The law firm is paid for billable hours, they have an open time + material contract for whatever they find: like bounty hunters -- they waited until the case has a maximum billing before contacting you, they want you to fight (they waited until they think you're too far to turn back) because then they can bill more hours.

Very well explained Dex, it certainly sucks to see a multi billion dollar company take offence to normal people just having a go, especially when there promoting there older vehicles as being great old trucks that are worth fixing (compare that to a modern jeep and it’s a different story). We all cope enough flak for owning a jeep since people always compare our old rigs to the modern ones that are full of problems haha. But I can also understand a company trying to protect its assets, even if they went a little extreme with all those people and yourself. Either way mate, you are a fantastic KZreadr that provides really good content regarding these wicked old school Jeeps and can’t wait to see what you bring to the table next! Keep up the good spirits and keep making that wicked content regardless of what you call your channel.

Dex, I do hope you read this as I have been thru trademark issues MANY times and always won the fight. Fair use provides that a party may use a protected mark not as an actual trademark, but rather, for its descriptive meaning. The fact that you own a registered business, with a registered name gives you the RIGHT to use the name/word. You arent selling JEEP branded products, You arent using a JEEP icon, Logo, font type, using the Seven Slots(which is trademarked) If you were to trademark DexJeeps as all 1 word theres absolutely fucking nothing they could do about this at all. Even my name TPBMODS, I was hit with a C&D from The Trailer Park boys lawyers(TPB Productions Limited Canada) and TPB BEAST LLC (LIMITED LIABILITY COMPANY; DELAWARE, USA) who deals in E-cig related products. Now, I am canadian, and my NAME was used in the vaping and computer world so words like Mods come from both sides, but TPB means TeamPipeBomb which is an old running joke

I agree with Tpbmods! I have seen other channels on KZread that have used Jeep in their name/logo (2 word together) and they also sell merch. They've been on KZread awhile and no such mention of anything like this by them. The letter Is only to intimidate and manipulate you and want to hurt your business. I would keep selling the DexJeeps merch, but have the words together in one word on your logo, maybe add Parts to it... they can't touch that.

Excellent point. I've watched Matt's Off Road Recovery - think they use cheep engines? Nope. They do not. I'm surprised cheep lawyers haven't gone after them for something.

It seems to me you should be able to use the word Jeep because you deal in jeeps. In fact they should be proud to have you representing their rugged old machines. Maybe "Dex Salvage Jeeps" would work. It is a literal description of what you do. And it separates your Jeeps from theirs. Good luck buddy. Love your videos

Glad it happened now. It is nice to see you push forward with the desire to achieve something vs giving up. Continue on with your dreams, learn and overcome. I for one appreciate this channel, as a Wrangler TJ owner I learn things about my engine, trans, transfer case, differentials that I otherwise wouldn’t have known. As a cereal KZread observer I see so much potential in this channel. Relatability, honesty and comedy are not always hand in hand. Here I (we) get that in spades. A combo with subscribing to. Man I work at the wrangler plant. Now I'm just a part timer. FCA is they used to be. Now its stellantis. The way stellantis treats their employees let alone their loyal consumers is beyond me. Every company operates differently. If they had a problem with the name. They should have contacted you the moment they had suspensions or concerns. There is no "injury" towards the company. Ever since they swapped to stella its spiraled out of control.

All the merchandise you already have, ask for people to donate to the channel and receive merchandise in return!

You could also take all the donations to your local church, community center, or any nonprofit organization so as to not have any monetary gain. Unfortunately you're already at a loss for the merchandise, may as well turn it into something good.

First off, I'm glad you made this blessing in disguise happen, I would not have found the channel otherwise. Jeep also sells merch like shirts and hats... Jeep is just defending there own trademark and have 100 lawyers on payroll sitting around just looking for stuff like this. Also the governments is not gonna give you trade mark advice, although I think it would be a good idea... its up to the company applying for the trade mark to do the research. I don't think you would have any chance fighting it, coming from a law stand point. You also have to remember when the trademark laws were put into place there was no internet where you can apply for a trademark overnight and the offices would let you know if they thought there would be a conflict.

Fiat Chrysler Corp has done “irreparable injury” to the Jeep brand. After years of being a shop owner I absolutely despise the automakers. They do everything in their power to make it difficult for small businesses to repair the garbage that they are selling and they generally have nothing but contempt for the customers who buy their products and have problems with them. Fiat Chrysler couldn’t build a lawnmower engine worth a shit much less build a competent vehicle. It’s no wonder that they have to have a small army of blood sucking lawyers to protect them.

Same thing happened to Exodus 4x4 in TX. They started as Exodus Jeeps and all they did was aftermarket mods and repair. They were forced to to rebrand.

Had a franchise company contact me 10 years ago bought me using there name since they were opening in this area. They were already running adds on local radio. Had a lawyer inform them that my business was 10 years older than there franchise. I had changed my legal name to include the business name so it is exempt from infringement. They decided to not move into the area and pay me royalties. Free advertising was nice.

Somebody get this man an attorney that specializes in this! As my business has grown we have finally made a connection with a great attorney that specializes in what we do. None of us good people enjoy the idea of court and attorneys because we feel we can just treat others good and we will receive that in return.....with that said not everyone lives by this golden rule. Our companies attorney that we hired this year has been such a relief to know we have someone on our side in the event of running into a bad person or situation, and let me tell you what a relief it has been knowing that we have an awesome attorney on our side to guide us. Not only are we protected, but I also feel better inside knowing this and dont carry the negative emotions around with me anymore of just not knowing. You start with a simple response letter and see where it goes, you can always walk away if things get hairy. Youve built and earned the name. A good attorney may say its just a scare but you are not in their lane and they have no grounds to stand on......worth the investigation. Even if you end up getting rid of the name you have built you will be glad to have made a connection with a good attorney. One more piece of my .02 If the attorney you talk to doesnt give you the warm and fuzzies from square one find another. Its worth the effort and piece of mind you will gain moving forward in your business venture.

My buddy had a side hustle, making folding fire pits. He made all sorts of them but a lot of them were jeep related. Now, a lot of them may be a stretch he made maybe 20 or 30 a year. He was fine until he built a small website, and FCA found it. He got basically the same letter. The first one was polite, like the one to you. He basically said hell with it and carried on. A few months later, the second letter was not so nice. He finally just stopped the product altogether. Btw from what I understand, you can be called dex jeep parts but not dex jeeps. Copyright laws are weird.

Many have asked about using the same name and were given an answer to NO you can't use period. Unless you contact owner and have written permission. Not even on a card or tee. Do a search asking you will see.. Someone must have made a complaint to tip them off. But be safe on trademark words.

I am a Trademark and IP attorney for World Wrestling Entertainment. Fact, you could and would win this case if one was ever presented. Also fact. You’re looking at $500,000.00 or more to litigate the case. It’s better to bail out unless you’re worth many millions.

Jeepers, they sure put a lot of resources into a fight that absolutely no effect on them .

One of my Jeep club friends has a small fabrication business on the side. He was building collapsible fire pits with different Jeep grills and selling them on his website. I think he gave more away than he sold. I think he told me he actually sold about 15 on his website. He got the same letter from Jeep's attorneys. I love Jeeps but the attorney shit has to stop.

I know of at least two businesses here in OH that have Jeep in their name and are centered around the vehicle brand. One is a restoration and service business , and the other a salvage operation. You can't tell me they don't at least know the businesses exist, and FCA hasn't bothered them for using JEEP in their logo.

The $850 for the trademark pays for the time of a half dozen or so people that process, briefly research and run register the trademark. Research basically to assure you’re not registering one that’s taken already. “Trade” in trademark inherently means you intend to use your mark to make money, so the $850 is small potatoes compared to what most people wishing to engage in trade of goods will pay a lawyer (or several) to ensure your trademark doesn’t conflict with the interests of another trademark holder. The government isn’t keeping your money, they’ve already paid it to the people who processed and registered your mark, and a little overhead for the power to run the computers used to do it, the paper and postage in processing and the building maintenance where those people work. The trademark office assumes by its nature that you’ll also have invested in adequate legal counsel to protect and monetize your trademark as you’ve intended. They can’t be the referee between you and another mark holder or act as your attorney to advise you on whether or not your unique mark will be challenged legally. Still, it’s bullshit for FCA to pick on you for something no one would ever confuse for their product or trademark.

So sad thar FCA attorneys sent that Cease and desist.
