Don't know how it is in the US but under Common Law in the Commonwealth it is actually part of the contract and is 'his property' until such time as the wedding is completed, so not giving it back is theft to boot.

Edit: for everyone telling me that in Australia or wherever you are legally obligated to return the ring then I absolutely believe she should comply with the law.
