@@taipan2345 In order for for him to be lawfully trespassed or given a lawful order to leave a public premises, he would have to have been committing an unlawful act on the premises. If there was an ordinance prohibiting the public from standing where BTA was standing, then telling him to leave would be a lawful order. A cops order to leave is not lawful simply because he doesn't want someone there. "Leave this place that is open to the public because I said so" is not a lawful order and is not grounds for trespass. Absent a lawful reason for the order, government actors could arbitrarily and capriciously eject or prevent entry by persons for unlawful reasons or no reason to the sidewalk, city halls, police lobbies etc. This would be clearly unconstitutional. Cops routinely mistake the span their authority to include making any order they issue a lawful order.

They DO NOT have qualified immunity until proven in court. When they violate their oath of office and act under color of law they lose any evidence towards QI. Qualified immunity is a smokescreen to deter the people from initiating a law suit. QI is only granted in a court action with proof that the officer's actions were qualified.

Did alittle digging. BAT's charge of trespassing was dismissed by the City of Medford Municipal Court. Dismissal was requested by the City Attorney's office. Reason stated was the primary witness (Sgt. Venables) was no longer employed by MPD. He's employment with MPD was terminated (or he resigned, not apparent which) after 21 years. He's now a commercial carrier (trucking) investigator with the Oregon Department of Transportation.

I believe California is a 2 party state which means if recording surreptitiously, one must inform the other party. Many believe 2 party laws are unconstitutional including Project Veritas who is attempting to bring such laws to the attention of the Supreme Court; but in the meantime, if BAT is open and obvious which seems to be the case to me, he isn't disobeying the law.

Number one, without the arrest there is no real damages for the attorney to sue for, futhermore it could be argued that you ultimately left of your own free will. Sure you can file an IA complaint that will say the cops acted within department policy. But without the arrest- no case law is made.

I live in Oregon, specifically Southern Oregon where this was filmed. It is a police state in these parts but I wouldn’t let it stop me from coming. It’s beautiful. Just make sure your tags, lights, all that stuff is in order if you are because you will get pulled over if it’s not. There are way too many cops in comparison to the population(IMO) so predatory stops are their thing.

This lawsuit should work out well for you, and hopefully you force any settlement to include those crooked pigs be removed from their jobs.

As he said, the government has the same rights as a private property owner. Furthermore, the 1A is not a barrier to trespass. This is said many different ways in plenty of SCOTUS cases. No lawsuit for you.

They DO NOT have qualified immunity until proven in court. When they violate their oath of office and act under color of law they lose any evidence towards QI. Qualified immunity is a smokescreen to deter the people from initiating a law suit. QI is only granted in a court action with proof that the officer's actions were qualified.

The 5th and 14th amendments protect us from deprivation of liberty without due process. Which means we have the right to access any and all open to the public publicly owned property until we break a law. As no law can violate the constitution, we can also exercise our right of free press while we are there

Any agency that's funded by taxpayer dollars needs to be audited regularly to ensure they are doing their job properly and not infringing on the rights of the citizens who pay their salary. This is called checks and balances..
