So there’s this girl who bullied and harassed me last year. I sent her a fake screen recording of a message that I got from my friend that said that she was saying a bunch of mean things about me. It was fake and I made it up but now she said she’s gonna go to court. The school kicked her off my bus but she got on and followed me even though the school told her not to. Am I going to get in trouble for slandering her name? She’s made my depression worse.

I had things said on the radio. I have been monitored by police and before I go anywhere, they talk to staff about me. I have been harrassed, etc. I called lawyers I have no warrants, no previous records. I said I have no problem going to court. It's ongoing.

A lot of people defame because they confuse their sick morbid wishes for someone with reality.

Might be interesting for you to do a video on the distinction between _“litigation privilege”_ (say pretty much anything) and *California Rules of Professional Conduct 3.3* “candor towards the tribunal.“

Steve Vondran On the surface, it seems like the latitude afforded attorneys under _litigation privilege_ is at odds with _candor towards the tribunal._ I recall Casey Anthony’s attorney laying out the most atrocious accusations about her father in her defense, but I don’t recall if he ever had to prove any of those accusations (or even trying to). That was Florida, of course, but I’ve seen pleadings in California by attorneys that come out with provocative accusations with just the inkling of truth to support them.

Someone owes me money and was not willing to pay, so I published our convo related to the money on Facebook to warn people about her, cause she's currently asking people for money for refugees in Haiti. She threatened to take me to court.

Hi attorney Steve. I’ve been helping my brother with filing motions in his child custody case. His soon to be ex-wife filed a restraining order on me. In the purr documents she listed that I have felonies. Which I don’t. My question is, is that restraining order court document enough evidence and reason for me to sue her? The damages are to paint me as a horrible person that is unfit to help my disabled brother raise his daughter.

When you go into some place (in my case neighbourhood, city, every store,every shop in town ,hair dresser,beauty salon,Caffee,Bank,Post,.) and as you enter suddenly People receive Phone calls and then acting strange towards You,hurting You in worst possible way,when not imidiately, then when You visit that place second time,and You don't know how to act, because You "just know",that not everyone received same "information" about You , but information that is working in particular case in that place in that Purpose for destroying me in that place....😐And You know that those Gossipers are People with Narcissistic traits who are envious and jelous of You because of something that " they" find better by You then by them...😦

Just had someone sue me for defamation in small claims court. I represented myself. I wrote her an honest review about my interaction with the business. I stuck to he facts and used every defense in this video. The JUDGE seemed to take her side and and say “why did you write her a review if you never been to her business” “no one should be writing reviews” Like WHAT?? What JUDGE would say such a thing? The review was my HONEST OPINION! There hasn’t been a judgement made but I am afraid it will be in her favor.

Hey Steve, I wanted to get clarification on the statute of limitations. I’m writing a book and there are instances in the book that may raise causes of concern when it comes to the libel law. Once published, the party (plaintiff) that disagrees with my writing has one year from the publication date to take me to court is what I gathered from your video. Then, after one year any allegations will be considered null and void. I am in California. Are there any nuances or loop holes in which the plaintiff can still take me to court? I don’t want to give too much private information out in public, but there are events in my book that I have endured that includes certain actions done by individuals that can argue that what I say is false. So if the 1 year SOL under California protects me, are there any loopholes in which these individuals can come after me?

I don't often say this on my channel, but it sounds like you need legal advice. Statutes of limitation can be tricky and can be TOLLED under certain circumstances. I offer low cost paid consultations, or other lawyers do as well. SV

"No Publication"? Not so sure about that one. If I say something slanderous to a third party (but I don't publish it) it's still defamation.

Hello, let's say in this hypothetical scenario that I get sue for defamation but I'm too poor to hire an attorney to write response statements every time. Can I just ask the attorney to write a 1 time request to the court explain my situation and request a trial to prove my points. Would this be an option?

Unfortunately, there is a process you need to follow. Judges may give leeway to pro se but generally speaking, this may not be the complete solution you are looking for.

What if a supervisor lied about something you didnt do that lined up in the handbook in violations with no witnesses no video audio of photographs documentations their story keeps changing snowballing is what its called trying to keep up with their lies with a written statement contradicting his verbal yet recorded testimony is there a case here with the damages of losing ones lively hood their job from the written statement and slander that prevents or makes getting another job constantly harder as it would normally would be

Is it a triable case when someone sues one individual for defamation over another individual’s writings? And to be clear, the information published was not sourced or under the direction of the individual being sued.

Judge usually lets people know if there is a triable case.

What if I as the plaintiff can not prove that I did not do the actions the defendant is stating I did. EG. My ex GF is stating publicly to all (and on Facebook) that I am hacking her phones and computers she even got a guy to show up at my house and attack me based on this false information(he was arrested it was all on video) I can not prove a negative. In other words I can not prove I did not hack anyone(I did nothing at all). I am an IT professional so these claims violate my working relationships with my clients. Is there a legal method where she has to prove her claims? The reality is she is very angry because of who I ended up being close with after the breakup but that doesn't get people mad at me so she is fabricating the hacking as she knows it will damage my career.

How do you prove their claims are false? If someone is telling my employer that I committed a crime, do they have to provide proof, or do I have to provide proof of my innocence?

I'm being sued for defamation for someone else's blog. I'm being wrongfully accused. I can't afford a lawyer because I'm low-income and recovering from multiple surgeries. It seems impossible to get help. Can someone with money just sue someone else without money and get away with it?

Anyone who wants to become a truly effective activist who actually accomplishes helpful things in society should be careful of the nasty harassment tactics that corrupt big money can use. Mostly this includes serious defamation, but it can be far worse than simply claiming the activist is a child molester. Many of the tactics we now see being used by paid harassers appear to have come directly from the CIA, and they are quite nasty. Those harassment tactics usually involve trying to make the activist look crazy. One simple method that the big money can use is to hire a hacker to compromise the activists computer, and then send out crazy emails to all his friends. The result can be that less and less people speak to that activist anymore, since they figure he’s losing his mind. In the old days, a similar tactic involved a harasser obtaining for example, the business stationary of the activist and then typing up some crazy letter and forging his signature, then mailing that letter to A friend of the activist or a business associate. Upon reading the nutty letter, that businessman simply cuts off all ties with that activist because he thinks the activist had sent that nutty letter, when in fact the activist did not, and doesn’t even know it was sent. Nowadays with the Internet, it is much easier to pretend to be someone else and then send out dozens of highly inflammatory, completely crazy emails from the activists computer, where his friends and business associates receive them and then begin to cut off ties, again because they think the activist has lost his mind. A common harassment tactic, utilized win big money is put out to suppress an activist, is for the paid harassers to get on the Internet pretending to be that activist, and then making extremely derogatory anti-Semitic comments. If the money is big enough, we are perhaps more than $500 is being spent, it’s not hard to find somebody who lives near the activist in real life to go make friends with him, and then get his fingerprints on a blank piece of paper, Then use that paper to print out some highly anti-Semitic article. The activist’s signature can simply be photocopied from an existing document he actually did sign, and then printing it on the anti-Semitic article which utilized the paper he has his fingerprints on. These are actually not hard tactics for an experienced harasser to engage in, And in this post we need not even begin to go into the miss use of telephones combined with audio clips of other peoples voices. Mainly this is done not just to make a person look crazy, but to drive a person crazy. Certain members of the lawn Forssman who investigate this form of highly subversive harassment can themselves become so confused or depressed, that they resign and go on disability for depression. This can and must be countered if our nation is to continue to be a first class nation. New laws are needed to prevent this type of harassment of law abiding activists who are not racist or hateful in the slightest. There are certainly ways to counter these subversive harassment tactics. Father sues then in 2011 SCOTUS ruled first amendment protection for the group in a 8-1 decision with scalia desenting saying this is not what the first amendment was written to protect

A lawsuit is awarded to the plaintiff without the defendants knowledge. The judge grants the plaintiff to take their websites and attorney states the granted lawsuit. Defendant finds out there was a lawsuit by their site being taken from the defendants attorney. Defendant appeals the case and the case gets dropped. Plaintiff refuses to give back website and continues leave false information on the websites ruining the business. It has been many years past. What can the person do to have the false information removed when the attorney refuses to give back the websites.

I had a client at my firm that was about 15 years late in filing his defamation lawsuit. Pretty unfortunate, because he had a great case otherwise.

I went to the Branch Manager with a claim that Im being harassed my supervisor sent me home because he thought I was stressing out when I said no he told me to do what he said. I told him I feel good mentally and physically the next day I get accused of contaminating a tank? I said no because I won't be manipulated. I'm not giving my rights to please theirs. I haven't done nothing. I got evidence and I show it Branch Manager denies that my evidence is not enough n I show her my name was on the graph sheets.. I get an email in which she makes me look bad because I got evidence n all I'm doing is bringing my claim about I'm being harassed and she attacks me with it and she CC someone on the email that seems me bad because she's part of this negligence for not investigating I was demoted and she's protecting this individuals who act like a mob..

I am being sued because I got child support raised but the baby mama claims I defamed her character that is all over Facebook guns, gangs and drugs. I got three cases to file but I am only gonna file two for now I went to a restaurant and ate gave out my card and at some point I asked for something that was not on the menu and they stated calling me non stop and did thousands of reviews on my business with ever shopping at my store. I had a lawyer want me to give him $1,500 for him to get the paper. It seems like he’s possibly agreeing and knows that someone called me mentally ill and won’t cooperate. Cause it’s irrelevant since I wasn’t yelling, but I was harassed after the accusations. Someone told me that he hopes that I get run over by a car.

In your description, you forgot the word “unprivileged”. Some defamation is privileged. It’s literally called the litigation privilege.

Good eye. In California the elements of Defamation, which consists of both libel and slander, is defined by case law and statute in California. See Cal. Civ. Code §§ 44, 45a, and 46. The elements of a defamation claim are: (1publication of a statement of fact (2) that is false, (3) unprivileged, (4) has a natural tendency to injure or which causes "special damage," and (5) the defendant's fault in publishing the statement amounted to at least negligence.

Hello Steve. I will upload an abuse story on my channel soon and what I said in it are 100% accurate. The thing is I will show: a screenshot of an Instagrammer slut-shaming me (with her username showing), the abuser’s full name and where they’re from (e.g Atlanta, GA & not full address). Can I still get sued for defamation? Keep in mind the abuser’s family members/friends were BYSTANDERS of him being an abuser to me. If they were to sue me for my YT video, would they ask the abuser’s family member/friends to be witnesses & say what happened?

@@attorneysteve I've been looking for an analysis from a legal expert on what exactly the Dominion defamation lawsuits entail. Is this something you as an attorney are allowed to speculate on? I am watching this video 15 Defamation Defenses to learn what I can, and it is helping put a few things into context, but not all.

What is the cost for for help to line me up to open a civil case in court against a white man from 2050 for personal abuses and discrimination , retaliation , wrongful termination and a sexual intimidation 🫵🏻?
