    Chad this was great. I’m a homeowner in Colorado who had a house fire and the insurance company’s initial estimate wanted me to just replace everything but with the code requirements and everything I’m going to have to end up replacing the foundation and starting everything from scratch. So I got bids, built a xactimate estimate and now submitted that to max out my coverage limits and get this done properly. This episode and a few others from you have taught me a ton! I’d love to be a case study of you ever wanted one from a homeowner who did this on their own

    A few months ago I had A I insurance company approve a roof that they originally did not want to pay and was going to originally deny , then the tryed to dictate that the roof was only worth $11,500,, then all kinds of c&o or law and ordinance work had to be done in order to do roof correctly and when they got final bill, they told owner that he didn’t have codes and ordinance coverage and that’s all they were going to pay lol,, fast forward 2 months later and all of a sudden my attorney made them settle for the remaining $20,000 ,,, isn’t that amazing that they ended up still paying for the roof plus now they had to pay the attorneys fees too😆 Thanks Chad for all of what you do to help contractors that don’t know how to navigate and never take No for a answer from insurance companies,,,keep bringing the videos and the receipts,,

    If the client shows you their policy to show you that they have o & c coverage can you than talk policy to the adjuster to get paid for the decking I already installed and they say they are not paying. My client showed me the policy and I see where it says it is covered

    Agreed. And 'law' does not warrant policy coverage but homeowner responsibility. But still awesome information.

    ​@InsuranceRestorationTraining you don't have to be polite to dip shits. But I'll be an asshole for you. "Ordiance and law coverage," appropriately named, does in fact mandate approval because in building code terminology, the "strictest shall govern. For example, say the city enforces code on manufacturer specifications, and they paid for a single single repair on a shingle that is currently available at your local supplier. The roof doesn't have iws or felt on the location the insurer mandated a repair. This is a replacement on contiguous roof surfaces because code mandates iws and felt overlap hips and ridges 6 inches, and iws on eaves, hips, and valleys. This is an intellectual topic that requires more than just the rules your carrier pretends doesn't exist. A real contractor or GC adheres to rules and has attorneys that will enforce proper coverage, until next time.

    This is incorrect. In the first chapter of the IBC/IRC states if this code is adopted with no amendments countering or improving on them. Then this is the measure of Best Practices. Best practice is the standard a contractor is required to build by regardless if a permit is pulled or a building inspector inspects.

    I'm currently fighting against an adjustor who is denying a full roof replacement, but they are already paying for the Front slope being replaced. We're using GAF shingles and the manufacture instructions want us to overlap the Felt paper to the opposing slope. This violates IRC code, so I would assume we can use code and ordinance to justify a full replacement. They are still denying it after the information has been sent and I've called their manager several times while pushing code and instructions. They now want to get an appraisal. I want to keep escalating this but I'm not sure if they'll budge. What are your guy's thoughts? Enumclaw is the carrier.

    So does that mean they haveta pay the full coverage? Or just on the items you spend on? Someone drove through my home and I’m trying out my first home, I’m 27 and I have 8,700 in OL coverage. How do I get them to send the full amount? I live in Oklahoma and is it itemized or is it that if it’s a building code area they pay the full amount?

    It means that any part of the repairs that are only necessary to perform because of items needing to comply with building codes they will pay up to $8,700 for those items… in addition to all other repairs that are a part of the job that aren’t code compliance related.     My adjuster has ask me to get a letter from the city saying that they enforce section R905.2.1 How should I handle this?

    Check the city building department website to see which version of the International Residential Code they have adopted. Screenshot that page and make sure it shows the url address to show it’s the city’s website. Then go to that version of the IRC and screenshot R905.2.1. Send both images to the adjuster and tell them that the city does indeed require the code. If they push back any further ask THEM to provide a letter from the city that they do NOT require it. If it keeps going from there, email the city attorney and ask if there are any of their municipal codes that they do not enforce. Don’t use a construction company email address. Just use a normal one and don’t ask specifically about construction codes… just all city codes. Send the reply to the adjuster and tell them to kick rocks. Kidding about the kick rocks part. Be professional, courteous and polite. If the adjuster doesn’t understand how codes work, educate them… In so doing, you are making the world a better place!     That’s a tough hill to climb, to be honest. If they don’t have the coverage, there isn’t a ton you can do. You can try to focus on manufacturer requirements and focus on what is needed to pass an inspection. The insurance company may allow certain items to be included but it will be very strict and tight. The best policy is to make sure they have the coverage in the beginning. Hopefully if they don’t, you know about it right away in the beginning of the process. I hope this helps, brother.
