In this episode, I want to discuss what happens after you sign a divorce settlement. The past month has been one of the busiest I’ve had in a while and the end of the year is looking to continue down that path. You know, as I’ve mentioned on a previous episode, the tax laws regarding alimony in divorce change in six months, and so that’s creating a lot of pressure for people to get their divorces wrapped up before the end of the year, because there’s often tax benefits to both sides, for wrapping up this year instead of delaying a year when the law changes in a big way.
If you don’t know what I’m talking about, be sure to listen to episode 170 for some of the details and I’ll be discussing it more in future episodes. But one of the things that’s happened over the past month or so is that a lot of cases I’ve been working on are wrapping up, which is a bittersweet feeling for me.
I’m of course always happy that people are finishing their divorce and they get to move on with their life. But also, I feel a little bit of sadness because I get to work closely, closely with you during the process, during a tough time and then, many cases, we part ways and we don’t have to speak with each other any more, which is also fine, but I do very much enjoy working with you. It is the nature of what I do.
And one of the things that a couple people have mentioned as their cases have wrapped up and they said, “Shawn, you don’t really speak much about what to expect after the settlement’s assigned. What should I be doing?” And I want to provide you some guidance to that effect. Now, of course, it varies for everyone, but I do want to outline some of the details of the divorce process once you have that settlement signed.
Most of you are going to go through the process where you negotiate a settlement and you sign the settlement, versus where a judge makes the final decree in terms of who gets what. Now, some of you do have to go that way, particularly in the tough divorces, but I expect most of you will be negotiating and signing some form of settlement.
And so what does that look like? And then what do you do afterwards? What kind of things should you be thinking about after divorce? One other thing I want to bring up is I have a, I think it’s a seven or eight part series on choosing a financial advisor and financial topics you should know after divorce in the quick start guide.     I wish I had known about you a year ago. I trusted my attorney...Big Mistake. My ex monopolized BOTH attorneys all day. There was no negotiating, and basically no explaination before we had to go in front of the judge. I was told to sign it or we would "have to start all over". Then I was told, "the judge is going to ask if you understand it, and you are going to say 'yes".

    My ex took me through a divorce after 30 years of marriage. There was no acts of violence or infidelity. We separated for 3 years in May 2020. She went to the friend of the court in Galveston county and filed October 2022. The divorce was uncontested and we both agreed that she keep her car and 401k and I keep mine. Divorce was finalized in Jan 2023 without a qdro and it stated that husband keeps 100% of retirement and or 401k benefits and it said the same for her. I've since remarried in April 2023 and very happy. Now she just sent me a certified mail that needed my signature because she wants half of my 401k and it was a QDRO filed October 2023. She wanted it signed by me so she can take it back to the friend of the court to amend the divorce decree. Is she allowed to amend the decree after it's finalized??

    I have a question. I found my ex's greencard after the divorce. It expired days after our wedding. Now I wonder.

    Is there a way to cancel the martial settlement agreement when it has been processed to court ?

    I have a question my parents got divorced in 1995. I got a hold of the divorce decree but its no settlement agreement. Do I get the settlement agreement from a different court or does that mean they didn't do a settlement or any custodial agreement through the courts. Also if they didnt do a settlement agreement would that be considered automatic joint custody at the time. I was born in wedlock.

    My attorney was horrible... I never saw any account of 150 thousand dollars it went into his trust... I have recorded all 5 attorneys involved and none got paid what was told... my ex sold his company for millions 2 months after our divorce. One of the top 10 in the nation company in Kansas City... the lies are all documented. I need help with breech of contract and contempt. Please contact me! I. Have a huge case that was unfair and unjust!

    After 34years my husband is divorcing me and I am stay home mom with a disable son that my husband cause it by pulling him by his penis and his feet are facing downward and he can't do anything for him self and my husband want us to sell the house he do all this cause I found out he was cheating on it once and he stop doing anything for me I am not getting any money from him and he stop buying groceries he is my son and he change his surnamewith out talking to me and no medicines with all this what must I do the garvement attorney are still good
