I caught this guy twice. I'm not sure whether swiping through Tinder would count as interactive communication under the old mobile phone laws, but that sent message on iMessages was an absolute slam-dunk of an evidence catch. The second time I caught him he was holding the phone, and under today's laws that would likely be enough evidence for a prosecution, but it wasn't sufficient evidence in November 2021.

You are 100% doing the right thing, as a car driver and motorbike rider people who use mobile phones are a danger to everyone who uses the roads keep up the great work.

Don't limit it to drivers and motorcyclists (really?) - anyone on the roads using a phone is a danger. They are not paying attention to the world around them.

@@FFVoyager Agreed. I'm a keen cyclist, but would never use the phone while cycling or even walking along a busy road. So many of us are mindless zombies to smartphones. They are the worst thing ever invented in my opinion.

Audi BMW owner drivers have different genes and are immune to conformances. We "rich" people can afford only Ford Fiesta or while a lot of these "poor" Audi BMW owners seems to be suffering from hardships!!! They are so poor that they cant afford to use built in bluetooth.!!

I agree a ban would seem appropriate as he clearly isn't bothered by a scolding from a judge and the hastle that comes with that. But you miss the point of the hardship thing... it isn't always about money. It can be but also if you are a carer you could say a ban would cause hardship to the person you care for. I think it is a good thing to have but it is clearly abused. The number of drivers with over 12 points and still legally allowed on our roads is too big. I guess with cuts to Police numbers and a backlkg of cases nobody js ever going to check the hardship thing so people will abuse it. Lets face it, those that get in that position are not trustworthy types really.

100%. Interesting how there don't seem to be many comments this time saying "at least he was nice about it". I guess people can see through his act. For me it was the sheer number of times he excused himself. Near the end it definitely seemed insincere, especially as Mikey was cycling away and he was still repeating himself.

I am following you because this is great work, I watched a fatal accident on the A11 Epping to London road at Loughton, Essex, a Fiat 500 a small car was in front of me with a female texting on her phone, she pulled out into the path of another car that was at the speed limit of 60MPH, I was out training on my bike, I pulled along side her just before and watched her using her phone, just three seconds later she was dead. T-boned and dead all for a mobile phone. The other driver was also injured, that is something you never forget. I had just ridden 100 miles, with no incidents and then bam witnessed that.
Totting up points shows how little respect he has for our driving laws.

Mind you the more miles you do the more points your likely to get as well as more accidents your likely to be in. The wider area and the more miles you do the more experienced you are but the less familiar you also are with those areas so the more experienced driver is more likely to get points which is rather misleading.

Its funny how his attitude changed between being caught the 1st time all apologetic to get off with it, then 2nd time had a right attitude because he realised he wasn't getting away with it
Wonder how sympathetic someone would be to the driver killing their loved one, whilst on his mobile? What a stupid thing to say!

Good job Mikey. The driver seemed sincere but he knew better. Funny that you caught him again. I don't know if he's going to change but you have given him a concern for every cyclist passing him. Cue the Jaws theme.

After the first time I thought well, that apology appeared genuine, but after the second time there's no doubt that reporting his phone use was 💯 per cent appropriate.

Half hearted apologies won't bring back the dead, these scum need lifetime bans.
If they HAVE to touch/use their mobile while driving, let them pull in. You are more optimistic than I. I suspect his compliments and thanks are the words of a smooth operator rather than a kindly reformed soul.
Spins a good tale but actually leniency just enabled his behaviour. A real shame he wasnt penalised this time. He's risking other people's lives and well being.
Funny how this man is trying to make a relationship but at the same time could potentially ruin someone else’s relationship. True selfishness.
He seemed genuine the first time you caught him but he definitely showed his true colours the 2nd
Another good job Mikey, I was very suspicious of the ‘sincerity’ of his remorse in the first clip (with his Uriah Heap impersonation), he had a different attitude in the second when he knew he couldn’t sweet talk you out of reporting him, true character came out. Disappointing the police didn’t at least send him a FPN (I think he’d have paid up without challenging it). The hardship defence has worn pretty thin in my book.

A Fixed Penalty Notice isn't an option where the driver would go up to or over 12 points on their licence. 12 points would be a ban normally and has to go to court.
As a car and motorbike rider - I have hands free Bluetooth on both - if you are holding the phone whilst driving you deserve a 3 month minimum suspension zero tolerance

All that guff thanking you for pointing it out so he won't do it again is about as impressive as the acceptance of his excuses by the court so he can continue to endanger others. This is just a very manipulative careless driver who only thinks of himself and a system which makes every excuse for "hard working drivers".
The fact they don't even notice you approach is evidence of a lack of awareness right there!
"It's hands free" but holding it in his hand, whilst coming to a halt on a pedestrian crossing through lack of observation. A Tinder maniac, but "I have a daughter" weird excuse so as not to be judged as a pervy old man.
I actually felt sorry for the driver until I knew he already had 12 points. No way he should have gotten off with it
Well done, sir. That's a very decent thing you've done and also necessary. We should all take more personal responsibility for our own actions as well as others and you've done so while maintaining the dignity we all deserve.

A very interesting clip, and the extra scoop was wonderfully insightful. I am interested in how you manage to find out when those you have submitted evidence against are going to be in court. In April last year I was severely injured in a collision that wasn't my fault. I dearly wanted to attend the driver's plea hearing for a sense of closure, but getting info from the OIC or court administration was like getting blood from a stone. Several times folk at the courts questioned why I wanted to attend... either which way, I heard it had been postponed, and then the next I heard was he had returned a guilty plea and received a smack on the wrist.

As the reporting party he will get a notification from the Police re the courtdate and he can attend as a witness.

Exactly and it doesn't - or shouldn't - bother them too much that we are concerned that they properly observe the highway code. They should be pleased if anything that people really do give a damn and that there is concern out there for the safety of other road users.

Do you ever go after cyclists who text on their smart phones while riding hands free? Or they are riding double, listening to music with earbuds ? I bicycle commute everyday, rain or shine.

Using smartphones while riding is not illegal for cyclists in the UK (And riding a bicycle with no hands is discouraged, but perfectly allowed). Riding double? Do you mean riding two abreast? If so, that is not illegal either. In fact, it is even recommended in the new wording of the Highway Code (Rule 66) And it is not illegal either to be listening to music with earbuds while cycling.

I had some sympathy with the guy's exceptional hardship right up until I saw the November footage. I'd be surprised if he's learned his lesson, even now.

Exceptional hardship driving an Audi S3. If things are that bad either sell it or hand it back and go buy a bicycle or a buy a 1998 Fiat Cinquecento and stop using the phone whilst driving. It’s not rocket science.

@@geoffpoole483 That's a bit of a stupid statement, claiming financial hardship is in relationship to losing a job through losing a licence, people with nice cars which often belong to companies or they are on finance with big monthly payments. Magistrates don't normally fall for sob stories you have to provide evidence....

I think nearly everyone who watches your channel appreciates your overall thoughtfulness. We appreciate that you remain nuetral and aren't swayed by gender, age, race or a pretty face. In the end it is true- can't do the time, don't do the crime.

I think you are doing the right thing. Texting / Tindering / Using the phone whilst driving is a distraction and can / does cause accidents. The police aren't interested here but its good to see they do something there. Did he learn his lesson ? NO ! The ones that really bug me are the ones doing it in motion. Some even do it on the freeway at 80 - 110 KPH. Looking down for 3 seconds at that speed is the same as crossing a football field without looking. Over here the fine is now $1000 and 3 points off their licence but I still see texters. They go, "Oh, it will cause me hardship / I need my car to get to work because the bus takes an extra 15 minutes. Too bad ! Ps I'm not familiar with Tinder. Is swiping left saying you like the person or is that bypassing ? I noticed he swiped down a few times as well.

The question you posed: are you doing the right thing? That is a real dilemma. Part of me suggest you should report blatant phone use but as a citizen it is obsessive to go looking for it. On the other hand I commend your efforts and in an ideal world there would be people employed to do exactly what you are doing in every town and village across the country.

Mikey is doing the right thing for sure. Some of these drivers will never change. But if just one person he stops/reports does actually change their behaviour and always keeps left at pedestrian refuges or never again uses their phone while driving then Mikey is preventing harm. As you say we need more people doing this in more places. It's the only way to spread the message that phone use while driving is unacceptable.
Despite the NIP this driver was still up to his old tricks. I'm not convinced that he has learnt his lesson but only time will tell..... If you catch him again, which I'm inclined to say is likely, then he'll regret meeting up with Mikey. Thanks for everything you do 👍

What a fool that guy is! Says he’s sorry, acts remorseful but the reality is somewhat different. Keep going Mikey as you are undoubtedly saving lives. Word gets around you’re on the lookout which puts off people with a touch more intellect than this chap
If a driver has kept their licence despite exceeding 12 points due to exceptional hardship, then that should be a one time thing, they shouldn't be allowed to repeatedly offend and keep their licence.

You really won't know what this guy feels unless you could see into his head. My first thoughts is that he is a con man, a psychopath who escapes all blame by virtue of his charismatic personality and telling people exactly what they want to hear. The fact you caught him again with the phone and that he already had TWELVE points displays NPD and a lack of conscience. He'll be in court again soon.

I lost my wife & young son to a guy that was using his phone while driving, he ended their lives at a zebra crossing on the old Kent road london a couple of months ago, he's now doing a 10 year sentence but that isn't going to bring back my family, so if your reading this do the right thing a don't use your phone while driving ✌ PEACE✌

gazza Robo .... I really cannot imagine how you feel after something like that, my condolences to you and I would give you a heart if I could. This is what makes Mikey’s work so valuable, if it just makes drivers put down that phone, it is all worthwhile. One other thing that really makes my blood boil is the idiots that come on here and comment grass, snitch, get a life/job etc… They have no idea or don’t care, of the devastation phone use can create and I’m sorry but I am not as polite to these people as Mikey is. If he really does change his mind after this and make a deliberate effort to drive with more care and consideration for other users, then full respect to him for doing that. Until then, he doesn't deserve to be behind the wheel for more than 10 seconds. It is hardest for those most entrenched in bad habits to actually change for better. This guy has a tough climb to reach that point but with determination and effort he could get there.

you are right mikey. im a biker and just on saturday a bmw car pulled into my lane as i was overtaking. he didnt indicate and was holding a phone. he was that distracted he didnt look in his mirror or turn his head to look. my sixth sense kicked in and avoided him. keep it up.
It's easy to be swayed by stories of hardship, but what sort of person, with twelve points already, and who needs to keep his licence, looks at Tinder while driving? Sorry, that's despicable, and no amount of hardship plea should prevent a ban. No sympathy.

Not really. Bruce Wayne is a psychopath. He's a man with the money and influence to effect real change, but instead prefers to dress up and beat the living daylights out of mentally challenged and disadvantaged people who took the wrong path because it makes him feel better about the traumas in his own past. Batman isn't a role model for anyone. Sure, he might not kill when he catches up with his prey, but I wonder how many people he's left bankrupt and destitute after their medical bills, forcing them to go further into a life of crime so he can snap their other arm. Plus, how many lives could have been saved by him actually killing his rogues gallery, rather than throwing them into an asylum with a revolving door so they can escape and kill again? Batman is the worst thing to happen to Gotham city. Ahem. Sorry about that.

Definitely doing the right thing clearly this gentleman has learnt nothing . Know what frightens me more than anything else when I'm out cycling , which is almost every day , is a car coming towards me and the driving looking into a phone .

The driver was paying zero attention to the road.
If the defendant claims exceptional hardship, the court should offer them a custodial sentence instead. I'm sure the defendant would change their minds. Anyone who gets hit by a phone driver and becomes disabled would experience exceptional hardship without choice.

The only exceptional hardship this person has is understanding thst he is a danger to other road users, typical Audi driver from my experience as a Motorcycle rider, what will it take to make him learn?

The hardship loophole is complete BS. We have a point system so people can learn from their mistakes and not lose their licence straight away. Anyone who has that many points and continues to put others at risk deserves everything they get. The loophole needs removing to protect innocent people and to stop protecting idiots like this. You're doing a great job!

This particular case sums up what I have personally said for a long time. It may sound flippant but these types of phone users are similar to heroin users.
