This 54-minute interview, done in two parts but presented as one, first explores at length a range of concerns about the working of the Collegium System. These concerns include its opacity, the scope it creates for nepotism, the fact that good candidates are often ignored and not elevated, the fact that inappropriate people often become judges and embarrass the Supreme Court, the fact that the author of the Collegium System, Justice Verma, changed his mind about the Collegium System and in 2004 said a National Judicial Commission would be preferable and, finally, if the Collegium is deemed to be perfect, which is Justice Lalit’s belief, the Supreme Court must fulfill all its requirements with clarity and, if necessary, toughness and this includes insisting that names reiterated for a second time are accepted by the government.

    50 Families ruling SC Talented people left out to become CJI. People with no talent & wisdom coming to Judges. People with few Caste in system. No fair competition to chose CJI. just recommendation No representation of Majority Population. Gogoi went to RS Just. Misra praises Govt in power. But But But.... According to Just. Lalit COLLEGIUM SYSTEM IS PERFECT. Wow the institution which is given responsible for Justice is itself faulty. 👏👏👏👏👏

    They are running a modern,polished form of monarchy in the Supreme Court. 99% of supreme court justices are the sons and daughters of justices or Advocates of High Courts or Supreme Court. The talents from the district courts retire in the districts and a handful of them get to the High Courts.. And that too for so brief period of time that they can't reach the apex court where the seats are reserved for the Rajkumars and Rajkumaris of the monarchy.

    Good discussion. Ex CJI's replies are very were informed and balanced. Coming to the Judges appointments any system can have some imperfections and no system is perfect. Collegium system also may have some imperfections. But still it's better than the NJAC system. Some say there is transparency in collegium system. No system is fully transparent. In what other selections fulldetails are released to public. Separation of powers is paramount for democracy. If higher judiciary is also appointed by the executive then it would be compromised judiciary. Then people will suffer. That's why collegium system inspire of alleged imperfections may still be better than other presently proposed methods. If govt wants it can try to bring some improvements in the current system.

    At @20:07 of this video,when Justice U U Lalit was mentioning the criteria for the appointment of justices,he should have been allowed to complete listing all the criteria.However,he was interruped before that,when Mr.Thapar raised his argument over the viability of the first criteria Justice Lalit mentioned.This could have been avoided.This interruption from Mr.Thapar has deprived me as your viewer( i.e as a viewer of the wire) about learning on the criteria considered for appointment of judges. I'll appreciate if my view can be considered.

    Interview of Justice Lalit is of the calibre that years back made me a fan of KT..but when bias steps in, the charm of purity is the first casualty and distaste sets in! The patience evident in Justice Lalit is exemplary and makes him a role model for most of us! Post interview, a question arise.. how can anybody or any collection go for godly self-promotion..that itself sounds as going against the rule of natural law!

    Indian judiciary is ridiculed for its decision in the case of Babri-RJB in which the judgement was given on the basis of faith as against evidences. Indian supreme court must be by far the only court in the world to hold this dubious record.

    Very interesting conversation. Throughout the march of time, human beings have tried to create perfect systems of governance for dealing justly with the affairs of state and its citizens. But systems can only be as good as the people in charge of them, and the human creature is fallible and prone to err. Of course, some individuals have proved themselves to be morally and intellectually superior to others, but attainment of perfection in any area of activity in this world is impossible. Yet, our attempts and ambitions to create utopia will continue. Such is life !

    Since Justice Lalit represented Hon'ble Minister Amit Shah, I thought he would favour the Government. However, he turned out to be a honest and upright CJI. It is pity that he served as CJI for only couple of months.

    The process of selection and the promotion in judiciary in India is flawed and rigged. Specially the collegium system . It needs to change immediately. Why not assess any judge after every 10 judgements he makes ? If it’s found out that majority of his judgements are changed in the higher courts - does not it say that he is not capable of being a judge ? No accountability? What is this? ?? Why the SC does not allow a nation wide competitive test to be a judge just like any civil services test, of course with few years of practice behind . And one more needs to be added - psychological tests such as Aptitude tests. Why not transparency on their assets? Should they not be assessed in every few years and fired if not you to satisfaction - coded criteria to be decided

    I'm Sold to Shri Thapar, Morally for his extremely brilliantly logical views/interview with former CJI UULalit. An excellent and Apt application of the Dictionary meaning of the word CUNSULTATION vis a vis CONCURRENCE. How true " Judges are NOT the masters of Language ". The issue of correct interpretation/meaning of the impugned word must be sorted out either by SC or Parliament sooner than later.

    All corruption cases should not be listed in judiciary which is also suffering from malaise of corruption. Swift and corruption free independent system should be on lines of lokayukta. Then only few cases will be left.

    1. In several High Courts some lawyer(s) is/are more influential than others and the capacity to influence derives its strength from family background, proximity to Senior judge(s), and some time financial capacity. Collegium system encourages this nepotism. 2. Some of the nominated judges may have their family' s interest in some business such as running unrecognised medical/engineering /law colleges etc. Collegium does not have access to such irregularities and Govt in executive has such secret data and Govt should have the power to disagree with the recommendations of Collegium. An excellent discussion by Karan. Hats off to you.

    There is a factual error by lordship at 26:20. Justice Kureshi had not retired when the next meeting of the collegium took place in which 9 judges had been elevated to the Supreme court.

    Indian judiciary is the most un-diversified judiciary in the world. The minority bammans are found disproportionately high in higher judiciary and the resultant mess is there for all to see; communal, caste biases are a given. What else can happen when ppl from castes known for lack of judicial character and integrity dominate the judiciary. The collegium system perpetuates the casteist character of the judiciary because of ample scope for cronyism. The anti egalitarian character of the indian judiciary got exposed when it deliberately fixed the cap of 50% to reservations when it came to giving reservations to obc’s but when it came to extending reservations to their caste-cronies under EWS they blatantly removed the cap of 50%. It’s high time every castes and community gets a fair share of representation in the indian judiciary in the interest of justice …..

    Independence of Judiciary without Justice as perceived by common people? Self appointment does not mean independence. There must be independent body on recruitment. Anti National Judges must be removed.
