To be totally truthful he has been a county sherif lieutenant during that timeframe. ie he is not arresting anyone, he is the one checking that when you goto court you pass through the metal detector without carrying a bazooka in with you. All of his actions were illegal and many in uniform feel that they are above the law. I just wouldn't want people to assume he was a police officer as he is not. Hopefully he gets fired and jailed for the 5 or more years he shuold get. As this is Cook County he most likely will be forced to retire but no actual jail time.

Dude tried to outsmart a lawyer without realizing that his simple yes and no is just him digging his own grave.

This lawyer is on top of everything. Rock on Lawyer.

As a former cop this is an absolute embarrassment. The whole department needs to be under investigation at this point.

@@wbg6500 What's a lot? There are hundreds of thousands, so no, nobody talks to a lot of police officers if you look at it that way. Every officer I've ever met, dozens, have been happy to pretend their department policy is the law instead of simply department policy. That's a major issue. It's pervasive. Look at the officers in this video as an example. Tons of years of experience and they can't answer VERY basic questions about the law. What do they rely on? Department policy. You heard it yourself. That's called what? Believing the law is whatever they say it is. They genuinely believe their personal department policy is the law. They believe the law is whatever they say it is. It's an epidemic that is killing trust in police officers on a nationwide scale.

That’s because, generally speaking, the law is whatever they say it is. What exactly can an individual do if a cop pulls them over (let’s say for speeding), then decides to arrest them (for whatever reason), then holds them in the back of the car for a couple hours, then books them. Eventually, that person will probably be released, but there’s a lot of points in there that the cop can make ANYTHING up to justify wasting half your day, or possibly much longer. What can you really do about it? Really? What if they outright shoot you in the head after the stop. Sure, they will probably go to jail eventually, but you’re dead, and they may not go to jail at all. Now imagine this world without cameras (body cams and personal), cell phones, social media, and audio recordings. They are the law if they want to be and for every one that gets caught and punished accordingly, dozens don’t. I believe most cops are good, the vast majority, but boy can they get away with a ton if they want to (at least temporarily).

This is FCKIN GOLDEN!!! People should be held to account despite who they are or what position they are in

yeah it's really hard to imagine the frustration you would feel in that moment. These cops follow company policy and not the law. To be perfectly honest the law is subtle and yet incredibly complicated. It's why a patrol officer was never intended to have the same right of interpretation as a judge. We need police, but they don't get the best and brightest. You can't expect cops to know the law as well as a judge, so they should be stripped of like 90% of their investigative abilities. Any invocation of constitutional law should be a required call to a judge or their representative, not the decision of some redneck captain who couldn't understand half the language in the law they enforce. Even if you eventually get justice in court, the process of bail/jail/awaiting trial should be considered one of the most despicable things a citizen can experience.

This case is not still ongoing, it has been dismissed years ago. The court found the actions of the officers lawful concluding: "Clearly, “videotaping other people, when accompanied by other suspicious circumstances, may constitute disorderly conduct” under an Illinois statute stating that a person “commits disorderly conduct' when they knowingly do “any act in such unreasonable manner as to alarm or disturb another and to provoke a breach of the peace.” Reher v. Vivo, 656 F.3d 772, 775 (7th Cir. 2011) (quoting 720 ILCS 5/26-1(a)(1)). In this case, Officer Barbaro testified that he observed Plaintiff “scanning back and forth with the camera up and down, people coming in and out possibly, possibly videotaping through the glass at the security post that I work at of the entry procedure.” [114-5] at 3. According to Officer Barbaro, the courthouse installed cameras outside the building after the 9/11 attacks to “watch the intakes for the air system in case someone wants to do something with that.” [114-5] at 3. Given such circumstances, Officer Barbaro had reasonable suspicion to believe that Plaintiff violated or was violating a general administrative order of the court, and/or the Illinois statute prohibiting disorderly conduct. He saw Plaintiff filming the entrance of the courthouse, a place where jurors, victims, witnesses, and litigants appear, and where security measures remain in place for the protection of all who come within the courthouse, including jurors, victims, witnesses, litigants, attorneys, courthouse security officers, and judges.’

@@TomWatson-vu6fj actually the case was dismissed because they settled. The lieutenant had to pay her 15k, couldn't find anything on what the sergeant had to pay. The sheriff's department settlement amount is sealed.

@@mmabri The Case was initially dismissed for the reasons I stated above. Amanda then appealed and the county settled for 15k as litigation costs would have exceeded the settlement Cost. The 15k were not paid by the lieutenant but rather by cook county.

We need annual tests taken individually by police officers, no group testing, to prove they know the law. This is outrageous

It's kind of not corruption, it's ignorance and ego. Also, this case I find is much more serious than the other video here, of the God Bless America sign veteran who was detained. He was detained very briefly and literally asked to be put into cuffs. Here, this is outrageous.

I am not a US citizen, and I am not a police officer, but even I know what the Miranda Rights are. How the heck did that guy reach the rank of Lieutenant. He was showing all the competence of a rookie turning up for the first day of Police Academy.

The fact that these two rose to the rank of sergeant and lieutenant without a basic understanding of the law is terrifying

This basically boils down to this; Cops - “I don’t like what you’re doing, so it’s ‘illegal’ and I’m detaining you” I hope this woman sues these cops into oblivion.

These court officers (not street cops) have been coached on how to answer without (?) lying. They are not quite as stupid as they appear. Just because they can't quote a law doesn't mean that they are ignorant of the law. I wish the lawyer deposing them was as good at deposing them as they are at lying without lying.

Detective Williams got it wrong.The civil case ended in 2021 with the judge throwing out the case, it appears. But also, I see something about how she got a $15k settlement. Google 18-cv-3619 to see those results

I understand a cop may not know the laws fully but they should try to know them to the best of their capacities. The fact they answer “I don’t know the law” or even make vague guesses is just amazing.

We need more lawyers keeping these people in control of their over the top power trips

A doctor can’t say he don’t know basic medical procedures and keep his job job but police officers can.

This is your average cop right here. They have no clue what the Law is and God forbid you actually invoke your rights. You get mocked for just knowing what the consitution says.

My biggest problem with this is how blatantly illegal all of this is, yet the cops remained employed and on payroll, and even worse, it somehow took several YEARS to reach a conclusion. This obviously open and shut case is being dragged out via beurocracy for whatever reason, I suspect to avoid accountability and drain the defendant of funds before the trial can come to an end

I was disgusted too, not trying to get them an excuse… but if you got promoted to a leadership position after just a few years of police work, and it’s been more than 2 decades since you needed to know any of that, would you do any better? All you have to do is be involved with the backside investigation processes, not mess up and boom. Promotion. There are tons of policing jobs that don’t involve getting “hands on”, and hence why he was the LT of the police station and not for patrol officers. Same thing as the military, just because you were a marine or solider doesn’t mean you were close to a firefight or know what to do in one. Edits only for grammer/typos. When she referenced the 4th amendment, and they said "why do we always get the crazy ones," I physically got sick to my stomach. I'm a former deputy sheriff and I'm in absolute disbelief. To say that you don't know what is required to detain and arrest when you have been an officer for more than 5 minutes is insanity. The problem isn't that "they" don't know...., the problem and issue is they are allowed to play coy and innocently ignorant to the facts and the law. They KNOW what the law is, but if they say it, now they're responsible for that knowledge which will in turn demand accountability. So, which is the easier and most discreet approach or route to take ...? To act as if they don't know the law, even at the expense of looking like they just don't remember or confused. When an individual (cop) is THAT cunning and sophisticated in hiding their deceptions, EVERY booking they have made, EVERY conviction the prosecution have won, should be revisited and reviewed with major scrutiny. (IMHO) Most COPS on the beat or anywhere will not give the the public the same consideration when confronting someone who they KNOW aren't out attempting to commit crimes. SMDH

Technically, and this can vary a lot depending on where and what academy they go to for which law enforcement body, they are required to know the law and attend law classes. Especially officers in an administrative position.

I have encountered police, many times, who did NOT understand the laws they were talking about. The comes a time when you just have to shut up and let them hang themselves..... The woman videoing the courthouse here is a great example of how to handle dumb cops. I REALLY wish black people would pay particular attention to the positive merits of calmly shutting their mouths and being observant to what is going on around them.

I'm just gonna add when you *actually* know the law lol. I worked with the police for a bit and a lot of people *say* they know their rights. Some, like this girl, *do* know her rights. And cuz of that, she had the wonderful outcome of winning her lawsuit. :)

Police forces in all countries should be scrutinised by a global organisation to stop all this corruption. 😮
