Three Black men accuse SFPD of racial profiling while shopping at Union Square

Three friends who were shopping at Saks Fifth Avenue in San Francisco accuse SFPD of racial profiling. Police say one of them matched the description of someone who brandished a firearm. They were detained for hours, say they were compliant and cleared of any wrongdoing. Police say their response was appropriate

    The individual who made the call is the one that committed the offense! Yet, the three black men were detained by police and taunted by the caller! The police should have arrested the call, yet they let him walk. They should sue the police and the individual that they refused to arrest. The police and caller ARE on the same team!

    It should not have taken 2 hours to determine what was really going on Cops were just trying to find a reason to arrest these young men because they were African Americans. YEAH SUE THEM AND THE PERSON who called and made the false statement about one of them having a gun and COPS found no GUN . This is harrassment by the police held for 2 hours humiliated and embarrassed as people walk by and see them handcuffed on the floor. SUE

    I immediately got the feeling that someone saw them shopping, called the police on them, lied & said they have guns, hoping that the police would do something to them . And it probably was a prejudice and/or racist person . It's some mean, nasty, & evil people in this world .

    @@jetjazzdauntless218Qualified Immunity is a governmental inherent doctrine to protect "the government". It is a state legislation issue to dismiss it or what like in Colorado. The problem is, it's a judge's discretion if qualified immunity should be applied.

    @@jetjazzdauntless218 I'm saying that it will take state legislation to get rid of it or some parts of it. The doctrine of qualified immunity was created by the federal government and passed down to all "governments" and their agencies. As for now, in order for it not to be applied to these cases, it's up to a judge's discretion. Usually a state court judge in criminal court, where these cases usually begin. And then the appeals are made to the federal court for civil violations.

    That video showed him cuffed on the floor (not ground) for less than half a minute. How did you conclude he sat there cuffed on the floor for two hours? Do you think maybe the Saks manager offered a private room or office so that other customers could resume shopping? Do you think its possible they uncuffed him shortly after the video. If was the manager at Saks I wouldn't let that public display go one any longer than necessary.

    It doesn't take 2 hours to investigate brandishing a firearms. an initial 15-minute investigation as simple as going back to the cameras inside the store. Make sure to not only sue the store make sure you sue the San Francisco Police make sure you young men do a thorough investigation to locate the person who intaily called in the false report and sue them civically in court

    It does NOT require 2+ hours to verify whether the detained gentlemen possessed a firearm. The detention became unlawful once the potential threat was cleared. That required no more than 15 minutes at most. Law enforcement has a duty to assess the situation independently and not rely solely on an unverified report from an anonymous caller. That is not to say they should not respond-they should and do. But they are not legally empowered to use unverified evidence alone to effect a detention (that legally became an unlawful arrest, so yes, they have solid grounds for a lawsuit). This propensity to rely on “officer safety” as the sole defense for grossly inappropriate, lazy actions must stop. As a former 12 year federal prosecutor this would not have been tolerated in any case crossing my desk, none that would’ve been prosecuted, that’s for certain. First of all, did they attempt to even verify the men’s identity with any store employee or manager before drawing their firearms and handcuffing them? Bottom line, police aren’t permitted to shirk their basic investigatory duties and violate civil liberties of innocent citizens based solely on the word of racist, lunatic callers. In the military (25 years of service and counting here), it’s expected to trust but verify. It’s the same in law enforcement. Basic human rights do NOT take a back seat to officer convenience and expedience.

    Not saying you are wrong, but this "two hours" is only one side of the story. If a civil suit occurs we will hear from the police and store employees and security tapes about the time frame and how long this guy was in cuffs. There's a lot of unpacking to do.

    I understand fully. I feel that I too was racially profiled at Safeway/Albertsons for shoplifting. I was working, shopping for Instacart. Two Denver policemen jumped to conclusions after a White manager asked them to interrogate me for shoplifting that I did not do. I filed a complain with Safeway corporate, Denver Police Department, and with the state civil rights division. We as Black people must do the work, documenting, filing complaints and taking legal action against this BS. They keep doing it because we brush ' ish off too damn easily. Kevy Michaels.

    One of the big problems I have is it look like they left them there for over two hours, then they made them stand up with the handcuffs on and took pictures of them. Why did they go through their wallet and run their ID for warrant when they did not see a gun? This is about as disgusting and abusive as you’re going to find.

    There is no "THEM!" The false call alleged that there was a person brandishing a firearm! Even if it were true that would NOT be a "THEM!" That would be a single PERSON not THREE! You don't get to arrest EVERYBODY who's black even if *"A"* person is doing something! This was clearly racial profiling! It is standard procedure to ask the color to identify the suspect and what HE is wearing! But these loser cops treated all three of them like suspects why? Because all three of them are black! I can assure you even if one BLACK guy was with two other WHITE guys and there was a report on HIM brandishing a firearm that ONE black guy is the ONLY guy that would have been handcuffed and detained and not him AND his two white friends!

    @ Michael Kivler You saw a guy handcuffed for 25 seconds and automatically assumed he was left handcuffed on the sales floor for two hours. Maybe he was, but maybe store management had police take them to a secure office ASAP where the handcuffs were removed. Management doesn't want an unpleasant scene in the middle of their sales floor for any longer than necessary. When you don't know the details, at least think about some logical possibilities instead of jumping on your keyboard talking bull.

    I think that is called "swatting". It's when someone calls the police and makes up a false disparaging accusation about an innocent person. When the police come, that innocent person is treated with brutality or maybe even killed within minutes of their arrival, which in turn satisfies the caller's desire to see a black man die behind the "weaponized" response of the police. This is wickedness at its finest.

    It just happened to me as a Black LesbianTODAY in union square. I walked into Macy's held the door for.a woman coming out. She happend to be staff & assumed I was homeless so signaled security to follow me around the store the entire time I shopped. he even took a photo of me while I was exiting. Last time I was in Saks I was harassed just for looking at shoes.

    Failed to properly assess and held for and unreasonable amount of time once it was discovered there were no weapons involved. The man making the report should be charged with obstruction, making false 911 call, disorderly conduct and reckless endangerment. The innocent young men could have been shot and killed

    I walked into Bloomingdales just to see what the Hype was about, and people were looking at me and following me around like I was thief. It was actually the first time I've ever walked into that store in my entire life. I really hate when they do that. I had to pull out over $200 cash just to show a worker at Whole foods that I could affordable the $10 worth of fruit I was purchasing. She kept paving behind me, looking over my shoulder just to ensure that I paid for everything. It's sad how after I pulled my money out, she stayed back with her mouth agape. I really hate this shit. It's so degrading and annoying. I am becoming increasingly angry by their judgements. I really am. And they can act like they are above angry outburst if they want. I might be liable to lay hands on someone for disrespecting me in this way. It's becoming so tiresome.

    I'm an average sized, slim Mexican, it happened to me at my own home when I used to live in a neighborhood with a 95% white population. Black neighbor called the police because her Black, tall, fat ex was banging on her door with a gun. The neighbor apologized to me and told me what she told 911. It did not match anything that the police said. I moved out of the neighborhood. Took me years to get over the paranoia of police pointing their guns at me and threatening to shoot. First week I moved to a diverse neighborhood, I accidently bumped into an officer walking around a wall corner, I didn't see him, he was with his gun out, he was looking for a Mexican suspect with a weapon. He apologized and continued doing his job.

You need to assess the situation when you arrive and you can't base you decisions on biases. The call was about a man with a gun. They should have cleared them immediately when no gun was found.

    People should stop calling this "police misconduct" or "excessive force" and start calling it what it is: Violent Crime.     I think if a caller is confident enough in their sight to know they saw a pistol and call the police they should be confident enough to not hide behind anonymity. Furthermore what happen to the right to face our accuser ? Or the right that if being lawfully detained whatever investigation while detailed should be within a reasonable time two hours handcuffed on the floor for the first five minutes to figure out no one had a weapon ?     I was cuffed in front of thousands of people driving by but then let go when the cops figured out I wasn't their guy. It was humiliating and I wasn't given much of an apology but it wasn't the end of the world, either. Btw, I'm Caucasian and so were the cops.

    Also that caller who put these men in jeopardy need to have consequences. This system is so obviously broken. Any person can call police on you and anything they say is treated as fact to the very end. Even when proven not to be true by the officers themselves. Hate is ugly. Distain is ugly. This department is ugly. Get them out!!!!!
