The Future Challenges of the International Criminal Court

On January 13, Luis Moreno-Ocampo, founding Prosecutor of the International Criminal Court, and Melbourne Law School professor Tim McCormack visited Harvard Law School for a talk on challenges that lie ahead for the International Criminal Court (ICC), the first permanent court established to deal with war crimes and crimes against humanity.
A visiting professor at the Harvard Kennedy School, Moreno-Ocampo was the subject of a recent book of essays by Harvard Law School Dean Martha Minow, HLS Professor Alex Whiting and Syracuse University College of Law Assistant Professor Cora True-Frost that examine his role and his legacy as the ICC's first prosecutor.
Tim McCormack, Melbourne Law School professor and James Barr Ames visiting professor of law at HLS, serves as special adviser on International Humanitarian Law to the Prosecutor of the International Criminal Court.
The event was sponsored by the Human Rights Program and the Harvard Law School Dean’s Office.

    In my point of view, the actions of these institutions seem to be going into the opposite direction giving only more power to the strong global political players against the weak ones. The hope is these International Criminal Courts, tribunals, and other new institutions could contribute to be a better balance of power.

    Your point of view is right, but some times we have to look beyond. The weak governments or leaders responsible of the crimes could not stay unpunished only because some others are not yet punished. The victims need remedy, justice and reparation of the losses they experienced. We can take the illustrative cases of Président of Chilii A. Pinochet or one of the former prisident of Tchad, after along time of international failure, they have been arrested and punished. The international justice can take time but as the facts are no prescribles, the time will come for the offenders to be pursuited. No one ignore the unfair treatment of some offender of massive crimes, we can note a weakness of international system whose ICC, the States members of Rome Stute have to heavly deal about this question to review that practice in favor of fair,sustainable and credible justice.

    I feel sorry for Mr. Ocampo, because he is a victim of the clash of the two systems of laws in the western hemisphere: a)The Civil System and b) the Common Law System . I am myself one of mr. Ocampo coleagues with the difference that I am voluntarily studying those differences, and took me many years(I live in the US for 44 years)to cross the gap between thos systems.I strongly believe that we are in the same position that Thomas Jefferson was when drafting the Declaration of Independence of the US. We still need to draft a World Constitution that will clearly define the role of the Universal Government. Or, we need to revise the Declaration of Men to create an effective balance of power between the big 8s and the other 99% of Nations that are still trying to call the attention for a Bill of Rights .On the other hand I strongly suggest that Mr. Ocampo hire a competent interpreter so he can freely speak Spanish to be translated into English, because, no offense, I missed most of his exposition

    The issues and challenges presented here are easily dealt with when a United Nations reform which makes it mandatory for member states to sign the Rome Statute or face expulsion from the United Nations body becomes reality. Those member state which refuse to agree on coming under the International Criminal Court's jurisdiction and global rules regarding war crimes and crimes against humanity would have to leave the United Nations, whereupon the nation will be perceived around the world as a "rogue state" unwilling to cooperate, a situation for the refusing state which results in profound negative consequences for the nation's economic, diplomatic, security, etc. international relations. Such a profound peace-producing reform would effectively end war crimes, illegal, unjust, wars of aggression, because no powerful leader could commit atrocities with impunity EVER AGAIN. Effectively, such a reform would absolutely end war on Earth, therefore truly carrying out mankind's greatest evolutionary action. Making it mandatory for United Nations member states to join the International Criminal Court would transform the Earth with regard to war and peace in a way that is historic, and would forever become perceived - read about by students in history books for generations to come - as the greatest decision made by humanity up until the year 2016. One is frankly astonished the legal scholars did not, for whatever reasons, mention such a clear, irrefutable, and profoundly powerful solution during this discussion.

    agreed. However, 3 out of 5 members of the UNSC are not still part of the ICC. The political situation must change largely for us to see this happening.

    Clearly the soldiers had no intention to harm the civilians. They were following the rules of engagement. In my opinion, one is not excluded from the commission of an offence because he/she had no intention of doing it or that they had no knowledge that such act amounted to offence, in this case, war crimes, but they mere fact that they committed it makes them liable to punishment.

    It’s incredible that this guy who has such a great difficulty to speak English can be a professor at Harvard! Is he? On the other hand I have read a lot of articles from European newspapers and magazines that he did poorly as Prosecutor of the ICC. On top of that his ethical behavior is questioned since he was accused of raping a journalist during his tenure at the ICC and Der Spiegel in Germany published an article showing how Moreno Ocampo used his influences for private business yet using inside information from the ICC.
