Sideboom as others have stated. A simple google search returned that he defaulted, FCC turned it over to the DOJ they sent him numerous summons and he never showed up to court. Then the judge issued a garnishment on his wages.

What's the old sideboom? Ya can't fight city hall? And the federal government is slightly larger than city hall. Now, to see if he manages to win the grand prize, "The Court is dissatisfied..."
Did a 2 second google search to find a case in US district court in 2021. He didn't show, so there was a default judgement. They started garnishing his wages in 2022.

The fcc has no real power for fines. They refer it to the justice department for collection.
Note the Supreme Court decision from Friday 6/28/24. Loper Bright Enterprises v. Raimondo. The Court overruled their Chevron case from 1984. This will restrict the alphabet agencies rule making authority, forcing them and lower courts to adhere to the Administrative Procedures Act of 1946 again. Also, they decided SEC v Jarkesy on Thursday 6/27/24 that requires the SEC to seek financial sanctions in regular Article III federal courts (where the defendant can have a jury trial by 7th Amendment right) and not their in-house Administrative Courts. This may have an effect on big fines civilly attached by alphabet agencies by fiat. These are important decisions for the average citizen.

In los Angeles there's a repeater on 2 meters last 15 years they broke every fcc rules and laws they are still on air 🤣🤣🤦♂️🤦♂️🤡

The FCC is understaffed and has been for a decade. Their priority is wireless services and interference in these services. Broadcasting is even in the back seat now so you can imagine where ham radio and 27 Mhz and UHF CB radio fit into their enforcement plan. One thing that is common with every service and that is if you don't interfere, you will never hear from them. I have been dealing with the FCC for over 40 years and the question today when you call them is, "Are they interfering".
I live local to this guy! He was a real Pain.....

As you said, it's not specified what the 'intentional' interference was. I did in fact make a mistake when using winlink on my Yaesu FT-8900. I use a SignaLink sound card with the radio. The SignaLink has a vox transmit switch. So...I left the power to the SignaLink on and retuned the radio VOR to a repeater. My computer got a bit crazy and began to send sound to the SignalLink. The sound was some digital mode, but not sure what. The radio activated its transmitter as expected, sending random noise to the repeater. As soon as I noticed the problem, I turned off the SignaLink. I hope you learn from my mistake. Booming on the side, Jim N4FAF

Sideboom! If the ARRL is going to post these articles, I'd like to see a lot more detail regarding the actual offense. Speaking only for myself, I follow the rules and regulations because I value my license and see no need to do anything that would create problems for other amateur radio operators. While I know the FCC is limited in their abilities to go after offenders, the accused could die of old age before the FCC found them. There seem to be asshats in every hobby...

They went there for the interference complaint and the fine for not identifying was just an added bonus.
I bought a new 12 element Yagi. The bracket wouldn’t allow me to install it perpendicular to my mast. So I bolted it on as a SIDEBOOM!
The biggest jammer in California got a huge fine. They took his equipment but he took it to court and they dropped the case because the government wasn't sure how to prosecute him. He was jamming a business. That's about the only time they care

Generally once they identify the issue there is a warning to correct the issue as is our responsibility once identified . This tells me he refused to do that or ignored the notices leading up to the fines since it took several years . Sideboom , they probably had pictures of him using said radio as well. IMHO

The FCC rarely does anything to or for Ham radio- unless they're being ignored. They positively do not like being ignored, and doing that will cost you bigtime.
Sidebooms an odd one lol. I'm trying to understand the interference. I get the lack of ID but I didn't hear anything on interference other than running digital over analog but that wouldn't be interference.

It would be interference if you were transmitting it on top of someone else or were doing it with the intention of preventing others from using the repeater. Running digital modes over an analog repeater is fine though. Just be sure to get permission from the repeater's operator first.

Good morning ‘Sideboom’ Jason, kc5hwb, Paul kfØaot here, Colorado Springs, how are you this morning? I’ll keep this short since your probably busy. Nice shack you have there, is that a Kenwood behind you? I was watching an unrelated video a bit ago, and at the end there appeared a recommended video of your quiet repeater story, first time I’ve ever had that happen (a Ham related video, not just a recommended video, but I digress)! I made a note of the 146.52 repeater, I was unaware of it’s existence, as I am most things ham, could you elaborate some on how to access it? The repeater I’m using here, 147.345 (+600), sits on top of Pikes Peak and, I’m told, is a linked repeater although I cannot tell you to What it’s linked. I think a number of repeaters across the front range, but I do not have a list of what repeaters nor do I know how to get a list of those repeaters. You might be able to tell I’m not on the air much here. I am a severe weather watcher, trained through the Pueblo NWS station, and I am a ‘member’ of the local weather Net here, which is the extent of my involvement with amateur radio I’m sad to say. I don’t get out much these days (disabled/retired law enf.) but, on the bright side, I am listening in most of the day. I said I was going to keep this short, didn’t I. Anyway, I enjoyed both of your videos and subscribed as well. I’m looking forward to watching more of your videos, which I will do after I eat! Take care! 73’s!
Does the FCC give any warning or put the station on any type of probation? It would seem that that operator should be more aware of the responsibility and privilege's that is given to him for his license. Anyway, I completely feel "moobedis" about this entire matter! It was preventable. Jason, I agree with you about the need for ARRL doing a follow-up. It would be interesting to know the rest of the story! If the ARRL took the time and effort to report the violation, then it would be nice to know the entire story! It just might help another amateur better understand the consequences of violating the FCC rules. Perhaps this guy had no technical clue as to his chosen hobby!? Ignorance is no real excuse, especially if we are legally granted the privilege to operate a radio! Since the amateur radio licenses got watered-down years ago, most amateur radio operators do not have the technical know-how or care to really take care of their equipment or operate on the air. This isn't CB radio! Its a privilege to earn the amateur radio license and if a licensee isn't up to the task, then they will most likely pay the consequences. I only hope that more amateurs who earn their license has a desire to understand and learn the technical part of this hobby.

Well said. The vast majority of licensed Amateur Radio operators today are "appliance" operators.....take it out of the box, plug it in and they're on the air. They wouldn't know a diode from an inductor.

Sideboom? Sideboom antennna... is that a thing? ? Maybe it's just for construction equipment. Anywho... being a dork aside... I'm tired of these lids coming onto the radios and just being juvenile and causing chaos. We have rules for a reason: To keep these services available for anyone to use. Same with driving. If you're gonna be a jerk and cause people problems, then you deserve to be caught and fined. Probably why CB is such a mess sometimes.
I listened to this through my new headset with a switchable sideboom mic. It is NOT true that it takes all kinds to make the world go round. We could do without the likes of them.

Why don’t these clowns BEHAVE ? This is one of my biggest peeves in ham radio. I’ve been licensed for 34 years, never any trouble. Sounds like some have no life, and nothing better to do. Amateur and CB are two different things !

11 meters (CB) use to belong to we hams. That was a sad day when we lost it.
This went to court. Materne didn’t show up and basically told the court to pound sand there was nothing they could do. They are now garnishing his wages.

What are the odds it being a mistake finding a location of the suspected interference being the location of a ham operator that is licensed to operate in the frequency that is receiving interference and them not allow the fcc to inspect the station? Refusing to let them examine your station is already grounds for license revocation.

Okay, first of all I watch ALL of your videos to the end. It's all in the title that draws my attention. I have learned a great deal by watching them. Second, those that choose to interfere with on-the-air Ham activities, have no place in the hobby. They should be fined and worse in my opinion. Sideboom. In cities now they scan and direction find you in Norway, but how often they act on things I do not know.

It’s like people don’t know about or forgot about fox hunts. But the question is, can you use a sideboom in a fox hunt?
Sideboom is not what that guy is saying. He is saying I don't need to follow the rules. The FCC says otherwise.
With or without any sideboom, if you just own it and stop it, they are satisfied. Bulling up? Not so much.
The sideboom to go along with this is that it did get referred to the DOJ, and Laterne entered into default judgement. Louisiana Western District Court case number 2:21−CV−02428, USA v Laterne. A writ of garnishment was issued.
People who use their license illegally should lose their license. I have experienced interference in a net we were providing. I think he should have been fined $25,000. Sideboom

The official legal record of the license is on the FCC's ULS, where it says that the license expired in September of 2023, and hasn't been renewed. That's consistent with what the QRZ detail tab says. The bio page on QRZ has a note that says "There is an Extra 'No Code' Class amateur operator on CB pretending to be me pretending to be him." There's more text describing how this "other" operator got an 18,000 fine. I certainly don't know the full story, but something strange is going on with this sideboom. --AG6QR

We’ve got a guy here calling himself a pest on the local repeater. Makes it a habit to come in and interfere with normal communications. Luckily for the community the local police and the FCC are involved now.

So the FCC wants Amateur Radio operators to police infractions. This sounds to me like the locals gave FCC information on what equipment this guy had. It also sounds like he was at odds with the owner or group responsible for the repeater. I’m sure some of the local club members may have known what he was doing, why and got tired of his antics.

I'm not up on the latest ham lingo as I have been out of ham for 30 years, just getting back into it. WTF is "sideboom"? Even googling it I was not getting much because the term is used for a few things. And I went through three pages of google results. As an aside, I might be getting back out of ham yet again but will renew every 10 years as I have been in case of emergencies. Never mind why I might go inactive again. Not going to say but there are many reasons. Too bad too because I just bought a TH--D75 which was not cheap! And no, I won't sell it because I can listen to stuff on it. I'm a radio nerd and sell nothing once I acquire electronics. One thing about the TH-D75 is it's very easy to accidentally hit the PTT and kerchunk. If a fly landed on the PTT it might activate it, very little pressure needed. Then I have to ID on whatever frequency by giving my callsign and then say " Sorry, accidental transmit". So now I have to keep it in xmit inhibit most of the time. No other handheld I've ever owned has posed this problem but it's not a deal breaker for the rig.

Sideboom on the side. If you do an extended burnout at a stop sign right in front of three or four police officer's you are probably going to get a ticket. If you are jamming a repeater for an extended time you have greatly increased your chances at an FCC visit. Pretty simple. Police and the FCC catch only a small portion of offenders but if you are going to serve yourself up then don't complain about the results.
Just wondering how the agent(s) verified it was him as they did not mention that. Did he do the alleged conduct while in his car, motorhome, house. If in his car, then yeah, I can believe it, if in a motorhome, still plausible, but in his home?? Did he let them in, did they observe through a window? If they observed tru a window, was is via a telescope, and listen on the repeater input frequency?? Too many questions!! That said if he did do the alleged things, he should have penalties as this shows badly for all Amatuer Radio operators!

It was at his house. All one needs to do is go around the house with an RF direction finder. If you have a 20 dB over S9 signal and the direction finder is always pointing at the guys antenna or at his house then he's the guy.
I am willing to bet that another operator complained and turned him in.

D-Star, Fusion & DMR were all available in 2017. The digital signal could have been another mode generated by a computer too.
Sideboom. It is funny how people think they can fool the FCC. Their job is to find the source of radio signals. They have been doing it for a long time. If you know what a foxhunt is, they are the best at that. If you don't know the rules and you don't have a license, don't play with two way radios. There are emergency situations but that is not what this video is about. This is just someone thinking they could get away with messing with the FCC and got caught.

Sideboom. I do have a question, though. HOW BAD does the infraction have to be before the FCC gets involved? For example, I'm fairly sure that they're not going to get involved if I key up my Baofeng on GRMS frequencies - or would they? Did this Materne character have to key up once, five times, ten times before they got involved? We all know that if you're going 2-4 mph over the speed limit on the freeway that chances are the Highway Patrol won't pull you over. But your chances go up when you're 10 over. So, how bad does it have to be before the FCC gets involved?

No, they're not coming after your Baofeng. I've said in many videos that if you're polite on the air, then they'll never notice you. This guy was causing interference to his neighbors and they complained. Unsure of how many complaints they got before showing up at his house

It's the issue of public safety that guides the FCC 's enforcement priorities. Just go on the frequency of the local airport tower and start babbling nonsense instructions to approaching aircraft and see how long it takes for the FCC to show up. Not to mention hams and the SWAT team.
I hear people tuning up or whistling over Poto operators, as a Pota Hunter it really crawl all over me.

I am surprised this was a lisensed Ham opertor, its usaully some unlisences moron who causes problems. A local repeater caught a guy with Baofeng radio, they were able to identify the type of Radio broadcasting likely due to the spurious emsions.
