Nogla was right; he was never read his rights about the right to a lawyer. His arrest is invalid. EDIT: Apparently, according to Miranda law, only things Nogla had said cannot be used against him as evidence in court due to him not being read his rights or provided an attorney. So what I said above was wrong. However, not being provided/allowed a real attorney CAN be used as a way to appeal to a higher court to have the sentencing revoked and/or the trial re-done. Actually in some cases if you have a really good lawyer they can get the case thrown out for them bot reading your miranda rights. Most lawyers dont try this, due to it being difficult and hard to prove. But it has happened before.
