When they said “their tuna isn’t tuna” I was like “eh a lot of things have artificial stuff in it.” But the more Subway says “TUNA IS TUNA” the more I think there is definitely people meat mixed up in there.

on one hand them constantly saying it's real tuna makes it seem like it's not tuna. but also if it isn't tuna this is the wildest, biggest double down I've ever seen

Part of me is like “this is a LOT of doubling down for it being real tuna” but also if it is real tuna, what else can you say??

I am willing to believe that the dna test was not entirely accurate due to the limitations of testing but whatever is in those sandwiches is DEFINITELY not tuna

Anyone who includes screenshots of these things for posterity deserves a Medal of Honor. 👋👋 (But also, Subway keeps saying “is *made with* 100% tuna”, not “*is* 100% tuna”, so I think they’ll win on semantics alone, as long as a tuna is involved somewhere in the manufacturing process. Like, Javier in purchasing buys one ounce of tuna and mixes that in with the 33,000,000 pounds of Mama Freddy’s Flaky Fish-Flavored Food Product.)

There's actually tons of reasons to believe this lawsuit isn't made in good faith. The plaintiffs have repeatedly refused to submit any evidence or data to back up their statements, and recently updated their complaint from "there is no tuna in this" to "it's not 100% tuna like they claim," which directly contradicts their original statement. There's a lot of stuff here that's indicative of someone making an outrageous but not immediately disproven claim about a big corporation in the hopes that they'll try to reach a quick settlement to get rid of the bad press. I hate to side with a garbage company like Subway, but in this specific instance, this whole situation is almost certainly a complete farce, kept alive by people extrapolating from inconclusive testing that the original journalists even stressed was by no means a totally consistent result

@@JohnWhatshisdoe that then raises the question: Why on earth did someone wake up one day and decide; "I'm going to lie about Subway's Tuna then sue them and take my lie to a court of law." I know the easy answer is just "for money" but surely there are easier scams to pull then suing subway over a tuna lie

Having worked at a subway, I can say the "made with" may refer to the fact that it's mixed with a bag of mayo before being served. That said, I cannot, at all, remember what the bags of tuna looked like. Which is a little upsetting.

@@apassionatenerd.3564 People with a few hundred thousand of disposable income invest in passion projects all the time, it would not surprise me at all if the prosecutors had been CONVINCED after years of tuna sandwiches that there wasn't any actual tuna in the food. It's not a huge stretch to imagine a situation where they hired some independent research and got promising initial results, and thought "we could make some money off of this." Then after committing, realizing they essentially had no case beyond a baseless premise, and sticking to it in hopes of a settlement. This would also explain why the independent research done by that news company turned up the same erroneous results. This type of DNA testing can be extremely unreliable if the material being tested is processed to the extent Subway tuna is, it's basically leaving it up to chance if the DNA in the samples hasn't been degraded enough to be properly identified. If you do an improper job of consulting professionals on testing and food logistics, you could pretty easily be tricked into thinking you have some damning evidence(which is also why the journalists doing the extra research stressed in the original article that the tests were unreliable for this task and that a more thorough investigation was needed before any conclusions could be drawn). That being said I have no issue with people continuing to believe it isn't really tuna, because it probably makes a lot of subway executives very upset and that's really funny to imagine

So, for those coming here from the future: over the LITERAL YEARS this case has been ongoing, the judge has ruled that there is no evidence that the tuna doesn’t contain tuna, indicating that yes, there is actual tuna in there. However, the present version of the case alleges that this “tuna” is also mixed with other fish and meats, so, not entirely pure.
