Sir IBC me application for initiation of PPIRP se pehle FC's ka approval lgega 66% ka or is approval ke liye hum unhe Base Resolution Plan provide krenge or Declaration denge ki CD 90 days me PPIRP ke liye jaane wala h. And sir after commencement, COC bnega or use Base Resolution Plan submit kiya jayega for approval. But sir my doubt is ki COC me bhi to wahi FC's hi honge na, to ye double approval ni ho gya from FC's bcz application for initiation se pehle bhi to unka approval liya tha na Base Resolution Plan pe?

Application for initiating PPIRP is given by CD itself(MSME- Co. LLP), so FC's ka approval nhi lgega phle

Sir but as the timeline mentions COC is to be formed within 7 days of commencement of PPIRP and first meeting within 7 days of constitution then how could the Promotors take approval of 66% of FC for approval of plan and appointment of RP before commencement ?

You got it wrong. Listen the background, First, As per Section 54A, DIRECTORS/PARTNERS will decide by making declaration to apply for PIRP and they have to decide a date for making application to AA for PIRP. Then, these directors/partners will approach members/partners (i.e. basically shareholders) that we have to apply for PIRP and then members/partners will pass special resolution approving such proposal to apply for PIRP. Third step will be, the director/partners will approach Financial Creditors and give them the declaration, the special resolution and base plan and ask them to approve such proposal to apply for PIRP. These financial creditors will propose name of Resolution professional to act during PIRP and will approve such proposal for application for PIRP and appointment of the Resolution professional with 66% majority vote. Once, this internal process is done, they will approach adjudicating authority and AA will either approve or reject the plan. If approved, the date of accepting the application will be called as PIRP COMMENCEMENT DATE and within 7 days of this, COC has to be formed. And, within 7 days of forming such COC, their meeting is to be held. Coming to your question, appointment of RP is done by Financial Creditors and not COC. COC will be formed a lot later i.e. after acceptance of PIRP application by AA.

Can creditor move with this amendment claim of Rs.10 lacs ?

There is nothing like pre initiation period. PPIRP should be completed in maximum 120 days. No other teachers have mentioned about pre initiation period of 90 days.

It is given in ICAI Study Module. It does not specify the name "Pre-intiation period" but it says "CD shall file application initiating PRIRP within a definite time period not exceeding 90 days." Page 6.78
