    Getting rid of qualified immunity would just make it easier to sue, it wouldn't stop cities from indemnifying the sued cop and paying the lawsuit, which the city does in literally 99% of cases according to a new study by Chapman College

If cops knew that their pension or their pay Was on the line the next time they approached a citizen with bullshit they wouldn't do it. Remember this was allegedly over some loud music, There was no crime. And after the stop was over they continued the stop which the Supreme Court had ruled you can't do. Do you think officers would still do this if they knew their Pensions were on the line?🤔

If they injured you or delete you, or violated your rights in anyway, that said cop will be broke, in jail, and taught a lesson. In AZ there are quite a few counties that have ended qualified immunity. Guess what no lawsuits against the departments, less escalation from cops. Why? They know they can get f*cked, from their actions. You're correct

    That chief is putting every single other officer under his command in danger with this too. The cya charges, the blatant illegality being supported...all of that is indirectly incentivizing the citizens to fight rather than risk detention, and to view his PD with gutter contempt. It's not even a novel concept, we just saw NYC cops go through this in as public a manner as is possible.

    There are even stupid laws if you drop dead and i try to rescue you for example with chect compressions , you can sue me for medical bills for broken bones... I mean WTF? One reason for me to never visit your country as tourist is laws like that. And the awful behaviour of some cops that are not doing their jobs to serve and protect the public. Those cops should use the logo 'Out there to piss off the public with vile behaviour' instead. The way a lot of cops in the states interact with the public *shouting i am the law types where you can't argue with. i will avoid that as the plaque. I can't carry guns so have no freedom you say? Wrong it's just highly regulated in order to get a gun licence i will need to show a) need it for work b) want it for sport in the later case i can't have previous jail time sentenses , can't have catched certain fines like the ones too light for jail but still involving violent behaviour. Then i need to make 2 locker compartment where bullits and gun are hold seperate and they must be kid proof... And police will come once a year at random times to check and you must let them enter. Can't have undergone mental problems and can't use certain substances. It's highly regulated. Then again i still can trust police here because they fall under the same rule and their police academy takes 3 years minimum and they don't have any immunity.

    He wasn't constitutionally required to give them any information at all. This is a clear 4th amendment violation and he needs to file a civil lawsuit immediately against the police department not the police officers may get qualified immunity although they are clearly guilty of brutality and excessive force.

    Not a bootlicker, I just checked Arkansas, unfortunately you do have to show ID, regardless if you're driving or not. At the minimum the State requires that you say your name, if you have no id.

    Obey and complain later??? File a complaint that is never followed up on. In Utah there are more than 155K complaints filed every year against officers and less than 200 complaints are investigated. This chief is the reason nobody has any respect for criminals with badges.

    This is pretty much it. People always say "just obey just comply file a lawsuit" but what they don't stop to think about is obeying and complying can result in charges and jail time even if you have a clean record and you don't do anything other than lick boots... then you gotta go hire a lawyer and 99% of the time at the local level where the cop, the da, and the judge are all buddies... you lose. You can guess what I would do if I were there.

    Maybe police wouldn't have people around so much that they can be done up on if they change the signs on the side of their car from " To serve and protect".... To something more appropriate or more correct and that would be " Two seventy protect our own"..... If anybody likes these ideas that I'm putting forth. And of course, I put these in my own opinion. But if you like it, please share. Let everybody else know what they should be doing. And maybe police will realize that it's not this public's job to help them in any way shape and form.

    Individual LEO's never pay for lawsuits (judgements or settlements). Even if you get past Qualified Immunity they still have indemnity.     Well it wasn’t implemented for what it’s being used for today. Its a prime example of why you can’t give an inch to the government. It’s shocking that people can’t see that we’re dealing with a tyrannical Government that are only being held off by the Supreme Court. Once the Democrats get there people in the Supreme Court or there’s an issue that the parties come together on then thats it. There going after the 1st & 2nd Amendment hard and eventually they will sneak something through worded so that it gives them the power to move us into the Democracy they want so badly where they aren’t bound by any Constitution. It will all exist in name only and it will be the we’re not taking away the 1st or 2nd amendment we are just taking X from criminals for your safety. We are not taking away anyone’s first amendment we are just getting rid of the disinformation that are for Russia.     If you happen to match a Be On the Lookout for or BOLO What do you think will happen if you refuse to ID yourself, they get to treat you like the BOLO they are looking for The police are allowed to have consensual encounters but if you ask them, “why are you asking me for my ID” and they refuse to give you an explanation and continue to demand it. It becomes a non consensual encounter and without probable cause they are violating the law and their department policies and they can lose their qualified immunity Then at that point if they arrest you and you have zero warrants it become a false arrest and they lose their qualified immunity. But remember every local justice system is a relationship of peers and you and I are not one of the peers

    Not only did the chief say comply now complain later about a person that complied, he doubles down and says everyone would be treated this way no matter the color of the person’s skin. The problem is nobody should be treated this way at all whatsoever. Dude complied even though there was no reason for the cops to attempt to identify the passengers. The cops ain’t making going home after the bars close on Sunday any safer. If the music was too loud they should’ve said, “Hey, could you turn down the music some until you’re out of the area. We might have to direct traffic and we want to make sure everyone can mostly hear us give directions to get everyone home safe and sound. (To the passengers) Thanks for coming out and making the good choice to have a sober driver. Take care, y’all!” That’s how you build good will with the community and show safety really is the priority

Nothing prevents you from making lawful arrests as a citizen even while already under arrest - if being under arrest prevented making arrests, mafia leaders could stop police from arresting them just by having people run up to them and arrest the cops.

    @@joefer5360 One of the fun things about how arrests work under US laws is that simply being informed you are under arrest is the entirety of the arrest. Being handcuffed, put in the back of a police car, body slams, tasing, and more, all of that is an optional add-on to the arrest. Think back to old war movies where an officer is told to confine himself to quarters and consider himself under arrest. No handcuffs, no armed guards, those are for dishonorable non-gentlemen. And the same is true of anyone being arrested - being handcuffed is a cop declaring that he doesn't trust you to respect the arrest unless restrained, it's NOT a required component of an arrest. You can make a 100% legally binding arrest with words alone, and a cop who laughs at you, jumps in his car and drives away is just as guilty of resisting arrest as you or I would be if our response to a cop pulling out handcuffs was to sprint away. Just saying the words is legally enough to cause cops SEVERE problems when a judge finds out. Being arrested by a cop for initiating a lawful arrest upon that cop, as a means to evade being arrested, is indisputably resisting arrest with violence.

    They claimed the music was "disorderly conduct," but you can hear music from the bars, which don't seem any quieter than what came from the car. Disorderly conduct is not a traffic infraction, so this wasn't by any standard a traffic stop. Since the accused disorderly conduct was the volume of the stereo, a back passenger can't possibly be deemed to be the cause of the noise, so can not be deemed a suspect. The cops had precisely _zero_ lawful authority to demand his ID. Add the fact that the officer admitted that he entered the wrong information, there is no proper standard by which force was justified. At first I didn't catch that the cop entered DOB from memory...that makes it ten times worse! "Encounters like these happen when the bars close down every Sunday morning." Well, thats a BIG effing problem! Everything the officers did was wrong! They demanded ID from a man they had no authority to make any demands of, one officer tried to remember a man's birthdate, and rather than acknowledging _he_ might have been wrong, he immediately initiated force. Rather than telling all of us to just comply, the chief should be fixing the problems in his department. This is the kind of chief who will completely ignore 99% of all founded complaints. I notice that there was no statement of a reprimand for the officer who "winged it" with the birthdate and was the one who initiated the unfounded arrest...just the one who unlawfully threatened arrest if Cedric didn't ID. The threat earned a reprimand, but unlawfully following through didn't...
