TikTok files lawsuit calling potential US ban ‘unconstitutional’

TikTok is suing the U.S. government over its efforts to ban the social media app if its parent company ByteDance doesn’t sell the social media platform in the next year. TikTok lawyers say it’s a violation of the First Amendment. NBC’s Savannah Sellers reports for TODAY.

    Props on them for actually respecting our constitution. If foreign governments respect our constitution more than we do, does that mean we're occupied by our own government?

    The USA has to introduce legislation that creates a classification called “Hostile Nation”. For hostile nations WTO rules would not apply and companies from a hostile nation would not have a legal standing in the USA. For example they could not sue the USA government for actions taken by the usa to protect the USA from a hostile nation

    Storing US data in China is a no-go. The owner of TikTok, being under Chinese jurisdiction, isn't bound by the First Amendment. China's communist regime doesn't uphold principles like freedom of speech. Only US citizens enjoy First Amendment protections. If non-citizens mishandle data, they could face charges like data theft, security breaches, or even economic espionage-especially concerning videos hosted on overseas servers that might pose risks to US interests. This necessitates intervention from Homeland Security, FBI, and SEC. The owner should've been mindful of Apple's End User License Agreement before distributing the app. Options include selling the company, being ousted by US executives (shareholders), or facing legal consequences, possibly avoiding jail time by selling the company. 🤷‍♂🤷 Duno.. The owner of TikTok is absolutely terrified of selling the company to the US. Returning to China could mean facing jail time, and selling to a US entity poses similar risks.
