As a signal maintenance subcontractor, this is totally fine. It's much better to just give the railroad police a call and explain the situation than cause even a minor collision. It is very easy to repair gates and in even worst case scenarios we can drop by a workshop and get an entire new gate assembly and replace it in a couple hours. In 99% of cases, no charges are made against any parties involved.

Heres a safety tip that could save any of y’all’s lives!! Railroad crossing gates are actually built to bend like that. If I driver gets trapped between a crossing like this, or any gate-equipped crossing for that matter, they can free themselves by quickly, but carefully, driving into the gate. The gate won’t raise, but it will open outwards as you drive so you can escape the tracks to safety.

I'm glad the driver at least backed up, but it is concerning that they had all of that clear view with nothing in the view and STILL turned with the lights flashing, requiring the reversal to begin with. Not sure if turning it officially 'breaks' the gate, but they really need to put up cameras and start sending out $500 fines for people based on tag/video captures. They need a camera that activates only when the train is coming, which shouldn't be too hard to make. Grab the tag number and mail them a bill to their address on file with the tag office or the business name and using their truck number. The positive was that at least, if that truck is full, the train didn't hit it and send concrete all over the rails (probably would fill the gaps between the ties and road, requiring it to be chiseled out), ties on either side, road and train. It would have been a big mess.

He did the right thing by backing up. Yeah you can get a ticket for it so what. You also get one by stopping or continuing. If the lights are flashing and the gates lower completely, YOU SHOULD STOP. If you're in the middle of crossing, they say keep going but it's safer to back up if there's no one behind you. Some people are saying "he should have kept going" but that's not true. Because around 5-10 seconds after the lights start flashing and the gates lower completely it's dangerous to keep going unless you're almost at the end. Others say "he could have gone around the tracks" when once again, that's dangerous and illegal. He did the right thing. Just think, if YOU were in this situation, would you _really_ care more about the gate instead of your own life?
