    South China Sea Dispute There has been a lot of articles South China Sea (SCS) dispute and China’s 9 Dash Line articles in recent time, with a majority of them twisting facts and trying to claim that China is bullying smaller countries with their growing military might when China is simply trying to reclaim what is rightfully theirs. In 1946 at the end of WW2 it was a US Navy battleship that took Chinese soldiers to reclaim all the islands that are currently under dispute in the SCS as China simply lacked capable ship at the time. Thus, the original R.O.C 11 Dash Line was drawn in 1947 after China recovered all the islands, the 11 Dash Line linked all the islands together to clearly mark China territorial waters which was at the time recognized by the American and international community. The 11 Dash Line was only reduced to the 9 Dash Line when China secretly transferred Bach Long Vi in the Gulf of Tonkin from China to Vietnam in 1957 so that the island could host a new radar base to provide an early warning of American planes and to serve as a transitional post for Vietnam incoming war aid material as the Vietnam War escalated. It was a goodwill and war aid material from China to support Vietnam against the US invasion. From this, we can tell how ungrateful and traitorous the Vietnamese are with their current aggressive stances toward China. Furthermore, all historical document sign by or involved any of the countries associated with the current disputes didn't lay any claim to any of the island involved in the current SCS dispute. For example: - In the 1898 Paris Treaty signed between America and Spain, both countries acknowledged that none of the disputed islands belong to the Philippines as the Philippines territory extends to the east of east meridian 118 while the dispute islands laid west of east Meridian 118. - In the 1945 Proclamation Defining Terms for Japanese Surrender contained the following statement: ‘’the Japanese sovereignty shall be limited to the islands of Honshu, Hokkaido, Kyushu, Shikoku, and such minor islands as we determine,” as had been announced in the Cairo Declaration in 1943; which clearly stated it didn't include Diaoyu Islands. In addition, the Cairo Declaration in 1943 also clearly stated all the territories Japan has stolen from the Chinese shall be restored to the Republic of China (that represented China at the time) and these documents were signed with Chinese participation. The American recognition of the 11 Dash Line lasted until San Francisco Conference in 1951 when the American specifically excluding China from the conference as the Communist Party in China-controlled most of mainland China at the time and proclaimed the establishment of the People's Republic of China in 1949. At the San Francisco Conference, the American made unilateral arrangement in an attempt to deny Chinese ownership of their islands that was previously international recognised belonging to China and put all these islands into a dispute. However, at the time no one including the current neighbouring claimants bothered to dispute China's claim to these islands and reefs, but China also did not have the ability to consistently enforce its sovereignty to these islands due to lack of military power and internal weakness caused by WW2 and the Civil War. Neighbouring states only started to violate China's claim, occupying certain islands and reefs when it was speculated that the South China Sea might contain oil and gas. For example: - During the San Francisco Treaty of 1951 in the absence of China and with the support of the American, the Philippine claim ownership of the disputed island, nevertheless the Philippine did not declare ownership of the disputed islands until late 1970 by self-proclamation. - The America took over the administrative duty of Diaoyu Islands at San Francisco Conference from China and promised to relay it to UN which they never did. The American kept the administrative rights until 1971 then transfer the administrative control of the islands to Japan at the opposition of China. - The rest of the disputed is laid according to the 1994 United Nation Convention of Law of the Sea (UNCLOS) 200 nautical mile EEZs which didn't come into existence until 47 years after the establishment of dash-lines and International laws generally don't have judicial to things which preceded it. Therefore it shouldn't be applied here in the first place. Once again all the dispute was supported by the American and the American even announced that “The United States has a national interest in freedom of navigation, open access to Asia's maritime commons, and respect for international law in the South China Sea”. The United States has also called for unfettered access to the area that China claims as its own, and accused Beijing of adopting an increasingly aggressive stance on the high seas. The American has also frequently sent warships into the disputed area on so call Freedom of Navigation Operations. Now if we look at historical evidence we can further assure China claims to these islands and the 9 or 11 Dash Line. Diaoyu Islands - China claimed the discovery and ownership of the islands from the 14th century and the first Chinese records of these islands date back to as early as the 15th century when they were referred as Diaoyu Dao. While the Japanese maintained ownership of the islands from 1895 until its surrender at the end of World War II which ownership should have been returned to China according to the Cairo Declaration. In the 1945 Proclamation Defining Terms for Japanese Surrender also contains this statement. Spratly and Paracel Islands - The earliest written record of the Spratly Islands can be found in documents dating from the Eastern Han Dynasty 25 AD and The earliest written record of the Paracel islands can be found in historical documents dating from the Song Dynasty 960 AD. The 1887 Chinese-Vietnamese Boundary convention signed between France and China after the Sino-French War states that China was the owner of the Spratly and Paracel islands. The Qing dynasty also sent naval forces on inspection tours in 1902 and 1907 and placed flags and markers on the islands. The Qing dynasty's successor state, the Republic of China, claimed the Spratly and Paracel islands under the jurisdiction of Hainan. The Japanese occupied the Paracels and the Spratlys from February 1939 to August 1945, which was handed back to the Republic of China at the end of WW2 according to the Cairo and Potsdam Declarations. In summary, all evidences support China 9 Dash Line historical and sovereignty claim in the South China Sea. However, it has been continuously undermined with the support of the US in their greed and ambition of controlling the world energy resources, world hegemony and containment of China’s rise. International laws and organizations such as the UN are just becoming tools for the US and are no longer performing the traditional roles that they were created for in the first place. If we use the same standard of argument used against China in the SCS then the international community need to do a lot more American occupation and military bases in Guam, Diego Garcia and other Pacific islands. Additionally information: A special thank to Gerald Tan US State Dept Chief of Spatial Geography and Boundary Analysis, Daniel Dzurek, who works as a professional geographer with distinction on this exact subject; from his book "The Spratly Islands dispute: Who's on First": "Because the Allies, in particular the United Kingdom and the United States, could not agree on which government represented China, no Chinese delegation participated in the 1951 San Francisco Peace Conference. Therefore the Republic of China (Taiwan) negotiated a separate peace treaty with Japan, signed on 28 April 1952. Article 2 of the text included a reference to the San Francisco treaty: “It is recognized that under Article 2 of the Treaty of Peace with Japan signed in the city of San Francisco in the United States of American on September 8 1951, Japan has renounced all right, title and claim to Taiwan (Formosa) and Penghu (the Pescadores) as well as the Spratly Islands and Paracel Islands”. Republic of China has argued that the explicit reference to the Spratly and Paracel islands in the text of this bilateral treaty implies Japanese recognition of Chinese sovereignty. Samuels and Lu have observed that, unlike the 1951 treaty, the Sino-Japanese text mentions the Spratly and Paracel islands in thesame sentence as Taiwan and the Pescadores islands. The latter are generally recognized as Chinese territories. Moreover, according to the negotiating record Japan insisted that the renunciation article deal only with Chinese territory. This shows that the ROC and Japan viewed the islands of Taiwan, the Pescadores, the Spratlys, and the Paracels as having a similar status - that is, belonging to China" US State Dept South China Sea expert Ambassador Chas Freeman who served for decades in the region, regarding China's claim to the SCS: "In 1945, in accordance with the Cairo and Potsdam Declarations and with American help, the armed forces of the Republic of China government at Nanjing accepted the surrender of the Japanese garrisons in Taiwan, including the Paracel and Spratly Islands.     This video missed an important point: China is the earliest sovereign state to discover and map these islands, using them with fishing and maritime silk route as early as Tang Dynasty at 7 AD. Your second mistake is using a European medieval square rig boat symbol instead of a Chinese junk rig symbol. These shows that this video is either biased or lacking detail research.

    In 1945, in accordance with the Cairo and Potsdam Declarations and with American help, the armed forces of the Republic of China government at Nanjing accepted the surrender of the Japanese garrisons in Taiwan, including the Paracel and Spratly Islands. Nanjing then declared both archipelagoes to be part of Guangdong Province. In 1946 it established garrisons on both Woody (now Yongxing / 永兴) Island in the Paracels and Taiping Island in the Spratlys. France protested. The French tried but failed to dislodge Chinese nationalist troops from Yongxing Island (the only habitable island in the Paracels), but were able to establish a small camp on Pattle (now Shanhu / 珊瑚) Island in the southwestern part of the archipelago. In 1950, after the Chinese nationalists were driven from Hainan by the People’s Liberation Army (PLA), they withdrew their garrisons in both the Paracels and Spratlys to Taiwan. In 1954 France ceased to be a factor when it accepted the independence of both south and north Vietnam and withdrew from Indochina. In 1956 North Vietnam formally accepted that the Paracel and Spratly islands were historically Chinese. About the same time, the PLA reestablished a Chinese garrison on Yongxing Island in the Paracels, while the Republic of China (Taipei) put troops back on Taiping Island in the Spratlys. But, that same year, South Vietnam reopened the abandoned French camp on Shanhu Island and announced that it had annexed the Paracel archipelago as well as the Spratlys. In 1974 South Vietnam attempted to enforce its claims to sovereignty by placing settlers in the Spratlys and expelling Chinese fishermen from the southwestern Paracels. In the ensuing naval battle at Shanhu Island, China defeated Vietnamese forces. This enabled Beijing to extend its control to the entire Paracel archipelago, where it has not been effectively challenged since.

    Additional: Philippines is a sea faring nation and china was not a maritime power until recently. When they do trade with Philippines in ancient times, Filipinos would be the navigators. Philippines added some shoals on to their maps 200+ years before China put out their 9 dash line. China do not even explored all the areas and used a british maps and translated the names to chinese. They did not even know the meaning of a shoal before and claimed that their southernmost territory is james shoal. Islands can be part of a territory of a nation but not shoals, reefs or rocks.

    The part of China's claim over the South China Sea before 1909 is inadequate. At the time of the Ming Dynasty, Chinese navy already patrolled the South China Sea to ward off pirates. And Chinese did not shun from the South China Sea. Even today the fishermen in China still kept a sea chart called Kan Lo Chi, which records all the sea routes in South China Sea to which they netvigate every year to carry out fishing. And there were semi-permanent settlement of Chinese in Spratley Islands going back hundreds of years, and which were destroyed by the Philippines in the 1970s. Chinese claim is not based on "recent discovery of oil", but based on history.

    You forgot to mention that in 1958, Vietnamese prime minster, Pham Van Dong(Ho Chi Minhs right hand man) signed a diplomatic letter which acknowledges that Vietnam recognises China's claim over the spratlys and paracel islands. Phillipines has no historical claims, and the rest is also weak. China has the strongest historical claims.

    First and foremost, the diplomatic letter mentioned nothing about the two island groups. The letter was only meant to support China's claim of the 12 nautical miles of sovereign sea from its coast as clearly stated in the writing. No interpretation was made with regards to the China's claim of controlled land. To put things in context, 1958 was the first year the international community convened to discuss about law of sea. The US proposed the 3- nautical mile territory while China wanted 12. Being a communist regime, the North Vietnam certainly showed supports for the "big brother" China. Such diplomatic support though should bear no legal binding. Another thing to consider is that in 1958, there were two internationally recognized governments in Vietnam. According to the 1954 Geneve Agreement of which China was a signatory, the Paracels and Spratlys belong to the South Vietnam government and not the North. Did China then go back on her own words? All in all, if China believes Vietnam has violated any international laws, wouldn't it be plausible to have the matter resolved at an international court? I am always perplexed by China's adamance in avoiding an international jury. As a powerful country how can you claim that the whole developed world is biasly against you and yet you try to convince much smaller countries to trust in you to do bilateral negotiations? Regardless of the dispute over the island group, China's 9-dash line claim is outright baseless. China refuses to recognize both the international law of the sea (UNCLOS 1982) and historical claims. Without a common international protocol or historical facts, how should any country hope to have a fair negotiation with the superpower China?

    Theres no mention of the 1734 Murillo Velarde map showing that the Spratly islands are part of the Philippines. The 9_line claim of China appeared only their maps around the 1940s.

    Great video but you missed the big part where during few last years of Vietnam War, South Vietnam control most of Paracel and Spratly Islands, seeing South Vietnam been weakened other countries like China, Taiwan, Philipines steal many of the islands. South Vietnam tried to retake but without the US support and approval they fail to reclaim their fathers land.

    The OLD NAME of the South China Sea = "CHAMPA SEA". It was known by navigators throughout Asia as the Champa Sea FOR CENTURIES, named for an Austronesian CHAM ethnic's great empire that controlled all of central Vietnam, from the northern border of today's Quang Binh Province to roughly the southern border of Binh Thuan Province.     The history of South China Sea does not start in China, cause' back then most people in china are farmers and the Philippines are fisherman's. Remember, the Philippines is a country of islands, (During pre-hispanic era) Filipino's were said to be proficient on building ocean going vessels!

    The 9 dash line was intruduced in 1949, reaserch for "Marillo Map". This map was a Philippine map intruduced by a priest in 1734, and islands are also named in the Marillo Map. (We call Marillo Map "Father of all Philippine map".

    The admin is wrong. Spratly belongs to the phollippines during its occupstion from 1500. Refer to maps ot the phillippines during spanish time. You are trying to right the wrong.

    the explanation of history is clear , the open sea that you called is your traditional fishing ground since in time of limahong more over , you claim the entire sea because of your fishing ground , but can you check the land mass of your land called CHINA its far far away , the chinese fisherman habitually fishing as far as they want , because they want the fish quality , because of this as your play ground , you want to claim the entire sea, what about the pacific ocean , why chinese fisherman not claim the entire pacific ocean , if you are claiming the oldest fishing ground why did not your fisherman discover the land of Guam if you are the oldest fisher.

    Don't have to invite US and Western ideology to our neighbourly Asian member. That can cause toxicity, chaos, destabilised and many other negative elements. We Asian able to handle peacefully among our self through dialogue and talk make this region progress.M ake PEACE!. Not created misunderstanding to break up Asian that had done good improve relation without outsider interference about SCS. Look & remember in past history, the US and European done had colonized almost Asian countries:-Laos,Vietnam,Cambodia,Myanmar,Malaysia,Singapore ,Philippine ,Indonesia except Thailand had not been ruled by Western, Japan. Even very very small country=Portugal able to rule Macao, almost all other European controlled Asia. We try to avoid chaos to go back poorer. Take more chance for Asian to change a better life than the Western world in future. People don't have to go overseas to work due victimized. Enough suffering during past history.

They (Vietnam, Malaysia, Indonesia, Brunei, Philipiines AND Taiwan should make a common appeal & claim) & mass their navies in the International waters. The court case won by Philippines will crystallise into this action. SCS (South China Sea ) in fact is very similar to North Sea where all the littoral countries drew lines in the map & peacefully drilling for oil. SCS littoral countries should cite it as the model here.

    It will be good for all countries involved in the region if China will be driven out of the SCS. No country should grab and own the SCS unilaterally because it's an international waterway. However countries sorrounding it should all be entitled to their EEZ mandated by the United Nation.

    If China will abide by the UNCLOS mandate it cannot claim the whole sea, so what the Chinese did they constructed many artificial islands scattered all over the place to bolster their claim. But building man-made islands in the middle of the sea and even fortifying them with military structures will not qualify China for a bigger Exclusive Economic Zones as ruled by Arbitral Tribunal in The Hague. The ruling as declared states that China's claim has no legal and historical basis. China's island building is not admissible in the court as evidence for right to claim.

    Free navigation for commercial shipment in the South China Sea passage is a right to navigate before w/ c actually w/o any Law in the UN stating that the South China sea is under the Intenational Laws of the Sea. Since the US is using this sea for war purposses like during the war of Corea and Vietnam, The sea were never been again safe for free shipment navigation and since ite always the target passage of the US Military force navigation, therefore China for security purposes went back to own the South China sea.The US knows about these now the US are already talking a lot of Blasphemy like reserve of oil , gas and other meniral resourcess were the sea lying there for all the century, no any nation talk about the hidden richness of the South China sea, The all other Asian claimant are only using the sea for its abundant fishing not for naval military way to bomb a country that all option lie on the table
