    Allstate app almost never records my daily trips. Sent email to tech and gave them all information they needed. Everything app needs to work is functioning. Tech never replied back. App is junk. Have uninstalled and reinstalled numerous times. Allstate is useless and I give up.

    I had a car accident back in 2021, and in most states I'd be most confident in winning. Sounds good for me right? Well, go to 5:16, and pause it there. Yep, I'm in a goddang Contributory Negligence state, but I did do everything in my power to avoid the accident, and unfortunately I was in the hospital and physical therapy for 23 days, and have $300,000+ medical bills! Yikes! I did my deposition in late January, and I answered everything correctly, and my attorney is still willing to represent me. Unfortunately, I feel not confident, because basically under the Contributory Negligence law, the defense attorney for the defendant can basically throw a seemingly infinite amount of darts at my dart board, and if any stick regardless of score, I get nothing. SIGH, well, my experienced attorney is who I've got, and we shall see what happens when this goes to trial later this year. Wish me luck!

    Today I was driving out of a parking lot, at a speed of 5-10 km per hour. Slow and a car who was front parked, backed up into my car. He ended up hitting the front side of my passenger door. I believe that he is 100% at fault since I had the right of way in the road, He tried to argue that he was already halfway out of the parking spot yet I am driving perfectly straight on the path and did not swerve in the pictures. He also tried to argue that I was not paying attention in order to share the blame, but my eyes were on the road until I saw the lights of his car light up and the moment that he crashed into the side of my car. Are pictures enough to prove that I am not at fault? The dents made by the car show that there are no drag marks which means i wasnt speeding, and are a clear sign of impact.

    Hey, I'm sorry that this happened to you. Pictures of your front passenger side door should be sufficient to prove that the other driver is 100% at fault since the damage is to the side of your vehicle.

    What if I was backing out of my parking space, but the person on the parking drive way passed a parking and decided to reverse to get into the parking. While we were both reversing, both cars hit. Who would be found at fault.?

    What if a driver in the same household (a relative) was not excluded , not listed and causes an accident with your vehicle with "UM" Coverage ? (At fault) Would the insured vehicle's policy cover damages for the other party (not at fault) ? In the State of Georgia

    Hi, what's is the difference if a car is backing up out of a driveway and already in half of the street and the other cars hits from behind with their front and side damaged. Who's fault would that be. Thank you

  • @theinsurancequotientiq167
    @theinsurancequotientiq1679 ай бұрын

    Hey, so the key thing to note here is where the damage is located on your vehicle. If the damage is located more on your back bumper, then this would indicate that you backed out in front of the other vehicle and would be your fault. However, if the damage to your vehicle is more to the side of your vehicle, this would indicate that your vehicle had established position in the roadway and the other vehicle ran into your vehicle, so it would be more likely the other parties fault.

  • @theinsurancequotientiq167
    @theinsurancequotientiq16711 ай бұрын

    Hey, If the driver of the other vehicle was not on the car insurance, the insurance adjuster that is assigned to the case will look to contact the owner of the vehicle and confirm that the driver had permission to drive the vehicle. If they did have permission and the other driver is found to be at fault, then the other insurance company will handle your damages.

    my situation is I had my insurance company repaired the car for me, I filed a Diminished Value claim with the at-fault insurance company. The at-fault company says they're waiting on my insurance company to send their subrogation demand before they can release the payments. My question is, should the cost of repairing the car be separated from the diminished value payment?

    Happened to me today. Was backing out of a parking spot and was the first one to start backing out and a decent amount out of my parking spot but stopped mid-way to allow 2 pedestrians to cross the parking lot to my left behind me. And in that time, this other vehicle backed in from behind me across from his parking spot. I had honked my horn a couple of times to let him know I was there, but he didn't see and hear me and still backed into me. I wasn't moving when he backed into me and I saw him coming and I couldn't quickly throw it in drive and drive back into my parking spot to avoid him, it was happening all to quickly. Thinking, he might see/hear me, but he didn't. It was but a small tap to the back of my right corner bumper. Don't really see any damages to his or my vehicle. So we let it slide, shook hands and went our separate ways.

  • @wisdomvisionf.
    @wisdomvisionf.9 ай бұрын

    @mikesmith8187 Yeah, it was kinda like that with me and him, but he was claiming that we were both in motion and backed into each other. Well, if that was true, then he would've known I was there. And I wasn't moving, I sat there with my foot on the break and saw him come at me. And I really couldn't move out of the way quick enough and throw my car back into drive and drive back into my parking spot. 1, it was all happening too fast despite the 2-3-maybe 4 mph in that short distance. 2, I'm driving an old 1998 Volvo S90 where I can't really be too aggressive with it and mess up the gearbox. So there was no way I was gonna be able to avoid it. And there was no point arguing with him that it was him who was at fault. It would just be one of those he said she said arguments of us both saying it was the other guy at fault. He was a much big dude than me and I didn't want this to become a big long ordeal for something so minor when I just wanted to go home from a long day.

    Great breakdown and well spoken! My question for you would be, in the instance of a car, would the ACV be roughly what a car of that same make, model, year, condition, mileage (give or take) trim package, etc. be or would they still try to factor in some kind of depreciation for the time that I had the vehicle? For instance if you paid $24,000 for a car and 2 years later it’s considered a total loss with ACV coverage. If that same car would go for $22K at the time of loss, would that be considered the ACV? Or would they someone deduct something out of the $22K? I appreciate your time and effort in making this video. Really needed it bro ✊🏽❤️

    I noticed how the video states that the vehicle driving through the parking lot at ANY speed has right of way. That's all these young, immature, reckless drivers need to hear. I see them speeding through the parking lots all the time. At the end of the day , every driver is required to avoid an accident. Now my focus is about parking when I go to the Walmart or grocery store. I try to park in a way that I can avoid backing into a moving lane , because I don't trust others anymore, to use caution.

    My problem is that Alpha Insurance company says their insurer is 100% at fault; but they don’t have enough coverage for the damages since they totaled my 4-month old car 😢 Anyways, working with my insurance now and “subrogation” came up, I had no idea people were allowed to drive with so little coverage. Thanks for the explanation in a way that makes sense.

    Bottom line a law should be put forward to penalize Uninsured and Underinsured motorist especially if they aren't following the state law on the amount of required coverages on their policy. Insured motorist that have State Law required amount coverage are the ones paying for the damages with increases on their policy as a result and a required deductible. This coverage for Uninsured and Underinsured coverage has increased substantially with Allstate. In 2013 Uninsured and Underinsured on policy was $69.76 every six months now starting in 2023 Allstate is charging $269.54 for this coverage in a six month period. It's no wonder there's been an increase with coverage and consequently an increase in Uninsured and Underinsured Motorist .

    i was in a situation yesterday. i was parked and there was a very tall and very long pick up truck to my right . i was facing west and backing out so that the rear of mycar would be facing south once i pulled out and drove. anyway. i looked both ways with my head turned before pulling out. there was nothing. i started pulling out very slowly and still nothing. i was at least half way out still not seeing anything then suddenly felt a bump but didn't even see the car. i quickly looked to the car parked dirctly behind me that was staionary it didnot appear to me that i was close enough to it to have hit it. then somehow i readjusted and got out. andnotice behidn me 1 or 2 spaces over behind me there was in fact a car sticking about 3 feet out that wasn't lke htat when i pulled out i also noticed there was someone in the drivers seat. i suspect this had to be the car. and they likely startedd pulling out a second or 2 after i already started. however because i was very ocncerent about htat reallyl long pick up to my right. i was blancing over there a litle more at that moment t make sure id din't hit it with the front of my car. i twas my rear bumper and I could almst not evn see anythingalmost at all. i could feel a very very slight indent in a small 8 inches roughse secon but you can't notic eit. almost. and it was on the right side of my bumper theut totally the back. so what is the situation for me. and i was backingout very slowly. should i be worried about other damage? i did open andclose my trunk fine after this. but i am tryingto figure out if i should make claim and get itfixed or not
