Kindly correct the error u/s. 409(2) sessions judge can't withdraw cases once the trial or hearing started only in the case of Additional Sessions Judge, whereare the withdrawal is from Assistant Session Judge or Chief Judicial Magistrate, the session judge can do so once the trial or hearing has started.

Section 409(2) at any time before the trial of the case or appeal from ,or recall any case or hearing of the appeal has commenced before additional sessions judge ,as session judge may recall any case or appeal which he have made over to any session judge

Sec 406(2) also says "every such application shall be made by motion" wht does it mean ? Doesn't it mean that SC can transfwr case on its own without any application? Plz make it clear
