Maybe you should take more than a second to study up on the First Amendment and Supreme Court cases that set the boundaries for free speech, rather than making ignorant statements. In the Supreme Court case of Brandenburg v. Ohio, the Court overturned the conviction of a KKK leader who at a KKK rally called for violence against blacks and Jews. The Supreme Court held that the government cannot punish inflammatory speech unless that speech is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action". President Gay was correct as she attempted to answer, but the rude Stefanik kept interrupting her. Stefanik was just grandstanding, trying to score points with gotcha yes or no questions, not allowing Gay to make her point. If I was sitting there with Stefanik badgering me, I would have told her to F off, and left the room.

And protesters are not allowed to carry guns on campus. So there can be no imminent threat of genocide, which is a mass killing. The question was so stupid, it was almost laughable. If Supreme Court case law allows it, why are you holding Harvard to a different standard?

Why are neo-nazi’s are allowed to parade down a largely jewish street in Skokie Illinois? Because it’s unconstitutional to prohibit it. The school Presidents should have said: “speech that violates the law, violates school policy, because violating the law violates school policy.” Wheather a statement is an illegal statement depends on context. The school should let the courts do their job and decide whether a statement violated the law, under the circumstances, before the school determines whether the statement violates school policy. Otherwise the school policy may be illegal.

I would guess that if she answered truthfully Rep. Stefanik's questions, Harvard might think they could face a class action suit by Jewish students at Harvard. It's a bit like the testimony of Justice Ketanji Brown Jackson, who danced around the definition of a "woman". For her to answer truthfully would potentially render her unable to rule on a transgender or other suit brought before the Supreme Court in the future.

Because some questions are so vague or complex, that an answer cannot be made with a simplistic 'yes' or 'no' without more information. The best response to them is "it depends, it could be yes or no depending on the context". It ain't hard to understand for anyone with half a brain. These kinds of questions are usually designed by the question maker that way to trick people.

@@richardsarabi2064 first, I’ve never heard anyone say that. Second, no one has ever said that while meaning that they want slavery to be legal or to mean they want a genocide of black people. This lady straight up admitted that she knows these people are calling for genocide and said that it is not the same as bullying or harassment.

Well its possible , but its also the fact that she would need to have the numbers on hand to answer the question. and the reason this specific point matters is because if say she says idk 300 people are under investigation. But it later turns out to be 700. Politicians will do what they do and will claim that she was lying or some variant thereof.
