As an adult he has to take responsibility for his actions; there is a limit to what can or ought to be excused-he overstepped that limit. And it is about time somebody paid the lawful consequences for abusing an auditor-they have been woefully denied police assistance. Even in this instance, Hudson was doing his best to evade the issue of an offence having been committed. Well done to TLA-showed the way with this one.

You are half right. The security guy was a liability because he didn't know how to do his job. What he should have done to be compliant with the law was to tell TLA he was trespassing and then to physically remove him from the premises using reasonable force in the circumstances when TLA didn't go under his own volition. Instead he flapped his gums and said a bunch of stupid and worthless things. You should note that some of the things TLA said could be used against him in court by even a rubbish barrister to undermine him and make him look guilty. There's no great victory for anyone here.

As it was a publicly accessible area, he would not have been trespassing during the publicly advertised opening hours, if he refused to leave after the closing time, he would be trespassing. If he stayed all day filming I guess there could be a case for harassment, but harassment can't be for a few minutes of using a public building.

@@timsaint835 No bro, you are not understanding the law. You don't get to tell the owner or their agent/s the score. If they decide they want you off site they just have to tell you that you are trespassing or words to that effect. If they don't want you photographing or filming they are fully within their legal rights to tell you to stop doing it or to leave. You have no say in it. If you want to make something of it after they have removed you then your options are to try to make out some claim through the county court (and good luck with that) or to suck it up and get over yourself.

Blind justice and Mike keel, you are right if it's private property, but this was in a public building I think. It would be discrimination against someone under article 10 of the Human Rights Act 1998 to just ask someone to leave a publicly accessible space for filming. If they were going up to people and causing alarm or distress then fine. Also if force was used then it would have to be proportionate to the "offence" committed. Just general filming would not warrant force in my opinion, following someone round filming them could warrant force from security if someone was alarmed or distressed by it. I'm not an expert in the law but this is my understanding. Open to be challenged though.

Imagine flipping out like that over absolutely nothing and getting yourself fired. And he's wrong about the section 5 thing. And repeated threats of violence he should have been locked up there and then. The whole POINT of verbal threats classing as common assault is that the police can deal with the person making the threat, and not the subsequent defensive violence that threats MUST be met with. As in, in the abseoce of a police force, if someone threatens violence against me I must immediately meet that threat with violence to end the threat. This is *what the police are for!* If they don't do this job, they're essentially useless - in essence, they serve no purpose.

The purpose of the Police was lost by them a long time ago. They are generally a self-serving drain on the public purse most of the time and have started behaving more like political storm troopers and an elite in society. The Peelian principles need re-affirming in a forceful manner to return to a useful and worthwhile Police force rather than little more than a reason to suck cash out of the council tax to service Police pensions.

IMO, that nasty guy deserved to lose his job, it was all of his own doing and completely unnecessary behaviour. You can't go around mistreating members of the public. Actions have consequences, it's wise to learn that earlier on in life ( he's now learnt that to his detriment). Perhaps, he'll think twice now about his conduct going forward (but, I wouldn't hold out any hope of him amending his ways, just because he lost his job). TLA, this update is a respectable outcome, given the circumstances. Some people lose their own jobs due to their own misconduct, I wouldn't feel in the slightest bit remorseful of the fact the man lost his job, he did it to himself. He'd have carried on mistreating people, if it hadn't have been for that audit.

The irony is that if the security guy had been competent he could have simply told TLA he was trespassing and then he could have used reasonable force in the circumstances to remove TLA. Instead he flapped his gums and talked himself into a tiny hand slap from the bacon. Community resolution is the lowest level of response bar doing nothing at all.

  • @DamnedIntrovert

@@blindjusticeandcommonsense2786 I'm under the impression that the community response route was TLA's preferrence over the guy being taken to court. I dare say, that the Police may have offered 'advice' that it was probably the most civil response to the situation, given that the man had already lost his job over his misconduct. A case of taking the moral high road, if you will.

@@DamnedIntrovert Beware the bacon trying to pull the wool over your eyes. If the bacon thought it was serious and if they thought they could score an easy conviction they would have rushed to charge the guy. That's how they function. They build cases. They seek convictions. Offering community resolution is mugging both sides off and avoiding either a loss or a humiliation. Game the situation like a barrister would. TLA has made a complaint. The police have talked to or interviewed the guy under caution. And the guy has flapped his gums and 'admitted' saying what everyone can hear on the video anyway. Does that mean the guy is in the wrong and has committed an offence? Could a competent solicitor or barrister drive a coach and horses through it and put all the blame on TLA? If they could (and yes, they could) then the police have nothing. But they can con the guy into writing a letter as 'community resolution' and put some BS on his file. Sucks to be him. He should have told them to get stuffed. And if he had been even remotely competent at his job he would have told TLA he was trespassing and then physically removed him using reasonable force in the circumstances whilst keeping his mouth shut. Then he would have been acting entirely lawfully. The whole thing is a farce. All the actors involved are in the wrong or incompetent in various ways.

I know the guard was incredibly rude but the response that came from the "lady" was just about the most common and revolting piece of female behaviour ive seen in an extremely long time. I'd be embarrassed to even be near a "lady" that spoke in that way!!!

It’s a shame someone had to lose their job but they had every opportunity to be a decent human being and not act criminally. Good on you for agreeing to the community resolution. You’re 10x the man he is but then again, that’s not a vet high bar 😄

" Relieved " of his duties, DOES not mean that he has been sacked, he will be removed to some far out of harms way place, like the Bahamas.

If the original incident is not the week leading up to National Police Memorial Day then Sgt Hodson is not following the same code as the Met. I wonder if the Hertfordshire Constabulary have a different dress code that allows the TBL badge all year round? I can't find their dress code online.
