The Chevron Doctrine is what has given regulatory agencies like the ATF power to interpret laws and make rule changes designed to infringe on our rights. The courts have deferred to these agencies as the so-called experts, but it has created major problems. The ATF has used Chevron Deference to make things illegal without an act of Congress, which puts millions of law-abiding gun owners at risk of incarceration.     It doesn't, really, but they can be challenged now on the basis that the ATF didn't have the authority to make those rules and they should get overturned.

    I was investigated by the lovely ATF for having FRTs. Had to lawyer up and turn them in. I a a few others were specifically targeted. Not fun especially since they’re losing the case

    ⁠@@sawtoothtactical404if/when they lose the FRT case I’m told I’ll be reimbursed…not holding my breath. But after talks with the ATF field office, my lawyer said, if you don’t turn em in, they’re gonna come search and seize with a harsh legal penalty to boot. Sucks that they got rare breeds paperwork. Was a rough decision but I didn’t want to end up like CRS which my lawyer specifically mentioned. BS Indeed

    You really explained this well and it actually educated me on this! I’m hoping that moving forward our Supreme Court with its conservative majority will continue to side with us 2A supporters and also if something does go the way of Congress etc we continue to get favorable outcomes!!!!

    This isn't the first time. But they never tried this hard to make so many Americans into felons. Consider under George W. Bush, all those millions of AK buyers were suddenly in trouble because they declared surplus AK barrels as a machine gun part. They did exempt existing firearms but newly made AK's had to have US made barrels from then on. It didn't sl9w down sales as they hoped and many AK makers moved here. Similar with PSL, the Romanian marksman rifle. It was the standard Romanian military rifle but used the AK factory and the ATF used the welded over hole to ban them as machine guns. They came back but were difficult to find as was the Yugo M76, similar to the PSL but in 8mm and much stronger. There were others. AR'S were different but surpassed all back with Bush 41's import ban. That gave homebuilding a boost. But no, I expect like Heller they will resist.

    I think technically, they have to be legal with the ATF having to follow the actual law of what a machine gun is, but I'm sure they still pretend they're illegal...
