Walking a fine line with paddle brands

The recent string of delistings has raised questions about paddle testing. One group in Florida even believes they were defrauded along the way. The paddle landscape has never seen so may lawsuits at the same time.

I explained this situation to ChatGPT and asked for possible explanations of what is actually happening with the Gen3 controversy, here were its "possible explanations" 1. Administrative Error: It's possible that there was a genuine administrative mistake in the initial approval process by USAP (USA Pickleball Association). This could mean the paddle was mistakenly approved without thorough testing or a miscommunication occurred during the approval process. 2. Technical Specifications Change: Joola may have made changes to the paddle's design or materials after the initial approval by USAP, leading to differences in performance that were not evaluated in the first approval. If these changes significantly impacted the paddle’s characteristics (like increasing spin and speed), it could justify USAP's decision to revoke the approval. 3. Testing Discrepancies: There might have been discrepancies in how the paddle was tested by Joola and the testing methods used by USAP. Different testing conditions or criteria could lead to different outcomes and interpretations of the paddle’s performance. 4. Regulation Changes: USAP could have updated or changed its regulatory standards or criteria for paddle approval shortly after the initial approval of Joola's paddle. If the paddle no longer met these new standards, it could explain why it was removed from the list of approved paddles. 5. Misrepresentation by Joola: Joola might have misrepresented the paddle's characteristics in its application for approval to USAP, either unintentionally or intentionally. If discrepancies were found between Joola’s claims and the actual performance of the paddle, USAP might have decided to revoke its approval. 6. Competitive Balance Concerns: USAP might have received feedback from players or other stakeholders about the paddle providing an unfair competitive advantage, prompting a reevaluation and subsequent denial of approval based on concerns about maintaining fair play. 7. Public Relations and Damage Control: Joola's claim of an "administrative error" could be an attempt to manage public relations and maintain consumer confidence in their product, especially if they believe the paddle might still receive approval in the future.

Zane and host, please read the recent lawsuit by Joola that has been published and you may have Joola answers on some of this podcast’s questions about the gen 3 paddles situation. One may believe Joola or not, but from what another podcast reported (by summarizing the content of the lawsuit) there are a lot more details on what the USA PB association did, that are also questionable. The main problem is lack of information for manufacturers on limits that should not be overstepped and clarity on tests to use. The behavior of first approving and then delisting paddles without clear explanation of tests used and limits that should be respected is highly disruptive.

Agreed. Vatic Oni was just delisted. Honestly there is no reason for the ball to compress like a tennis ball. Pickleball isn’t suppose to be just ground strokes and shake + bake. Super hot paddles are bad for the game IMO. Players under 4.0 play worse with hot paddles. Hit even more balls out than before at the rec level. They need to work on their technique and drill not buy into the marketing. Gen 2 paddles offer plenty of power. Shouldn’t have to wear glasses to play freaking pickleball lmao. Not enough strict rules in place for paddle companies. It’s the Wild West right now.

What about the Gearbox Power Pro? This is even faster than any of the Joola Gen 3s and would be even more "dangerous" if that is USAP's reasoning for coming down on the new power paddles. Clearly it would not pass the new exit velocity test.

    - the admin error "depending on what it is" could be ammo, if its not sufficient then its best for the non-profit to approve then delist within the 18 months and abide by their own guidelines. Settlement, drawing a line in the sand and saying "no more than this" and publically communicating testing standards moving forward.

USAP is going to try and cover their asses. JOOLA will say anything for those millions. Just looked it up. The USA Pickleball President's salary is about $700,000. That's what I could find. Not bad for a non-profit. If that is what it is.

The key to a class action is punitive damages. Class actions were born from big companies getting away with small infractions and no attorney would take the case because they would lose money going against a giant corporation over a few dollars. With class actions the court can punish the company for their misconduct (fraud) and impose penalties (punitive damages) beyond what the plainitffs lost out of pocket to send a message. Lawyers also can get their fees and these often settle. Interesting that the class action is againt only Joola and not USAPA. My guess is USAPA doent have $ like Joola and the class wants to force Joola to litigate against USAPA. Joola has to say they sent the wrong paddles bc it would be disclosed in discovery (all corporate docs would be disclosed and depositions of all officers) and they have an easy defense that USAPA violated their own rules which account for accidents like this. I bet all the litigation will settle (people will get $5 lol), paddles wont be reinstated but USAP will probably pay Joola a little bit. l'm an attorney but I only have basic litigation knowledge.

What is the probability that of the, guessing here, 50,000 paddles made 2 of them, or .004% were sent. Zane’s right I’m calling bs. $280 for a paddle, ridiculous.

proton doesn't seem excessive to me, I have played with the Series 1 A 15mm, series 2, and series 3. At no time did anyone tell me that they had excessive pop or power. The Nanotech coating is awesome for spin though and doesn't degrade like raw carbon fiber or the gritty sandpaper paddles.

I think Joola engineered a paddle to beat the system with the current/now previous USAP testing metrics that didn’t use exit velocity. Once USAP realized Joola created a faster paddle beyond how paddles were currently tested, they backtracked and started dropping the ban hammer on any paddle that didn’t fall within their new requirements. Even Ben Johns himself foresaw new USAP testing metrics coming down the pipeline prior to the Gen 3 releases. Inevitably, it’s a mess.
