I just said it under other vvideo that Elizabeth was only possible because of Americas HORRIBLE,HORRIBLE heathcare system....I live in Europe and never payed a cent for my bloodtests, everything was always correct but in US Ithey have made peoples health a literal business, thats not okay, I dont understand why arent people in US rioting on the streets, I would be outraged if my country would have healthcare system like that

What does an NDA have to do with systematic flaws? They’re usually not ‘forced’ and any contractual agreement entered into due to duress is void anyway.

You can only sue people for defamation if the statements are _inaccurate_ and NDAs are legally void insofar as they cannot be used to suppress illegal activity.... As a prolific and experienced lawyer, David Boise knew this. Did Boise know about Therano's deception? I don't know, but it's telling that Theranos's never went through with legal threat against the ex-employees, like Cheung and Schultz, and Carreyrou.

I think he said something along the lines of “I’m a very good judge of character” in an earlier episode and, to me at least, it felt like the writers were essentially saying that he might not have any problem representing Theranos but doesn’t have any doubts about it all being BS and Elizabeth being a con.

That’s not how NDAs work… It’s a completely blanket agreement. You say absolutely nothing regarding your work at the company. There’s no discussion of whether what they said was true or not. Just speaking about the company in any detail will break the agreement. When it comes to whether it’s true or not that’s what matters for the defamation lawsuit.

While I appreciate that the content of what you are saying is meant to describe an illogical statement, the form in which you cretique it is not logical. The implied logical argument by Kurtwood Smith would generally be as follows: Premise 1: You cannot trust anything else from an untrustworthy person. Premise 2: The Reporter is untrustworthy Sub-Premise 1: People who break NDAs are untrustworthy Sub-Premise 2: The reporter broke his NDA Argument: The reporter broke his NDA, therfore he is untrustworthy, therefore you cannot trust anything else from this person. Based on the outlined logical form, we can see the premise "if you are lying, you will not break an NDA", is a non-sequitur. It does not follow Kurtwood Smith's argument In fact, this example shows the limit of logical as a critique. Kurtwood Smith provides a valid logical argument, he is a lawyer after all. And yet he uses it to spread misinformation and falsehoods, he is a lawyer after all. Instead a better understanding of the subjective political dimension behind NDAs is the best way to approach this.

It’s so obvious that this lawyer sees right through their BS. But he sticks around for quite mysterious reasons. I think he was just interested to see how long EH and SB could keep their Con going. With his look (the choice of actor was very interesting considering what he is most known for) and mysterious motives reminds me of that one mysterious character in TV shows that no one really knows or understands but he knows everything and can seemingly predict the future which means they can get out of very bad situation and be the only one to escape unscathed. Sorry for going on a weird rant about this minor character.

I think he said something along the lines of “I’m a very good judge of character” in an earlier episode and, to me at least, it felt like the writers were essentially saying that he might not have any problem representing Theranos but doesn’t have any doubts about it all being BS and Elizabeth being a con.

If they broke their NDAs they must be telling the truth because by definition they'd be disclosing facts about the company. I think it's a way to show that he knows what's going on

I love the logic of "they are untrustworthy, they break NDAs". Well, if I am lying, I haven't broken an NDS. And because I haven't broken an NDA, I must be trustworthy. So I can't be lying.

That’s not how NDAs work… It’s a completely blanket agreement. You say absolutely nothing regarding your work at the company. There’s no discussion of whether what they said was true or not. Just speaking about the company in any detail will break the agreement. When it comes to whether it’s true or not that’s what matters for the defamation lawsuit.

While I appreciate that the content of what you are saying is meant to describe an illogical statement, the form in which you cretique it is not logical. The implied logical argument by Kurtwood Smith would generally be as follows: Premise 1: You cannot trust anything else from an untrustworthy person. Premise 2: The Reporter is untrustworthy Sub-Premise 1: People who break NDAs are untrustworthy Sub-Premise 2: The reporter broke his NDA Argument: The reporter broke his NDA, therfore he is untrustworthy, therefore you cannot trust anything else from this person. Based on the outlined logical form, we can see the premise "if you are lying, you will not break an NDA", is a non-sequitur. It does not follow Kurtwood Smith's argument In fact, this example shows the limit of logical as a critique. Kurtwood Smith provides a valid logical argument, he is a lawyer after all. And yet he uses it to spread misinformation and falsehoods, he is a lawyer after all. Instead a better understanding of the subjective political dimension behind NDAs is the best way to approach this.

It’s so obvious that this lawyer sees right through their BS. But he sticks around for quite mysterious reasons. I think he was just interested to see how long EH and SB could keep their Con going. With his look (the choice of actor was very interesting considering what he is most known for) and mysterious motives reminds me of that one mysterious character in TV shows that no one really knows or understands but he knows everything and can seemingly predict the future which means they can get out of very bad situation and be the only one to escape unscathed. Sorry for going on a weird rant about this minor character.
