Great advice John. I use Track One for a lot of my clients. And for Canada, where I practice, I file for expedited examination. Yes, the fees are higher, but the rewards offset this.

@@johnferrellesq. John, as an FYI, the logo next to my name no longer applies to my IP practice. I merged with another outfit in Montreal where I’m now managing partner. I might still use a modified version of the logo as I venture out into the world of digital marketing, podcasts and the like

Would the cost to expedite be offset by a reduced amount of work required by your attorney over the normal process?

It depends somewhat on the invention and the examiner chosen to evaluate the patent. It's normally only a bit more expensive overall to expedite the application; although, occasionally, it is very close to the same price, for the reason your stated.

Hi John, I have been building prototypes for a product I hope to sell commercially. It would compete with an existing product that performs similar tasks even though the design is my own. They have patent for their product, but I am not familiar enough to understand how broad their patent is or if my design would infringe on their patent. Is it typical for patent attorneys to be consulted by someone like me to provide guidance on whether it's worth continuing to work on my product and take it to market?
