    @@nelsonjuanbaraoidan381 Unfortunately I have not done a video on preparing for QME yet. However general guidelines is you need to make sure that you fill out the forms correctly or when you speak to the historian sometimes you need to make sure that all your body parts are covered that you report complaints in every single part that could possibly be related to your claim even if it wasn't originally claimed so that the QME can evaluate and do measurements on those body parts to see if there is a possible compensable consequence injury. Also make sure that you report your pain levels as if you had no pain medication not how it feels when you have pain medication. If he asks you how anything is feeling now he means in the last month or so not necessarily at that moment. Some of your permanent disability might be related to range of motion so don't try to kill yourself to get a further range of motion on his evaluation. I do not mean don't give it a good effort you should give it a good effort but don't push yourself overly painful. I hope this helps.

    Hi Naomi I have a difficult case I believe I was injured in 2003 and had four surgeries to shoulder and two neck front and back cervical never fully recovered from either and depression all these years I’ve been waiting for some type of settlement and the only money I got was my temporary disability benefits for two years and in the beginning they sent me to over 30 doctors physical therapy four hours a day five days a week for six weeks which was ridiculous all coming out of my pocket of course they used to pay for my meds but they haven’t paid for my meds for 2 1/2 years which I pay for now because they don’t believe I have pain I think in 2015 they came up with this new concept of other doctors opinion reading on paper what you’re about and deciding if you’re eligible for medication opiates usually and they all state no they won’t give me any therapy any chiropractic any acupuncture nothing I don’t know what to do anymore I’m at my wits end I am in dire pain and I was told by my lawyer my injuries were my neck my shoulder and depression I did not know that neck included my full back that’s what I’m finding out now I did not know them and if it’s my fault shame on me but she never said your full back is covered now that I found out it is I have paid so much money out of pocket for MRIs doctor visits and she doesn’t seem to care I told her if I can get reimbursed and she said they don’t have to do anything for you the only money I got from her was penalty fees because it’s taking so long I haven’t got no chunk of money and we’re in 2022 which I think she didn’t do her job in the time that she had to do it I’m so frustrated anyways I hope I get some kind of input from you I would really love to speak to you but I know you’re very busy but I hope you leave me a comment thanks for your time greatly appreciate it cc

    Thank you for your question Cc Moreno, I am sorry you had such a bad injury. It definitely sounds like you had a Stipulation with request for award years ago and probably didn't realize it. A stip is less formal and only needs one signature. You are correct that the work comp was completely overhauled since your date of injury and treatment is done through utilization review now. I would look at the UR denial letter to see the reason for the denials. You should be appealing when you are denied treatment. An admitted neck injury is not usually the whole back. It is only cervical spine not thoracic or lumbar spine. Even if you had Stip settlement, you can see if the defense is interested in settling out your future medical especially because you continued to treat. They might want to. That would be a C&R for future medical only. But if your claim was settled, then the defense can tell you no and there is really nothing you can fo about that.     Thank you Ms. Robinson, I am sorry but Washington workers comp is different that CA work comp. For CA, DRE IV category on lumbar spine provides for 20% - 23% whole person impairment.     I received the SJDB voucher from the WC carrier. My question is, am I able to purchase a computer and get reimbursed before I choose a school? And also, am I able to submit the voucher for the $500 in miscellaneous expenses at the same time? Also, if the computer is $1200, I'm assuming when I send the receipt, they will just send the $1000, correct?

    Thank you for your question Ruben, IDK if I understand it. Each body part is treated individually but may be treated with the same provider if related e.g. all ortho parts. They also can have their own work restrictions. They are rated separately however. Then each PD amount is combined via the combined values chart to arrive at your claim PD amount. The amount of years you worked there is not relevant for specific injuries but may be for continuous traumas. Hopefully, you did not wait too long as there is a statute of limitations.     Hello can a QME doctor take over 3 months for final report? I call my attorney and hardly explained that Defense doesn't respond so she'll have to go to next step but it . She mentioned to have some discrepancy but nothing specific. What's that next step? Thanks Naomi

    Thank you got the question Joe :-) A doctor has 30 days from an evaluation and 60 days from an interogatory to issue his report. He can request an extension for more time, which usually happens if her is waiting results for a Dx test. If the report is late either side can object and request a replacement panel (before they receive the report) If you think he is unfavorable, definitely try for a new panel to get rid of him. If he is good, cross your fingers the other side does not get rid of him. Hope this helps, Naomi

    I live in Florida. I’ve been on workers comp since September. I dislocated my surgery on the job and now I need surgery in a few weeks . They say it’s a long healing time . Is there extra benefits for like help with food . They say we make to much for food stamps but I can barely pay my bills and my fridge is empty . Also do you always get a settlement while doing workers comp? Or just some cases

    Hi Naomi, Thank you so much for all the great information, I have a question in regards to the voucher, my employer offered me a position that meets my restrictions, how ever I had to decline at that time due to the fact that I'm still experiencing a great deal of pain, workerscomp has refused treatment, I have received some but not enough to alleviate some of the pain, now that my case is coming to an end they are refusing to provide the voucher, what's your advice? I spend most of my adult life working for this company and really need that voucher in order to find a job similar in pay?

    I'm sorry that happened AJ, There might be a few ways to attack the issue. Keep in mind, you are in a bad position and could very well end up without it. Usually, if you reject a legit offer, you will be ineligible for the voucher. These may be long shots. Disclaimer, I am working on limited info and this not legal advise. First, if you haven't already, check out my video specifically on eligibility for the voucher. kzread.info/dash/bejne/nW2cpthsmay5krg.html (1) You can try to have the other doctor P&S you with more strict limitations? i.e. if original Dr was QME, have your PTP do it and vice versa. (2) Send an interrogatory to Dr. that gave the restrictions or do a re-evaluation to try and get more strict restrictions. Interrogatory might reference your increased symptoms and/or request a functional capacity evaluation to see what limits are appropriate. (3) Double check the offer they gave you to see if it meets the other required criteria I go over in the eligibility video. (4) Double check their offer was timely. (5) If you have multiple dates of injury, if you have different P&S dates for various body parts, you can try using the most recent P&S date restrictions. (6) If your negotiation hand is strong enough, you might be able to negotiate it into your settlement even if you did not qualify for it. You can try using as leverage the cost it would take to get re-eval by Dr and the FCE cost. Hope this helps. Good luck! Naomi

    @@GonzalezLawEmpower I took your advice and went to FEMS and I found to order and awards three years apart but only received one partial settlement and when I looked at the court papers on my end it was under penalties but under famous it says two orders of awards three years a part one and 2014 one and 2019 what could that mean and I really I appreciate you so much

    Miss. Naomi, my MMI date is approaching on 12/30 of this month. I still have pain on my left wrist and upper left back shoulder, since trip and fall at work I injured left arm. I’m worried MMI date comes and they want to sent me back to full duties at work. I don’t see the work compensation doctor until 1/3/2023. What should I do? I got injuries on 11/27/2023 and I feel MMI date was too not enough time to recover.

    I was seen by QME doctor who rated my disability 9% but requested for steroid injection and or surgery also he put me off work and permanently no more than 10 lb lifting. But on the other side my work comp doctor keep requesting for physical therapy and the request has been 10 months worth which my work case adjuster keep denying. im so streesed and in pain. its been 2 years now.

    Thank you Tariqmsk65 for the comment. There does not seem to be a question, so I do not know if you have a specific question. However, it may be helpful to understand that the QME is NOT a treating doctor. His job is to evaluate only but he will not do surgery or injections for you. He can only make recommendations. If your PTP has not already done so, ask them to submit an RFA for the injections to the utilization review (UR) department of your insurance company. If the injections do not help, then ask him to submit an RFA for surgery if you are a candidate and want it. As for your PT denials. When you have a denial, you can appeal to the Independent Medical Review. if the independent doctor overturns the UR decision then you get your PT, but if they agree with UR denial then you have to wait a year to try again. Meanwhile, if you try again sooner than the year, the RFAs will not even go to UR. If your adjuster and not UR is denying the PT then most likely either your doctor is not properly submitting the RFA or you are within that year period of waiting or your case or body part requested is denied.     I’m so glad that I hired a Workmans comp lawyer. Workmans comp never did try to screw me over, but there are so many little things you need to know, and having a lawyer helped in dividends. One thing to know though, is that everyone involved, both the insurance company and the Workmans comp doctors look for and know how to look for people faking injuries. I’m glad I was a legit case with X-rays and tests, and I was still scared of being called a fraudster. The doc had to tell me to relax because she knew I was really injured. But seriously, I’m so happy I got a Workmans comp lawyer.

    My case it has been denied and my attorney doesn't seems like they are familiar with workers compensation cases ..all I ve' learn it's cause I ve' watch videos from others attorney on KZread , videos like these ones.I really feel like wanted to get a different lawyer but they also said that it's not a good idea to being jumping to jumping on lawyer..and I don't know what to do. All I'm getting it's the bonus # 1 I guess TTD from EDD had a deposition also AME and almost a year now and still nothing . everything it seems like going no where mode.

    I’m was a machine operator I made paper for a living in I was pulled into a machine by a lose belt burn my face and most of my arm up to my underarm and shoulder things have been very slow took yrs just to see doctor when I did finally reach that part of my claim things were worst I never got a skin graft also I found out I had a shoulder and neck problems I now have ptsd ,extreme depression and extreme anxiety since then I’m now on disability and I just recently had to file for SSI my life is over

    I am sorry that happened to you. We do sometimes get referrals to plastic surgeons in cases like yours. And this kind of case is common to be accepted off the bat. I do not know what could have caused delay. Has it been more than 5 years since your date of injury? If not, you might try reopening your case for a new and further injury. If SSI is denied, I can refer you to a disability attorney to appeal. Just text " SSI referral " to 909-266-0003 Have you used your retraining voucher?     Thank you for your question, TTD benefits are available up to 5 years from the date of injury. To qualify, a person must have an accepted injury that has not been found permanent and stationary or maximal medical improvement. where a work comp doctor normally PTP has given taken them off work or given temporary work restrictions that the employer cannot accommodate. Also must not have used up the 104 weeks of TTD yet. If you don't have a PTP, ask your adjuster for the help line number to call for a doctor appointment if you don't have an attorney. General info.     For this program, to be eligible, you need to have received an SJDB voucher. To have one of those, you need to be an injured worker that has an amount of permanent disability and was not offered modified work from their employer within 60 days of receipt of permanent restrictions.     How about if you just want surgery, attempt to go back to work but have pain and never the same again with 20 years left until retirement. If the employer accepts that but your performance drops and they decide to fire you because of the performance, how is a tiny settlement fair? Is there a way to get enough to help more with the rest of life not the same anymore?

    Another question. After you get the AME report and you're deemed P&S/MMI, and the doctor gives you a percent rating on the report .... Are the adjustments (age, type of work you did, etc.) calculated after you get that AME report, or had the AME doctor already included those adjustments in his report. For instance, if AME report was 25%, will it be adjusted out later by an attorney and end up with a higher PD rating? Thank you ;). Excellent video BTW. You're awesome!!

    Thank you Nica :-) You seem to be confusing one thing, units. The AME wiil give his numbers in terms of WPI (whole person impairment) so 25% WPI. Then you need to convert that number into PD (permanent disability) that is the calculation you are referring to. Then if the dr apportioned part of your injury to other causes, that PD value will have to be lowered. So if PD was 10% but 1% was from a prior injury, then you only get 9% PD.     @@JackADoodleThePoodle That means there is no apportionment. So in my prior example, you get all 10% PD value paid out instead of only 9% PD. Also, yes your attorney can rate the report and you can get the court to rate it as well to double check accuracy.

If your injury was caused by work, you should tell them. Then you need to fill out a DWC 1 claim form. I have a video on how to report your injury.     @@GonzalezLawEmpower Yes. I have an injury over 70% and my Law firm is taking very long on my Sibtf case. Also, my lawyer wants me to settle for a large 6 figure but I don’t know if I want to compromise and release. I will likely need chiropractic and massage for life because my spasms don’t go away. I want to know all my options in settlement. I actually believe my injury is worth 7 figures not to mention the cost of spinal fusion or a more conservative procedure has been 7 figures. My brother had to have fusion from his accident that’s how I know. After you answer this im going to prob delete this response bc I’m not trying to tell the world my issues lol.

    Thank you for your question Ivett, Are you closing via C&R, Stipulation or trial? If Stip or trial, you should be able to keep your Kaiser PTP for future medical. If C&R, it would depend if your doctor is only part of Kaiser on the job or if they are on the regular side as well. Also if you have Kaiser insurance privately. Hope this helps, Naomi

    @@ivettburciaga874 its always a good idea to check with your insurance prior to settlement. However most people treat with their private insurance after their injury is no longer under the jurisdiction of workers compensation. Especially if the case was denied.

    @@anthonywylie5771 Sometimes you need to request the PD advance checks. If not PD starts after your settlement. And the advances will be taken credit for by the defense i.e. they won't pay twice instead you are just being paid early advances until settlement or until the pay out your portion of your pd. So if you haven't already, send a letter demanding pd advance start. Then file a hearing if they say no. Hope this helps, Naomi

Some people have no money in their edd account or some are not qualified for other reasons. You might consider applying to see if you are eligible.     I really need to talk to someone about my last case. They didn't do anything to fix me, im still in great pain ( 6 years down the road) and no dr will see me because it WAS workers comp. I need help I took 175 pounds (grown adult human) free fall 5 feet landing on my head neck and shoulder . I went to the hospital where my chest and wrist got xrayed. Ignored my cry rocking while holding my head from pain. Didnt feel around my shoulder. Just sait muscle contusion. Physical therapy. After 3 rounds of pt, it was gettong worse so i went on to see a surgeon. He founf my broken collar bone. Doing it not knowing of the break, it shot everything in my right arm. Laletly it seems the bone that broke off is in the nerve in my shoulder causing issues in my hand. Wc was so long ago and i dont want to go back to wc bs. But no dorctors will help me and say " oh report to work"

    Hi there, I sent you a response on your other text as to a general requirements. But in a case like you described, you may have been released from care Permanent and stationary a long time ago. If they were released with no future medical, then they won't be able to get treatment three years later. There is a year to appeal the no future medical only. In your case, you need to contact your adjuster to know what your options are at this point.     Thank you for your question Victoria. Is your injury in the California Work comp system? Sometimes employers will extend their health insurance benefit when you are on TTD if you pay what they normally had been pulling out of your check. But that is only for a period of time usually. Check your employee manual to see if it covers that time period. What people normally refer to as "workman comp payments" is usually just Temporary Total Disability payments paid by the work comp carrier. But if you are in a different state, they have different names for everything. - Naomi

    I had a quick question. My workers camp attorney basically told me "If You don't like my representation do it Your self!" I Did! 3× MORE on my own I believe the legal term is : in pro per. I just realized I have to pay this incompetent attorney that bungled my case and dragged out the case case for no reason give me no care for 3 1/2 years , Taking months to call me back after I requested to be kept up-to-date with the status of my case.hung up on me several times. Refuse to refer me to or take on other pending cases that were related to my worker's compinjury such as sexual harassment wrongful termination assault At work. Loss of pay hours.     Thank you for your question, First of all, you totally got me with your name. I saw my notice that said my mom had commented on a video and I clicked thinking it was my mom. At the same time wondering how big brother knew who my mom was. Then I realized it was you LOL :-) You cannot exparte get attorney fees reduced i.e. meet separately with the judge. But you can petition to reduce the attorney fees. It will go to a hearing where the prior attorney and you will be there and you can tell the judge how little work they did and how much you did and everything else you think is relevant. File as much document proof you can with the petition e.g. text messages or emails, filings you did, itemized list of work they did and you did. Don't expect the prior attorney to agree with your assertion of the work he did. They probably have their own story of what happened. Good luck! Naomi

    I'm sorry the QMA destroyed a previous report , the report was lie. I never injured NY low back until 2008. I asked for a copy they didn't have one the defence attorney doesn't have it nor does the claim adjuster. Shouldn't the plaintif receive a copy of the medical report. I know they never had the reginal report. I want to change the QMA. The QMA lied on the report , the defence wants to god forward.

    I want to thank you for your reply it seriously means a lot to me you just took five minutes to read what I wrote and I’ve gotten more out of you than I can get out of my lawyer I have so much to say but just not enough time because I don’t want to say my whole case on this page but I do have a lawyer and she never appeals anything I just recently asked her if she was going to appeal the denial and she never wrote me back and I have copies of everything I’ve ever emailed her and replies that she wrote back it would blow your mind the way she talks like I said it’s been 17 years and she hasn’t done a damn thing to me she let my settlement go as I stated before August were talking a couple hundred thousand dollar set a compromise and release and the next letter to weeks later as you have no award I ask her what it’s about she just puts it in other terms and she doesn’t wanna reiterate that’s her favorite word she doesn’t want to reiterate nothing my case is so messed up it would make your head spin if you know anybody who would want to take it and see if there’s anything out of it I would be so grateful I just don’t know how to explain to anybody what is gone so wrong well thank you anyways for your reply it really means a lot to me I wish I would’ve chose you along time ago seriously thank you for your time C.C

    Thank you for your question Ondria, I am afraid I do not understand. You work in a mental health facility? Or you have a psych WC claim but were misdiagnosed during treatment? In general, you can pursue a medical malpractice case if you are not passed the statute of limitations. As far as WC, the new permanent disability of the correct diagnosis and conditions should carry. But if you were given PD 14 years ago, you can't really change that now as you have 5 years from the date of injury to file a new and further injury. Hope this helps, Naomi

    Thank you for the question JM, Are you referring to 14% PD or WPI? If not completely unable to work, the functional capacity helps determine your appropriate restrictions.     @@JM-zf5cz That WPI needs to be converted into PD rating. Your attorney can do that or you can request a DEU rating for the court to convert it for you.     @@GonzalezLawEmpower I’ve never met my attorney and the defense attorney wants to offer $24,000 minus my attorney fees and I get a voucher for school. That’s why I’m not sure if I’m being robbed or my attorney is selling himself. Is that a good amount for a lump sump with my WPI AND 25.5 of my FCE ? Please give input, i just want this to end.     Thanks for the question Mary, We usually see TTD overpayments when either (1) PTP or QME finds the injured worker Permanent and stationary thereby making them not qualified for TTD, BUT the report is not provided for weeks after the appointment. Meanwhile, they keep getting checks. So they were overpaid TTD. OR (2) they paid them at a higher rate than they should have. ie more than 2/3 their gross pay. Hope this helps. She really got disabled from Social Security on it but she does not understand English why do you think the outcome will come out once our case gets settled she has L one in the L2 hernia disc she really got surgery but she’s not feeling anything any better The doctor said that she’s ready reach MMI.

    @@alexeloisa4509 Hi there, Without seeing her case, i can't tell. Generally speaking. But if a doctor find you MMI that's good. Ask your adjuster or attorney to send that final report for a DEU consultative rating to get our court to rate it. If you want to C&R, it should be that value plus what her future medical needs will be. If she is on SSDI, she will probably need a Medicare set aside. Ask your adjuster or attorney for one. That will help you value future medical. But ask your adjuster or attorney what is involved in a Medicare set aside. Too long to explain here. Make sure you have a hartman addendum in your settlement docs because of the SSDI.     I heard a couple of Lodi ca Transit workers talking about the head manger of their department.. These guys said she works 3 days a month and lives in New Mexico the rest of the time.. People I do not agree with this kind of behavior..

    My treating providers said that my injuries are stationary for brain injury after almost a year of workers comp. Now the insurance scheduled 3 IME appointments. One claimed my injury revolving my eyes would 99% get better but minimum a year or more of time even though it's going on 4 years since injury. My doctors said its been almost 4 years since the injury and there's zero improvements. The eye doctor said he's telling the insurance to pay benefits. BUT insurances said they were not authorizing anything until all 3 IME were completed. I have only a psych exam left. The neurologist & psychologist are known for always blaming other things or that it's in your head, but with my diagnosis', which some are visible, can these doctors still lie to get the insurance free? I need to follow up with my neurologist to get more medication & evaluation, but insurance are denying until then.. What are possible outcomes?

    @@GonzalezLawEmpower Knowing other attorneys on the east coast WC is similar here. CA I see is different. I got word that the exams were just to try to find ways to say my injury was coming from something else, which they've failed already. Or try to say my TBI isn't that serious. Adjuster told my doctors office that she's not sure if I deserve benefits or not pending Psych exam which this doctor is notorious for lying in his reports stating that "injury is in the patients mind" & winning. Total BS. Even though my diagnosis are also visible, I hope the commission isn't that evil to believe him. Thanks & wish me luck.
