    You have to invoke it first or it won’t count. Silence itself isn’t assumed as invoking your 5th amendment rights. It’s a common misconception and frankly why the Supreme Court ruling on it is stupid. But it is what it is.

    Even if she was listening to loud music IT IS HER RESPONSIBILITY TO BE AWARE OF HER SURROUNDINGS including whether a lit up police car is behind her. In this case, ignorance isn’t an excuse. What if she had been delaying an ambulance or fire truck behind her? First thing I learned in driver’s education was constant situational awareness. Being oblivious is a good way to get dead or cause another’s death. Awareness has saved me many times.

    She knew the officer was there. It sounds like she was calling someone and hoping they’d meet up with her to “save” her. She’s still screaming for them to help when she’s pulled out of the car. I highly doubt the music was up that loud the whole way, otherwise she wouldn’t be able to hear the person she was on the phone with. Just another person who thinks the rules don’t apply and they should never be held accountable.

    @@shelbyseitzinger927 I did a pretty in-depth study of excessive force in law enforcement back in grad school. Granted, this was data available as of 2014, but by and large I imagine you’d get the same results I did even today. One of the primary factors that determines how “aggressive” an officer is, if not the most important, has more to do with the officer’s experience on the job and their perceived safety wearing the badge than anything else. Many departments include in their training videos such as this one, and worse; they show recruits and veterans alike the dash cam and body cam footage of their colleagues being ambushed and/or gunned down in the field. This is for training purposes to help officers stay more aware of their surroundings and the nonverbal cues given off by their suspects. Sometimes there’s no predicting or stopping what’s coming, but officers are still tasked with actively investigating and apprehending the most vile people our world has to offer, all while knowing damn well that some of them would gladly open fire on anyone in uniform. After cataloging tens or hundreds of thousands of data points and putting them through specialized software, one ratio popped out; an officer’s risk of using excessive force is largely determined by two factors; their exposure to violence on the job, and how much of their time is spent dealing with it. If you compare the total number of violent crimes reported and responded to by law enforcement to the number of law enforcement officers employed to deal with them, that’s the factor that seems to most determine that risk. This doesn’t mean that other officers won’t step over the line, but even there the same factors apply; the more an officer has been shown, through training or experience, that their life may be in danger on any given day, the more likely they are to get aggressive when they don’t necessarily need to. Every time a suspect speeds off, starts acting antsy, gets aggressive, or starts making sudden antagonizing moves, they’re reminded of videos of their colleagues being gunned down, and their training that proves that a suspect can draw and fire before their victim has time to react effectively. A suspect with a knife can cover 30 feet and deal a lethal blow before an officer can draw, aim, and fire, taxers don’t always work (and certainly not the way they’re shown on TV), and other less-lethal options often have minimal effect on suspect high on adrenaline or uppers. They’re also aware that a suspect can take several center-mass shots with a 9mm and still be on the attack, running on adrenaline alone, and quite a few officers have lost their lives that way. When someone starts getting aggressive, argumentative, or sketchy, officers will sometimes meet fire with bigger fire; a show of verbal force right out of the gate to demonstrate how serious the situation is and how badly the suspect is outgunned. It tends to work.

They can absolutely run any plate they see for any reason, or for no reason at all, and they aren't violating your rights by doing so.     Second arrrest - i can make a concrete conclusion. She said he pulled out a gun , pointed at her, asked for her drivers license, and then randomly yanked her. Luckily, ALL of that interaction was on film and none of that was true - at all. She was ordered out of the car and she refused and had to be yanked out. Period. And of course discovered she broke multiple traffic laws. Thank goodness for body cam.

    I disagree, I mean that was the only questionable case. The cop did use excessive force and literally threatened to break her arm. That’s not legal. He definitely escalated that situation.     The lady in the second video clearly was on her phone and wasn’t paying attention. Not stopping for a traffic stop by an officer is a big deal, and he responded the way he should have. Her boyfriend was far more respectful and actually tried to help the situation, but some people aren’t worth helping.

    When they argue, it is usually to cover for something else. Diara knew she was driving without a license and with illegal plates, so she did not stop. It is as simple as that. When she did stop, she was going to create as much confusion as possible to try to get out of the situation. As futile as that was, that seems to be the train of thought behind all that.

    It's a driver's responsibility to be aware of surroundings. "I didn't hear the cops" isn't a valid excuse for not pulling over and her new excuse of looking for a safe place to pull over doesn't fly since she didn't think of it until later.

Some people shut down, some people act out. She was pretty calm until he tried to rip her out of the car out of nowhere. I think most people would get worked up in that situation.

    Again, he had every right to yank her out. She was fleeing because she didn't stop when he turned on lights and siren. He chased her for who knows how long. The only reason she was stopped is because of the stoplight. So by law, he has every right.

    Ikr! I have an anxiety disorder and I’ve never acted like that to a cop. If anything I’m extra nice as to make sure I don’t escalate anything accidentally. Most people with anxiety do their best to not escalate situations as to not heighten the anxiety of the situation, we are in fact more hyper aware of trying to keep everything calm. I’ve never seen anyone with actual anxiety act like that towards someone. I hate how anxiety has just become this throw around word that people use to garner sympathy for being a-hole’s. There are actual people who have anxiety who are trying not to cry at simple traffic stops and would be profusely apologizing for doing anything wrong, I wish people would stop using it as an escape route.

    I don't think you have an explicit right to call a lawyer during a stop either; The courtroom is the courtroom, and citizens should comply with all police orders during the incident and raise rhe matter later in court if they believe their rights have been violated; they should clarify whether the officers comments are requests or threats under duress of arrest, but even if an officer is acting unlawfully, it is unlawful for the citizen to refuse their order, You will be given ample opportunity to call a lawyer at a later point in time, but you don't have the right to hold up a traffic stop to contact a lawyer

    You can call the lawyer at the station after the process is mostly over. Not at the traffic stop. They might allow you if you’re either cooperative or a female (I’ve seen many massive a-hole women allowed to call whoever they want).

    I feel bad for the girl on Xanax, benzos are no joke and are highly addictive and doctors used to hand them out like candy, got so many hooked. The withdrawals can literally kill you. You black out on them and your moods can swing rapidly. I was in a psych ward with a girl JUST like her, one second she was sweet then bam she was a raging lunatic. Even fought the staff. As a recovering addict I have to feel some sympathy with her situation, I hope her life gets better.

    I don't know why people don't understand that the more angry and disrespectful and non-compliant they are, the worse the situation gets. Nothing's going to get better when they act like that. I've had more contact with law enforcement in my life than I care to admit but I promise you, staying calm and respectful is the best response to dealing with them. I have even gotten out of multiple tickets by simply being cool and in compliant. I was even stopped by the police for speeding and when he asked me if I knew why he stopped me, I said "because I was flying like a bat out of hell." The officer started cracking up laughing and I ended up not even getting a ticket.

    I'm not sure what laws actually govern police behavior, put the climate lately has gone from holding bad cops accountable (which should happen) to police officers almost afraid to police! Especially for people of color, I get it, minorities have been mistreated and abused by law enforcement and still are. But acting like just because you are a minority gives you some kind of right to act a damn fool with the police hoping the Jessie Jacksons and Al Sharptons of the world show up to for their 5 mins of tv time and that the ACLU files some stupid lawsuit to hopefully get them some money is plain ridiculous.     I understand that the Second Lady was wrong ass hell but the cop that yanked her out of the car with two sentences made was crazy. He didn’t need to be that aggressive after asking barely couple of questions.

    Right off the bat, I've seen Nicole pulled over so many times. She currently has somewhere between 27-30 DUI, driving with license suspended/revoked, drug possesion, etc., etc..

    NOT knowing something that you should know doesn’t get you out of trouble. That “lady” in the car where she claimed she didn’t see the police behind her….. that is not a valid excuse. If anything she was not paying attention or was distracted while driving to the point she didn’t see the police behind her. Either way…. she was a moron and should not be permitted to drive a car especially since she didn’t have a valid drivers license.
