    Unlikely to be prosecuted, as the jury is very unlikely to believe the lie after it was exposed on cross. If the jury believed him and the lie was only exposed after the verdict, that would be a different matter.

    Perjury usually isn't prosecuted unless the jury believes the lie and it changes the verdict. In this case, the lie was immediately exposed, so it didn't corrupt the trial.

    @@carlosharris8998 No, actually, it _is_ how it works. Think about it: most people who are tried are found guilty. That means that most defence witnesses are found to have lied. Most defence witnesses do not end up being charged with perjury.

    @@Thepopcornator But; lest anyone forget and like my retired Deputy District Attorney brother mentioned often post-trial, specifically regarding "stricken testimony": "Human beings are fallible despite their best intentions as a jury member.". Judge Merchan was correct in not striking Costello's sworn testimony, and the Defense team should thank Judge Merchan for NOT embarrasing them by "disregarding the testimony of their star witness Costello.".

    Isn't it insane? The lawyers I know IRL are very intelligent and capable people. One of them showed me her LSAT study book, and I literally could not understand any of it. So no, he wasn't reluctant about testifying, far from it. He wasn't looking for an escape hatch to save himself from immortal embarrassment. He was ready to go down in history as the star witness who, at the eleventh hour, would exonerate the criminal defendant Donald Trump and make his own name in the pantheon of the new order. But that's not, in fact, what happened. Because reality caught up with these miserable wicked sycophantic lying conspirators. And Costello, far from making Trump look innocent, firmly and credibly and with specificity established his guilt, his intentional involvement in a deception. We know he was brought in to say Cohen told him Trump didn't know about the payments, and didn't Cohen say he lied to Costello when he had said that because he didn't trust him. Not sure what that means. But what was the point of the prosecutors tie-ing him down on emails and texts and meetings that Trump used him to get Cohen not to cooperate. Not earth shattering really. There's more storey about his antics to the judge than what actually was revealed, do you know anything other , it hard to find the transcript in full So i'm still not sure what the relevance is.

    Most innocent people don't testify in their own defence. Waiving the fifth amendment is considered by most defence lawyers to be a bad idea. It's only notable for Trump because he always claims he's going to testify or spuriously claims he's not allowed to. He does the same in civil trials and he did the same in his impeachment a and other congressional enquiries.

    Perjury is rarely prosecuted unless it changes the course of the trial. If a witness lies and the jury doesn't believe the lie (either on their own or because it's shown to be a lie on cross), it's usually not worth prosecuting.

    There's an interesting series on Netflix, British, called "Bodies'. Science fiction. A crucial phrase in the whole series is:"Know you are loved". Without spoiling things too much, bad things can happen after someone says that. An email ending in "you are loved", that's almost as clear as a kiss of death.
