The ICC does not have a 'real case,' analyst says

Banafsheh Keynoush, non-resident scholar at the Middle East Institute, discusses the International Criminal Court's request for arrest warrants for Israeli Prime Minister Benjamin Netanyahu, among others, and says it's a "symbolic gesture" from the court.

    It is well known that international criminal law is hard to enforce. Putin for example has not been arrested. However he did avoid going to South Africa for the BRICS summit in the summer of '23. So it is not without consequences.

    Not by the court, by a prosecutor that didn't follow the normal process. He even invited Amanpour to The Hague for an interview. He is playing a dirty game.

    there are no set of rules at to how to carry out the process of issuing an arrest warrant at the ICC. Good thing they came out with their plans to send the allogations to the icc judges. It may make netanyahu think twice about leveling the last standing city in gaza.

    Barely anything is enforceable in international law. It is all norm setting and the norms extend as far as the states consent and bind only those state which consent. International law really should not be called law, it is misleading and confuses laypeople.

    @@Bill-Hicks-ashtray it is not a question of should we or shouldnt we. I just told you what is, not what ought to be. No reason to get emotional about it. If you believe that things ought to be differently than they are, you have to justify it with such reasoning that you would also accept as applicable to your own self should the power balance shift and circumstances change. If a state does not respect state sovereignty absolutely (I am not saying it should or should not) then that state better be prepared to not have its sovereignty respected by other states in certain circumstances. It is reciprocity between states what governs international law. There is no higher authority standing above states (and I contend there should not be). Technically speaking, the international landscape is anarchy, but because in theory every state should care about its own self interest, diplomacy keeps this anarchy nice and tame. All international organisations, treaties and conventions were born out of state consent and bind by virtue of state consent. The international courts only have jurisdiction where states consented and even in those cases, as much as rulings are deemed binding on the particular states in the particular case, there are no means by which they could be enforced.
