiff is engaged in the business of lending, banking and similar activities, and has a branch within the municipality or city where the defendant resides, the Statement of Claim/s shall be filed where that branch is located.” Doesn't that mean that the revised rules overrides the statement of location exclusivity in the PN??

  Hello, Ms. Rose. Complicated ang situation ng anak mo at ng tanong mo, at hindi ko ito masasagot dito. Kailangan pag-aralan ng mabuti kung ano ang mga legal remedies na pwede mong isampa, para sa best interest ng anak mo. Gusto kitang i-refer sa mga kakilala kong lawyers para makagawa sila ng legal opinion after an in-depth interview with you. Ako naman ay hindi na humahawak ng kaso maliban na lang para sa aking exclusive client kung saan ako fulltime legal counsel.   Atty , ask ko po kung ang isang notarized na document po ba ay na-eexpired? halimbawa po ay ang 'Affidavit of No Pending Case' (notarized May 2023) susubmit po ngayon june 2024. isa pa po pwde po ba ako mag pa notaryo kahit nasa abroad ako? salamat po.

  Yung Affidavit of No Pending Case technically does not expire, kaya lang yung fact of no pendency of a case refers only to the period mentioned in the affidavit. If it is May 2023, baka hindi na io tanggapin ng office to which you will submit the affidavit now because it's been more than a year. It depends on the office which needs your affidavit. As for notarization, you have to personally appear before the notary public, so if the notary is in the Philippines, the document cannot be notarized if you are abroad. What you can do is go to the Philippine consulate abroad, and have the document authenticated there.

  Good day po. Mam, kung ma deny po ang annulment of judgment at gusto mo I elevate to higher court ang order/resolution, what is the mode of elevating, it is petition for review still or notice of appeal? Thank you for the clarification. God bless.

  Hi. Remember, the case is filed with the CA as an original action if the decision being questioned is that of the RTC. The only way to elevate this to the SC is through a petition for review on certiorari or an appeal by certiorari on pure questions of law. If the Rule 47 action to annul refers to the decision of the MTC, the action to annul is filed with the RTC, and since it is the RTC resolution(denying the action to annul) that is to be questioned, you can elevate it to the CA through a notice of appeal (since the action to annul is an original action).

  Prof Chato, in your note, it says reglementary period for Certiorari under Rule 65 is within 30 days. Is it not 60?

  Hello. It is 60 days under Rule 65. However if the petition for certiorari is filed as a post judgement remedy for decisions or final orders of the COMELEC or COA under Rule 64 in relation to Rule 65, it is 30 days.   HI. Ang plano nyo pong gawin ay tinatawag na simulation of birth na isang krimen sa ilalim ng ating batas. Hindi po ito pwedeng gawin legally. Advice ko ay i-adopt nyo ang bata ayon sa ating batas. Hindi na ito dadaan sa korte dahil bago na ang batas tungkol sa domestic adoption. Pwede ko kayong i-refer sa law office na pwede ninyong ikonsulta at lapitan para hawakan ang kaso. As of now kasi, hindi ako humahawak ng kaso. Will wait for your reply. Salamat po.

  Kung non-working day yung due date, submit it on the next working day. Rule 22 Section 1 - Section 1. How to compute time. - In computing any period of time prescribed or allowed by these Rules, or by order of the court, or by any applicable statute, the day of the act or event from which the designated period of time begins to run is to be excluded and the date of performance included. If the last day of the period, as thus computed, falls on a Saturday, a Sunday, or a legal holiday in the place where the court sits, the time shall not run until the next working day. (1)

  May tanong pa po sana ko atty.kung ang file ng investigator is attempted then ang naging resulusyon ng piskal ay slight phisical injuries,umakyat sa judge at dinismiss dahil daw tapos na prescription period(30 days)....saan po ang magiging basehan para masabing nag prescribe na un case...?dun po ba sa isinampang kaso na attempted na 1yr yata ang prescription o sa naging resulosyon ni piskal na slight which is 30 days lang po yata?salamat po ulit!!😇
