  For anyone who’s dealing with these evil workers comp managers, their doctors will always say, they cannot find out what the issue is when you’ve been injured on a job. AND PLEASE DO NOT GIVE THEM ACCESS TO YOUR FULL MEDICAL RECORD HISTORY. DO NOT DO IT. Go to your own doctor, gather medical evidence and keep scheduling appointments with your workers comp manager and wait it out. Eventually they will offer a settlement and before you reach this stage, you need to gather information about your injury, surgery cost, lost wages healing from surgery, physical therapy and negotiate a settlement depending on those factors. Workers comp often deals with individuals who doesn’t know their laws or how workers comp functions, remember, all they can do is induce fear. So study about the laws. You are in control. They will also try underhanded tricks, like trying to make you resign before you receive the settlement papers and stuff like that. Do not talk much with them on the phone either, just give one worded answers and EMAIL THEM ALL THE TIME. I absolutely hate them and they absolutely hate us no matter how sweet they sound. Me and my recent workers comp had heated situations due to her own misunderstandings. Their goal is to belittle your injury and stop you from pursuing the case any further. PUSH AND PURSUE. It will work out!

  So I had reached out to my claim specialist about a C&R per my dr knowing my MMI date was coming up. We settled on an amount.. I was told paperwork would be sent out that week and then she ignored emails on and off for two months. She told me I could cancel my doctors appointment, which I did. Only now to find out via the defense attorney I need a P&S to take to the judge. That being said, I tried rescheduling my appointment. I can’t get seen until September now. When we first talked about settlement she made me feel like it would take too long to get a QME. But after her ignoring messages and prolonging my case for the last two months I could have been to a QME or at least not cancel my last appointment so that I could get a C&R. I explained to the defense attorney financially I need to settle and I want to take on my own medical bills … originally he said we can do it without a P&S now he’s stating that we need one to move forward. Its beyond frustrating.. I contacted my doctors office but they stated that my case was moved to a specialist so I would not be able to see my primary any longer to get a C&R. I feel like I’m constantly being told one thing over what the actual truth is.

  My permanent stationery restrictions the last accommodations I was given caused me more pain the accommodations I've always had that was stripped away from me but no warning at all don't understand compliance is still tried that accommodation like I said cause more pain couldn't even complete could not work 5 days at 4 hour shifts how much more pain I was in and it cost

  I am a traveling manager with the State of California and was injured on the job. My CW case is accepted. I was told by my employer that I will not receive any compensation for lost overtime. I average over 15 hours of overtime per month consistently for the past year. Is overtime factored in? Also I was approved for IDL pay but my job has been using my leave credits instead of and I have yet to receive any money from IDL and all of my leave time has now been used up. My on the job car accident happened over a month ago. Will I get my time back ?

  Ive been out of work since last summer makde an attempt in November of last year when i opened my case not until may of this year had my first depo. Then in june had my second depo i wasnt present. Ive had 6 weeks of treatment with the attorneys doctor. Ive run out of my edd and in need to return to work. Have to many bills. Ive been doing my own light work outs at work for my pain it has helped. Would i be able to return full duty would it affect my case

  Hi Renee! Yes, you want to look carefully on stipulation page to make sure you agree with everything as truth. That's what it means stipulate. Make sure all issues are listed. Eg if you think you are owed TTD, the defense may not list it. You need to add it. Judge will only give opinion on specifically what is listed. For evidence, you MUST list all your evidence.   California does not have reciprocity with any other state unfortunately. Attorneys must be licensed in the state they practice for the most part. Exception being federal work.
