ATF Says No More Form 1 Suppressors - Are SBRs Next?

The ATF put out an open letter last week, saying that "solvent traps" don't exist and that they cannot be used to build a Form 1 suppressor, anymore. This basically leaves expensive Form 4 factory built suppressors and VERY lengthy wait times as the only real way to get a can anymore. If they can do this with suppressors, what's to stop them from doing the same thing to Form 1 short-barreled rifles? We've already seen them try to make braced "pistols" into illegal "unregistered SBRs" over the last year, and the consequences that had on the entire gun community. Even though we eventually got a national injunction, it was a major problem for a lot of people while the court process was taking place. What will they do next to infringe on our rights?     The only way to deal with the ATF is to eliminate it...move all their personnel over to the border patrol or they can quit. Abolish the NFA...anything else is just giving up rights and/or kicking the can down the road

    Why is the ATF so concerned about sound suppressors? I would love to have one because I've already lost a considerable amount of hearing ability and I need to protect what I have left but the cost of a suppressor is way out of my budget and the hoops and hurdles are just annoyingly unnecessary. The ATF needs to leave us alone!

    Yeah. It's pretty ridiculous. Suppressors are safety devices. Everyone should be able to acquire them without any extra hoops and hurdles or exceedingly expensive costs.

    The idea is to constantly increase all gun laws, so more and more people can be charged on technicalities. It’s happened in many countries. Essentially creating so much red tape no one can get a gun. Do to their recent losses in court, and the liberal administration, they will attempt to ban anything they can.

    As with most things the gov't wants to restrict: tax revenue. If they thought it was such an existential threat they wouldn't ignore it for $200, which tells me its just a way to get cash

    I just went through the eForm 1 process for a suppressor back on Dec 1st. They literally try to get you to incriminate yourself with their own language, and what they want you to supply for the application. They require you to submit a picture, asking you to show and describe what materials, parts and components you will be using to build the suppressor, which according to their new interpretation, having the materials and parts prior to the tax stamp, indicates illegal intent, yet they want you to submit what parts you will be using, thereby self-incriminating. I submitted a picture of my empty desk, stating as much on my application. We will see how long until they shoot my dog...

    That's absolutely ridiculous! I was thinking the same thing when people were registering SBRs during the whole pistol brace thing. They wanted pictures of the firearm, which they were already considering to be an illegal SBR, before approval. What if you didn't get approved? I guess your dog got shot...

    @CuttinChris so the denied the original application after 12 days. I resubmitted with a piece of paper printed out with a statement saying I will only be using commercially available materials, and giving general dimensions of the final device. I printed that out, and uploaded it as the required picture, I never mentioned the word 'parts', and it was approved 9 days later.

    For those who do NOT understand the meaning of “Rights”, we need to make it clear once and for all: The 2nd Amendment does not apply to semi-auto rifles, nor does it apply to bolt action rifles, pistols, or revolvers. The second Amendment RESTRICTS GOVERNMENT. The technology of the firearm is irrelevant. The restrictions on government remain the same, regardless of the firearm. The 2nd Amendment was not written to grant permission for citizens to own and bear firearms. It forbids government interference in the right to keep and bear arms, period. The right of the people to keep and bear Arms shall not be infringed. This also applies to the other ‘Rights’. They are not granted, they are stipulated inherent rights that the government may not prohibit.” There needs to be another amendment added to the constitution. No government may tax, prohibit or otherwise impede a constitutionally protected right of a U.S citizen and may not strip the people of any right indefinitely. Otherwise they aren’t protected rights, they are privilege granted by government.

    Problem is, you have to get a court case that directly challenges the Gun Control Act on 2nd Amendment grounds. Then, you have to get it through the Appeals courts and then get the SCOTUS to take it up. The deck is stacked against us and the Constitution. They make it an administrative nightmare to even challenge their 'rules' and laws. It takes creative lawyering, luck in drawing the right judges, and a TON of money. At this point, the cost of ammo might be cheaper than the courts.

    i expect people to die on this hill and not simply hand everything over because its "the rules" now. I heard about this guy on TikTok, non violent respectful guy that just put a stock on his pistol without filing a bunch of paperwork, paying $200 extra, waiting all year. Why should he get thrown in federal prison for 10 years and face a $250,000 fine for a slightly different arrangement of plastic on the end of his gun? This isn't really a free country anymore unless your ready to die in an epic shootout with actual tyrants.

    You will never win a fight just by yourself. It is important to make a stand but it is important to also have the power to execute that stance successfully. It is important to have lots of friends who will drop everything and come to your aid if necessary and vice versa. It's very important for people to not just poke the bear without any plan of action, as people getting killed or imprisoned is pointless if they aren't present when they are needed. Especially since it is really easy for people to just not comply secretly.

    Yep. I've got a few, myself. My first build was an Aero Precision EPC-9 and my 16" 5.56 has their Atlas R-One handguard on it. I've been perfectly happy with their products.

    That should be correct, because supposedly the ATF only regulates inter-state commerce, but the state of Texas sued the government to be able to let their citizens purchase and own made-in-Texas suppressors, and I think they lost, unfortunately. I'll have to look into that again, though...

    Im a midle aged guy who is normally pretty chill. I bumped into a pair of ATF agents at a meeting. I engaged in a friendly manner to see where these two guys stand on all of their agency's infringements. Immediately, these guys went full gustipo on me and were trying to defend their agency's actions on the pistol brace and recievers rule. I left them with this. Gents, it is appearant to me and most of the nation that your agency is not acting within the guidelines of the US constitution, which by the way you all were sworn to protect and uphold. It is the opinion of my fellow countrymen, myself included that the ATF is not needed, wanted or respected. You all are constantly flip floping on matters depending on who is elected and sitting in comanders chair. You are constantly breaking the law you're sworn too. By trampling on our God givin rights we as a nation have turned our backs on the ATF. Some of us already see the agency as a enemy of the state. So I asked what would compell anyone to choose a career with the ATF.

    So is it just solvent traps? Or is machining one still potential for form 1? Been kicking around the idea of machining a 10/22 heavy barrel into an integral (less the gas tap port). Just been considering doing something different.

    Given enough time and enough rope, or inches, it will be illegal to ASSEMBLE anything on your own. In an AR platform, name one part that is actually built by most end users ? The lower parts kit ? The bolt assembly ? The barrel or upper receiver ? The handguards ? Nope, almost everything is purchased and assembled by the "owner" if they build their own; so it's not really building, but assembling parts manufactured by other companies. Left alone, this interpretation will come to pass.

    That's one way to do it. There are a lot of great suppressor manufacturers out there, though, and filling a Form 4 is the only real way to acquire this suppressors currently.

    Why are you giving different information from the others as it relates to braces? ATF lost the ruling on brace ban yet you’re saying a form 1 is required. I’m confused…..

    I'm not saying a Form 1 is required for a brace. A form 1 is only required if you want to make your gun into a Short Barreled Rifle, so that you can put a real stock on it.

    The ATF will do anything to disarm law abiding citizens, Constitution or not. The government is worried that the people will interfere with them as our rights are removed. 2A was written just for that reason, to protect the public from anarchy.

    I bought a suppressor in March of this year, and got my stamp in October. “Only” seven months. The .22 LR can I bought in March of 2021 took fourteen months to get my stamp. Absolutely ridiculous.

    The ATF doesn’t hate that you can own short or quiet things. ATF, just likes that there are rules they can enforce to justify their existence. The more rules there are and the more complicated or vague those rules are the better they can twist them to use them against innocent people. It’s not emotional. They just need to bust people for something or their funding goes away.

    I'm not sure why it would take that long for a Form 1. Usually they don't take as long as a Form 4, but I think my Form 1s took about that long, too. Hopefully, you've gotten that approval, by now.

    Personally I think the long game here for them is to completely eliminate the form one where you have to buy everything from a manufacturer……. and honestly if they had their way they would get rid of the “other” option on the 4473 and you wouldn’t be allowed to buy a stripped lower and build it yourself

    I guess my biggest complaint is that a Texas lawyer was able to make suppressors legal to buy without ANY FORMS, in the state of Texas, if you are a resident, and the suppressor was manufactured in Texas. Since this is a new state law, it should pertain to all 50 states, and we should be allowed to purchase from anywhere within our 50 states, and get it delivered to any of the 50 states.

    @@sawtoothtactical404 it was initially struck down, by a court saying since no-one had been arrested for attempting to make a 'Made in Texas' suppressor yet, the ATF had not actually infringed on anyone's rights yet, and therefore, the suit against them was frivolous. Was a complete cop-out. Thankfully, it has been appealed and pushed up to the next circuit, which is much more 2A friendly. The basis of that suit, is that since the Federal government should really only have authority through the Interstate Commerce Clause, if a specific item was made, manufactured, and indefinitely kept in Texas, then the Fed should technically have no jurisdiction over it, because the State still has it's own level of sovereignty. The Federal jurisdiction would only come in to play, if it was attempted to cross state borders.

    Feds have been arguing over jurisdiction for decades. They only have the constitutinal authority to "regulate interstate commerce", so anything made in 1 state & sold only in that state is NOT under their "authority" to regulate. Wyoming & a couple other states have argued the same over guns manufactured & sold only in their state.

    You don't get to tell somebody else what to do with their own property. The role of government is not telling people what they can or cannot do with their own Private Possessions like it belongs to government, it doesn't. It's property of the private owner, not federal scallywags who steal tax payer money thousands of miles away. Nothing the atf touts has any legal merit or authority. The atf is an unconstitutional and undelegated agency who's very existence is at complete odds with Constitutional Law for starters. Major property Rights violations here.     I filed for two NFA items back in November. One was a form 4 suppressor, the other was my form 1 SBR. As of two weeks ago I have my suppressor at home, while the form 1 SBR is still in ATF jail

    contact your congressional district rep. the ATF liason will email you back with an Information Release Form, fill that out. The liason will contact FBI {background check} and the ATF. You will have your stamp approved in a few days.

    It has nothing to do with it being an SBR the fact is they don't want it classified as a pistol because in most states you cannot carry a loaded rifle in your vehicle but due to it is a 5.56 pistol under the law you can carry a loaded pistol in your vehicle and on your person as long as you are not a prohibited person

    I’ve never seen a state where you can cary a pistol but not a long gun. Most states you have to be 18 for long guns and 21 for hand guns. So hand guns are more restricted. Curious if you know those states let me know which ones. Not saying it’s not true… I’m just curious to learn.

    I imagine that they are looking to make these changes in order to test the waters for future changes: 1) Pave the way to re-instate the failed 80% frame and receiver rule under different context 2) Put AR's and other semi-autos under the NFA registry and make them harder to get (combines with AR ban and semi-auto ban goals). 3) Frustrate and decrease firearms ownership in order to decrease public knowledge of firearms and resistance to eventual bans and confiscation.

    The feds already have everything in their data bank about you, except maybe a recent pic & prints. They have the pic with your D.L. & if you've ever had to pass a background check for anything, they have your prints.     @@sawtoothtactical404 1911 are very expensive for what they are these days. If you are interested you are much better off making a 2011. The build process is basically the same but you get a more practical handgun. 1911 and 2011 aren't super hard to make but there is just a lot of different tolerances for them unlike AR and Glocks where the specs are so standardized you almost can't find a bad part.

    Having freeze plugs sized for a flashlight that you own may be construed as constructive intent. No different than owning an upper assembly for a pistol while owning a rifle that the upper would fit.

    At one time I was going to build an Uzi kit with the fake suppressor so I could build it as a rifle with a short barrel, but now the ATF has made fake suppressors into real suppressors.

    I didn't know that. I thought you could still use a faux suppressor to get to the 16" barrel length, but it would make sense that they would try to regulate something just because it looks like a suppressor... That sucks!

    It should go away with the frames and receivers rule but I am not so sure considering the SCOTUS vacating the district court vacating the entire rule. The 5th Ruled against the F&R rule but I am not sure. If the Supreme Court doesn't hear the 5th CCOA last ruling, it is over but to what extent? A fake suppressor is a suppressor currently.

    But what about all the people that actually do just want to collect their solvent when they clean their guns, and have no intention to ever fire a weapon with the solvent collector system on it????? Never intend to drill any holes and never intend to modify it in any way?????? What about those people?

    Can't get either of these in Commiefornia....pray we can work these through the courts with Heller and Bruen...but that will take years and a lot of money...the fact we have to fight to reclaim a right, taken from us with our own tax dollars, is abhorrent....and cause for another party....just not tea...

    It is really crazy that they use OUR tax money to strip us of our rights and then it costs us MORE money to fight to get those rights back. That's not the way our Founding Fathers intended for our country to be ran.

    I got sick of waiting to see what would happen with the brace rule and I wanted to be able to shoot my guns on the channel, so I SBRed a few.
