    Don’t let them pressure to settle like how I was told there it no other option but to settle. Do your research you injury may get worse as how mine is you might need more treatment just an advice I wish someone had told me

    I think its best to settle to keep your medical open for the rest of your life pertaining to your injury...its baffeling how big companies always want to buy out while only offering a small amount that won't even cover your future surgery if you need it...

    I wish my attorney could have broken this down so concisely like you did. I feel, and thats really the issue. I feel I “deserve” more compensation, 56 y/o, 2 neck fusion surgeries, and a hip replacement. But realizing that the settlement is based on potential “exposure” explains a lot. Too, I was misinformed about the “uses” of a MSA. Can’t be spent as you need it, needs yearly accountability. If not you could loose you Medicare benefits

    I’m sorry you sustained those injuries and for the experience you had. My videos only pertain to Florida workers’ comp cases as that’s all I handle. That said, if your case was a Florida case, your distinction between what you feel you deserve versus the exposure on the case is exactly the thing most clients need explained to them from the outset so they go into their case with eyes wide open. It’s a hard thing to accept (that workers’ comp really only pays based on what their exposure is) and I find clients need time to absorb that information and let it sink in.     I keep hearing that 99% of cases settle. I’ve been dealing with an SI joint issue and found more problems with my X-rays last week that my chiro found and my work comp doctor wouldn’t even look at. He just wanted me to get the injection that took 5 months to approve. It’s been almost 9 months and I’m curious why they are not trying to get rid of me? The mental and emotional toll this had taken on me is crazy! What are the main reasons they don’t offer to settle? In general? Im not in FL. I talk to my attorney today, but I’m starting to feel like another number in such a broken system. Is it stupid to say you just sent to settle? I’m not settling with no medical, tho. I think I’m just ranting bc it’s so frustrating and I never had any idea what a nightmare this is. Thanks for the video! Appreciate it. 🙏🏼

    Unfortunately, I am only licensed in and handle Florida workers’ compensation cases. In Florida, as long as you were in the course and scope of your employment, doing your normal work activities and that happened resuming in an injury to you, I think it would be compensable. I’m glad you found the video helpful and hope you can find a local attorney who can help make sure you are treated fairly.

    Hows it going I got injured at work and got surgery on my right foot its been a month and I'm not allowed to drive yet my work called me today and said they have work for me but cannot get me a ride to work I have to be siting down 95 %of the time and can only stand for 10 min a hour should I not go to work will I get fired if I don't show up

    how can i find out what my case exposure is by the defense? have a lawyer but he is keeping me in the dark-- this exposure is my case value correct? Well i have 3ea. workers comp injuries with different injury dates--how will this settle?(global?) I"m in california, but trying to get some details that my lawyer is not giving me at this time--( learned my lesson about hiring( he was refferred to me) a shady lawyer .

    I only handle Florida work comp cases and don’t have a personal relationship with a CA attorney unfortunately. Exposure is what the settlement value is based on. In FL, at least, the insurance company will typically pay 40-60% of the exposure on the case. You need to calculate what the insurance company is going to “likely” pay for continued benefits if the cases stay open and don’t settle. You may want to consider demanding an in person meeting with your lawyer and if you’re not satisfied after that, consider hiring a new one. Wishing you all the best.

    @@sbthedon6677 not mines. He told me to settle if not I can be going at it for years. Plus he never called me I always had to call him and he never asked if I was still in pain. I’m still having pains and new pains are occurring I was told both my doctors and none of them really took me serious. They told me people are born like this! Umm but I wasn’t. If I had to give anyone advice going through Worker’s Comp. wait a year and make sure you’re all the way healed and get the full max amount. And find a lawyer who cares about you!!!

    @@sbthedon6677 see yeah then it’s time for you to settle. If you feel like you want to and your ready to settle. But make sure it’s a good settlement make sure the medical payout is a good amount. Don’t forget it’s your medical pay plus the pay for the damage. The medical pay is so that way they don’t have to keep you on their insurance every month and there just paying you out. And the other half would be for the pain that you went through and the damages that are occurring to you. So just tell your lawyer how you know I’m ready to settle and if you can’t help me then I had to get another lawyer. Don’t don’t forget just because we’re not paying them up front that doesn’t give them the right to put us in the back burner versus the people who pay upfront. Either way they’re still getting their money.

    I’m so sorry to hear about your injuries. I really can’t give you any advice if it’s a NJ claim. My advice would be to look for a small firm that specializes in workers’ compensation in NJ. You will get better, more individualized service. In FL, fault is irrelevant as long as you didn’t intend to hurt yourself and value from a settlement perspective would be based on what the insurance company would have to pay in the future for lost wages and medical treatment because of your accident. Hope you can have the best recovery possible sir.

    I have been receiving the worker comp for 4 years now and still receive each month. I don’t have lawyer and I have had 2 surgeries and my doctor recommends me to have another surgery but I don’t want to. My insurance is ok for the surgery but that is all up to me. My insurance ) worker comp) have never mention anything about settlement. Sometime I want to settle and move on with my life. Should I call them and tell them I want to settle? I receive $2800 per month for almost 4 years now. Thanks

    It’s really too difficult to give legal advice based on such limited information and this isn’t the proper forum for that. If this is a Florida workers’ compensation case, please feel free to contact us for a free consultation. That said, your question asks about really two issues: (1) the impact of being paid under the table and (2) the impact of the employer not having workers’ comp insurance. This is some general information about those issues. Being paid under the table is not the end of the world for a Florida work comp case. It may make it more difficult to show your wages earned prior to the accident for use in determining how much you get paid while on work comp but that can still be done based on testimony from you and an employer representative. If the employer had 4 or more employees, in Florida, they would be required to have comp coverage. If they didn’t, you could hold them responsible for your benefits but they could potentially just file bankruptcy. In certain circumstances (typically in the construction industry where they have to have coverage if there is even one employee), there could be another company who would be considered your “statutory employer” and their coverage may cover your accident.

    So I lost a finger due to my employer’s negligence (no sop or safety loto procedure) they did pay for my medical bills and they told me they would send me a check of 1700 compensation for the week I was off. The question is, is that the settlement you’re talking about or is there a different comp? My lawyer told me that I can’t sue my employer as long as they paid for my medical bills and give me the comp? But what about me losing a whole finger?

    I only handle FL claims. Assuming this is a FL claim you are asking about, what you were told about suing your employer is unfortunately correct. When you are injured at work in FL, you are entitled to workers comp benefits (medical and lost wages) but you cannot sue your employer for negligence. This means there is nothing you can receive for pain and suffering/loss of enjoyment of life etc. whether what you receive is a settlement I really cannot say but it is unlikely. In FL if you were paid a settlement, you would have had to complete settlement documents and a Judge would have to approve the amount of your settlement going to your attorney for fees and costs and the amount being deducted from your settlement for child support obligations (if any). Sorry for your situation. Hope this answers your questions.

    Sometimes for higher amounts, it requires higher level approval within the insurance company, which can delay. Or depending on their policy, sometimes the employer themselves has to approve settlement which can also delay offers.

    @Sb TheDon First, I need to tell you that we only practice in Florida so my answer is based on how things are handled in Florida workers’ compensation cases. Typically, if you want to settle your case, your attorney should be providing you with an evaluation of what your case is worth as well as a recommendation for what you should provide as your initial demand. Sometimes, insurance companies do make settlement offers without there being a demand made. However, more often than not, settlement negotiation start with a demand being made by the injured worker‘s attorney. In Florida, settlement is voluntary; meaning that if one side (whether it’s the injured worker or the employer/insurance company) doesn’t want to settle, the case cannot be settled. A Judge of Compensation Claims (JCC) in Florida does not have the power/ability to settle a case. The only thing the JCC can do is make determinations about whether you had an accident, whether you sustained injuries, whether the insurance company is responsible for those injuries and thus what treatment they have to provide you with, whether you have been paid for all of the periods you’re entitled to be paid for and whether they paid you at the correct rate. If you settle a case while not being represented, there are some things the Judge has to do to approve a settlement and if you are represented when a case is settled the Judge has to approve the amount of attorney’s fees, costs and child support being deducted from your settlement. If the insurance company truly wants to settle the case but hasn’t offered anything, this could be because they are waiting on what we call authority (money) to be allocated for settlement of your claim. Sometimes, this comes from the insurance adjuster’s supervisor and sometimes it comes from the employer. I would honestly just be guessing if I tried to answer your question.     I had my work accident 08/2011 I had 3 surgeries all ready I spent most of the time in bed. My attorney told me on the day how much he was asking he never mentioned money before asking me if I was ok with that amount. I am soo confused I am in Maryland anyone can give a consultation please.

    I’m seeing the QME Dr. tomorrow on my back injury (bulging disk) here in California. If I keep the claim open and don’t settle will I still continue to get the bi-weekly checks from workers comp or do those end since we are at 2 years?

    The work comp paid me only 9 months then i had to apply for edd sdi through the doctor because wc stopped paying me. now it depends on the doctor how long will they approve you till they treat u, also after 9 months i had to request for an extention for sdi because im still not back at work which is still pending!!! but dr had approved it. Too much going on my work comp wont even approve my pt for almost 10 months. 7/2020 to 3/30/2021 wc pay 4/1/2021 to 12/31/2021 sdi edd 1/2022 to 4/30/2022 extention filed still pending next dont know may be ill file for Ssdi if im still not back at work. also make an account with edd sdi later if wc stop paying u and you will see how much you are approved for sdi and the remaining thats how i found it and i ask for an extention. But this was my case im not sure how your case is so ask for advice from attorney if your situation is different. get well soon

    @@tariqmsk6541 Really appreciate the input. So WC did stop paying me (reached the 104 week max) so I filled out the online form for SDI. Waiting to hear back from them but it sounds like my Dr. has to send it paperwork? My lawyer didn’t mention SDI until I heard about it online. My fear is the Dr. won’t want to do the paperwork and I won’t be getting anything.

    @@cencoast_7.340 SDI is state disability from EDD and you will need to tell your dr that you will be filling for SDI because wc stop paying you. As long as u r being treated by the dr and u r not able to go to work they have to fill the forms for you. All u have to do is let them the dr know and u have to get the SDI papers from the EDD OFFICE or sometimes the drs have them they will charge u may be $25 to fill n then u input your info n send them. But make sure you have SDI account created on edd website. It does take time for SDI to be approved but keep logging in and check for emails on edd account. Always keep receipt when sending to the forms to edd office I usually send certified mail. My case is after my QME they offered me almost no money probably can’t even buy a salvage car because I don’t have a lawyer. But if my SDI runs out n if I’m still under dr care I will apply for ssdi from social security.

    I’m from chicago & I work in law enforcement. I was attacked by an arrestee april 20. I was fingerprinting the prisoner & he sucker punch me. I suffered a broken upper jaw, missing front tooth, my upper lip was split in half & my teeth next to my front tooth that was knocked out was knocked out of alignment. After I was attacked I put my front tooth in the garbage can & I proceeded to take the offender down while my partner stood by & watch. I was told by the dentist that even though I put my tooth in my pocket I’ll probably lose it. I told them to put it back in my head which they did after stitching my lip back together. The attack was caught on video. What do you think I should do? So, far Workmanscomp has spent $26,000. I was told I’m probably gonna need implants. 2 to be exact…

    If you were working in Chicago when this happened, I won’t be able to give you any advice as each state has different workers’ compensation laws and I am only licensed in Florida.     What compensation did you receive in the end? I’m researching for a similar situation, my fiancé is an officer in Chicago and got injured on the job. Trying to figure out what he should be getting in comp and if he should settle

    Good morning I have a Trumatic brain injury and Now they wanted me to do a job search then the lawyer called me and asked me do I wanna have a lump sum settlement also I am on Social Security disability so I destroy still quite explain anything to me this is what insurance New York State fun insurance off of me as they doing at work search so I really don’t understand what’s going on on

    But say if someone had a lung injury that was work related, wouldn't they have to settle after they reach MMI for so many weeks of payments?

    If you are talking about a Florida workers’ compensation case, you never HAVE TO settle your case. When you reach MMI, your doctor will indicate whether you have a permanent impairment rating or not. If you have a permanent impairment rating above a 0%, you will be entitled to a certain number of weeks of what we call impairment income benefits. However, that isn’t a settlement. Those are benefits you are entitled to because of your permanent impairment rating.

    @@LawOfficeOfBrianDTadros yeah I'm in nys and things are different up here. I believe the way it works up here is that if someone has lung disease or asthma or such. It's a non schedule workers compensation claim. But it goes by impairment rating the worse you are the more weeks you get 2/3 your pay only. But I believe that when those weeks are done you are done. I don't think they offer a separate settlement on top of that

    So I've been out since Feb of 2020. Had to get my back fused and a new left hip as a result of working injured and favoring a side. I often had to be able to lift 50-100 lbs and sometimes in akward positions. The WC insurance denied my claim and is still denying it. My court hearing was canceled and I can't get any info as to why from my attorney. I don't blame it on my employer as that is why they have to get Worker's Comp insurance. But I understand their (WC) job is to deny, deny at almost all costs. I've been going through all of this for over a year so far. I don't think I'm going to get anything and I live in California.

    I feel your frustration, sptt. I'm sorry to hear that you're getting the run around on your Workers' Comp claim. Well, the good news for me now is at least I got SSDI and LTD for now. Staying on it I hear is another thing :) Best Wishes!

    In FL, settlement of a workers’ comp claim typically requires you to sign what we call a General Release which usually states you give up your right to ever work for the company again.

    So...what happened if I accepted agreement advise settlement from my lawyer and they promise you" as soon as you resign your job you will recieved immediately an advance check" And the next check or final one you will recieved from 6- 8 weeks ( final check ) And you never received Or still waiting the promise ( fake promise) ? Where do I complain and why this happen I'm not happy with my counsel in my case. And NOW you LOST JOB You are HURT And NOBODY response to you!!!

    I can only speak to what would happen in Florida. In Florida, you could refuse to sign the settlement documents which would result in the insurance company’s attorney filing a Motion to Enforce the settlement agreement. You would attend a hearing on that motion and present testimony that you did not give your attorney authority to accept the settlement. The Judge presiding over your case would listen to testimony and decide whether you have your attorney permission to settle the case or not.

    My husbands lawyer is noooo good at all. My husband had a head on collision in a big gas tank transfer truck. His attorney hasn’t even talked to him about what to expect about cost or hasn’t told him what to expect for his comp claim.

    @@LawOfficeOfBrianDTadros No sir it was in Missouri. His lawyer has many lawyers under him and all he does is have a bunch of lawyers under him. He has never told my husband what to expect, from money reimbursement or the fact that he’s had to find his own doctor and the doctor has found his issue after the workman’s comp doctor just dropped him like a hot potato. He told him that he couldn’t find anything on our last visit, walked out of the office on us and BAM…..workman’s comp quit paying, my husband is messed up and we have been put in a bind. Thankfully after so, so many weeks without working his boss gave him an easier job but we’re not making the same amount of money bc it’s light duty. The attorney was supposed to be going after workman’s comp for him to make sure that they found his problem and fixed it…that’s all we wanted and our complete losses covered. He kept calling his attorney but he would never meet with him. His secretary would sometimes respond with an email about NOTHING that answered our questions or that would take care of the situation. My husband had some lower back arthritis before and had minor problems but he was able to drive the gas truck that delivers to the stations. Now he has big problems and he can’t lift the the same hoses bc they are 85 pounds. He is in constant pain and humps over a bit when walking. You would think he was very old. There’s so many issues that we’ve had and no decent attorney. Last week the workman’s comp wanted to make a settlement of a small amount. It was nothing financially completely covering everything but his lawyer suggests him to take it, through a letter of course. We’re still trying to get help for whatever is messed up in his neck and back. The lawyer is trying to make quick, easy, and fast money without having to lift a finger. His part is 35% which would not cover half of our loss. PLUS we are still trying to find the exact problem and fix it. Don’t even let me start on the workman’s comp lawyer……… Thank you for all of your information.

    Workers compilations has been terrible for me it took yrs for me to get medical help my attorney sucked had to get another lawyer his boss I was pulled into a machine my face and my arm was burned I have nerve damage PTSD depression anxiety and my job went in on me until I was placed on disability I now depend on SSI and disability and medical from job and family service my life turned up side down worker’s compensation was supposed to help people I thought

    I’m sorry to hear what you’ve been through both with your injuries and your attorney. The Florida workers’ compensation system is designed to provide benefits to injured workers but it is a limited system and when an insurance company doesn’t do what they’re supposed to, that’s when attorneys need to be involved. The comp system only provides medical and lost wage benefits. Sadly, there is no ability to obtain anything for pain and suffering or loss of enjoyment of life. Hang in there.
