Hello. If a case is mutually dismissed, can I still sue for false arrest ?

Defendant had no knowledge they were being sued on a case that was filed, and the plaintiffs won. The judge granted them to take the domains and posted the lawsuit on it. Defendant appealed. The case was dismissed without prejudice does that entitle the plaintiffs to keep the domains and defamation posted on the domains

Could you tell me what happens after the dismissal without prejudice for a removal in proceeding case ? is it going to grant Asylum automatically ?

Yes you can

What if they dismiss but it doesn’t state with or without prejudice? We asked my husband’s attorney if they dismiss we wanted it with prejudice but all his attorney said that usually when they dismiss a case they rarely refile the charges and he shouldn’t worry about it. (We are in Texas)

In civil cases in Oklahoma, the savings statute allows refiling within a year of the dismissal, regardless of the statute of limitation, if it is dismissed without prejudice for the first time. But, you are talking about a criminal case. There is no savings statute for criminal cases. If a criminal case is dismissed without prejudice, then it can be refiled only within the original statute of limitation. In Oklahoma most crimes have a three year statute of limitation, but some crimes have much longer statues of limitation. For more specifics on your circumstances, talk to an Oklahoma attorney. So, if you sue the DMV agency dismiss case with prejudice, and you will be unable to appeal to a higher court from the district court.
