Very informative video as always! I'm ALWAYS being asked about F1 copyright and there's NOTHING out there that exaplins it in full... so now I can link them this! I'm someone who's very guilty of using F1 footage in my content for reactions by using the footage in small clips / cuts and blocking out the the broadcast logo. This has led to me never getting an automatic strike from KZread's CMS, but obviously though this is a big risk I choose to take in that one day this content could be manually striked. I believe what I do is under fair use, but like you said, no one will ever know unless we went to court.
Do Formula 1 teams follow the same/similar rules online too? Such as the McLaren Unboxed series

Yes which is why you’ll sometimes see them use cleaver methods to show the pit stops or moments from the race - however for partner / sponsor pieces (or even end of year highlights) that’s where teams will strike a deal with Formula 1 to license official F1 footage, this is why on Twitter most teams just simply reshare the videos F1 have posted - and not upload themselves!
This may be the greatest plug to a sponsor I’ve seen in a while.
For the 2023 Australian Grand Prix the most onerous stipulation in terms of videos was that spectators could only upload videos they've recorded at the track to social media provided they don't exceed 5 seconds in length. I don't know if F1 enforces that. Also I don't think F1 is automatically granted copyright to any videos you take (at least not in Australia), but the attendance terms and conditions allow them to request that you assign them the copyright of any video or photo you take trackside that they want to use. Conceivably you could refuse, have them take you to court and see how that plays out. :) Lastly at 7:33, from the Talent Guidelines: "No content showing ... children under the age of 18". Max Verstappen was 17 when he entered F1!

yeah this seems strange. They could attempt to say that, but in Australia and the US, copyright exists with the person who made the footage. They might try to stipulate it in the ticket, but I doubt it would hold up in court.
I remember the first video I tried to upload used like 10 MINUTES of F1 race highlights as a backround to my commentary 🤣. I put hours into that video since it was my first one on the topic and I wasnt to familiar with how to go about editing it. You could imagine the shock I felt seeing it removed the next day due to copyright reasons.

Here's a true story regarding the matter. I had in the pipeline for a youtube channel a series which on the f1 2020 game I did a career mode starting in F2. When we went to spa the footage was auto copyright strighted despite it coming from the f1 game directly and tbf F1 listened and unstuck it thankfully love you FOM. But yeah no-one is on youtube allowed to do races on the f1 2020 game using an f2 arden around spa.

What i find interesting, is that even gameplay from the F1 games regularly gets claimed/blocked when uploaded. Most times with reasoning it being actual footage of races/practice sessions😅

I received a copyright claim from FOM for the 1982 Australian Grand Prix......which wasn't even an F1 race!
Interesting video. Very informative. They do strike video Liberty seems to be not as tough as Dorna Sports with MotoGP. I see f1 content on youtube. some clips are over 1 minute long with no noticeable filters. Not sure how they are getting around the copyright. f1 makes millions o dollars, content creators are not screen recording races and posting. We are making transformative content. So it does not hinder the official f1 channel. Other racing series such as Nascar & indy have embraced content creators. I was unaware all content in the circuit count. Free Practice and Quali are also copyrighted. the countless hours spent making these videos they act like content creators are Miramax films. There are channels from Asia straight ripping full races and posting them. They are not taken down. I will keep some of these in mind making future videos. Good video sir.

I like seeing the clips of cars driving around on test days. It mixes up the video content.
I recommend the Videos from EmpLemon about Copyright Smuggeling "The KZread Copyright Metagame (Part 1)" Where sometimes you are legally allowed to use the content but the automated systems stop you in your tracks until the copyright holder lets the claim run out
We as creators can search to see if our work has been used by others on KZread - I learnt that a Brazilian scale model shop was using clips of some of my builds to sell the original kits.

A very informative video! It's very complex isn't it? But understandable once you understand it.
This is why I stopped making f1 edits. Some of my edits have stayed up to this day, but it's just not worth the risk of spending weeks editing only for f1 to take it down.

@@F1arkham some KZreadrs have done it so it's not impossible. Maybe there's a sweet spot for how you use the clips, but I never bothered to find out. Personally, it's not worth the risk

"Fair use" has to be one of if not the most misunderstood or point-blank abused concepts in media law. For example, lots of creators claim that simply reproducing original content is fair use because they are providing it for “criticism”, but don't add anything. The misunderstanding is that they need to do the criticising themselves, not their audience. From an ex-BBC production person who has had more lectures in media law than he wanted, thanks for putting this video together and clarifying the world of sport copyright issues, which has many grey areas.
Formula 1 enforces its copyright to protect its IP, just like any form of content that is broadcasted. Even if you hear on a channel that Leclerc crashed, if the video is not shown, they can still make some money by searching for the clip in the official F1 channel. That being said, the content creators who do upload "altered" footage to get around CMS are infringing on F1's copyright, but it would be unfeasible for F1 to introduce a whole team dedicated to scanning every content creator, even the big ones for such content and then manually issuing a copyright claim. You mentioned that a video is not that profitable anyways, but if anyone did it, F1 would come down hard on the main channels, until no one did.

I really want to do F1 commentary videos as I am autistic and F1 is one of my special interests. My comments are not just on the race butnaalso the commentary on SKy e.g. Danica looks nice this waeekend. I donr wnat to argue with anyone though. I would have thought F1 would like additional media coverage from different tyoes of people. How can I get authorised? This is so confusing for my ND brain

I once had a chat via Email with F1 about Copyright on Yt and they told me to name every channel I knew that violates there copyright. They were serious but I think they never searched "F1 Edit" on KZread and banned all those people. Maybe they think it's better for them to not do that or it's just not worth the time.
I'm pretty sure legally if you dont enforce your copyright you lose it, so F1 not enforcing it at the tracks gives up the right to claim it.
So if I understand this right. I can fair use f1 b-rolls taken from official sites of f1 teams.

Producing those colorful pixels costs a SHITLOAD of money. Those who put their money to create those pixels put their money to get their money back with a profit. It's not charity, it's a business. So you start a business, a bakery, you spend all your money to buy the ingredientes, spend hours making some nice cakes, put them on display for people to buy.. then a random dude comes, steal your cakes, sells them down the street and keeps the money for himself. You're now broke and with no cakes. So you go to the dude and confront him: "Hey dude, those were my cakes!" And he replies: "What's the point? It's just some flour and sugar and fruits in different colours at different temperatures".

@@formulanova12 Would it have been any different if the guy who stole your cakes and profited from them told his customers that you made the cakes? I see what you mean, but if you put yourself in their shoes, you won't be arguing in favor of illegally using copyrighted material. I know people usually see big companies as faceless corporations, and mostly they are, but they are also thousands of people working for/with them, and they put a lot of effort, sacrifice and sometimes risk their lives for us to be able to enjoy their content. I rather respect that by not stealing their content.

Wise words from someone who I assume has not created anything original in their lives. How would you like if your baby project of original work to which you dedicated years got stolen by some random jerk on KZread, uploaded and monetized for their profit without you being able to do anything about it? All your hard work, stolen, forever. Copyright doesn't exist to make wealthy people wealthier, it exists to protect intellectual property. It happens that, usually, people with intellectual property make money from it, so they become rich if their intellectual property is good.

It seems stupid too because it seems that any publicity is good publicity. A creative YT creator who is producing good quality content MAY be able to bring people to F1. .the Drive to Survive phenomena shows this. I love watching YT creators talking about F1 because they may be insightful or funny even if the race itself isn't particularly exciting. I mean, let's face it, it's Verstappen season atm so the races can be quite dull if you just want to know who is going to win.
