What's the deal with Patented plants? Should I have them in my nursery?
The world of plant patents can be confusing. Here, I try to make it a little less so.

The home Gardener can divide and propagate patented plants to they're blue in the face. You just can't sell them. You can give them as gifts to all your neighbors and Friends. You just can't sell them. Patents are all about money.
There are a lot of plants that you pick up at the garden center will say “propagation prohibited” right on the plant tag.
Always an interesting topic! Had trouble finding the off patent Limelight Hydangea. Some variations such as “Prime” are still patented. Had to order online but did get some plants to start propagating from.

Limelight Prime is said to be an improvement on Limelight and was given a new patent. Supposedly blooms 2 weeks earlier. They are considered two distinctly different plants. I call BS! There is most likely a DNA marker in Prime to prove it's Prime.

I agree if its patent just don't plan it . Makes sense to me. I always knew plants had patents I just didn't know how you could tell if one did I always planted by seeds now I plan and propagate as many ways as possible. I learned all this by watching your channel

Royalty Administration International handles most of the plant patent inspections in US. I get a visit every year.
That's some good info thanks for sharing. I might be weird, but I was looking at being someone who grows plants and sells to places that want to deal with customers. I have little to no interest in dealing with customers, but I have almost 4 acres of land (mostly covered in forest), that I am working on clearing up now, and I would like to be able to get to the point where I grow the plants from seeds, or cuttings and then sell them to people like you who deal with the public.

Sure I can update you with where I end up. It will probably be next year at the earliest before I am at a spot where I can do any growing. (Still working on clearing my forest out, and removing dead tree's, burning out stumps, and trying to get my hands on a good enough tiller that it can help me dig up my soil, plus mix in some healthier soil.).

Absolutely LOVE what you have done and LOVE your channel content! You are by far the best and I have gone thru alot of channels and fine myself more often on yours. I more or less compare notes with you to get you take on different things. 😁 So, are you buying plugs with royalties and selling under Trade Name or is that a different fee than selling Patented plug grown resells?

Thank you for the kind words. Once you buy the plugs, you have paid the royalty and can sell them under their TM name.

Could someone sell a patented plant “for free” with donation or with another purchase? 🤔 (Just to stick it to the big guys 😂)
The "Name" issue with selling propagated plants with an expired plant patent but has a Trademark name... like Pinky Winky... Could be dealt with by displaying the Patent info. It incudes the patent name and the trademark name generally. Search *plant patent database* *"plant name"+patent* Etc... Use expired patent *name and pic and patent info on laminated display sheet.😁

U. S. National Arboretum has a list. The Hosta Society has extensive list, as do other plant societies. Mike McGroarty_Non Patented, Public Domain Plants that you should be free to propagate_ great list. Non-patentrd Coleus at RosieDawnsGarden

Think your first video on the topic might have been better for my interests, but you always bring good information to the table. ... Just a stray curiosity... are the SEED from open pollinated (or even specifically cross pollinated) patented plants also included in the protection? I know that in the GMO world they are, but not sure about hybridized plants...

To my knowledge with landscaping perennials sexual reproduction aka seeds are not protected by the pattent
If a patent is over 20 years old and has expired, do you still pay royalties ? Reason I’m asking is that would be an easy way to know if you could propagate them legally or not by looking on the invoice to see if you paid royalties or not
There’s no patent number on the Endles Summer’s sales tag. Does that mean it has expired? I researched and saw that it was applied for in 2001 and granted in 2004. So 2024 may end it anyway.

The original endless summer expired in 2021 but the name is trademarked. Trademarks last for as long as the trademark owner renews.

@@wrightsnurserygreenhousein8117And that's the tricky stuff that the savvy dirtfarmer talks about. It's difficult to sell a plant if you can not mention the trademark name. It's a clever "trick" by the people to "extend" their patent longer than 20 years.

@@blubbietweeduizend There are several plants that are sold under multiple names due to brands wanting to have their own trademark name. I've had people tell me how much they don't like variety A but really like variety B and didn't know that they were the same. Plus they were paying 20% more for variety B. The point is to build their brand and not necessarily your business. This is the main reason I don't grow much branded material.
I hate that plants can be patented. Certain corporations are trying VERY hard to patent plants that have been in cultivation for literally CENTURIES by giving them a new name if they have even the slightest new trait. Soon, they’ll “own” all the plants of the world, mark my words.

@@lydiaahubbell8545 almost all plants in our modern world are hybrids…almost all the flowers, bushes, trees, fruit, veggies, etc. I hybridize plants almost daily as a rare aroid grower. You want Monsanto and Costa farms to be the only people (edit: “entities”) “allowed” to cross plants for the betterment and enjoyment of humanity? Because that’s what’s coming.

@@itsthehumidityyall8303 you have to name them something different that what they’ve always been called to get a patent. Ie: “a yellow Sunflower” becomes “Sunflower ‘Yellow Summer’”….and now they own something that has been cultivated in the world for thousands of years.
