My hearing is on Tuesday so thank you very much for this information and I will be attending today at 7 PM. I agree, you have to be careful when testifying about negative things about the other parent. I testified for about 28 hours, and a lot of it was negative about the mother. I think the key is to not be petty, don't focus on minor things that make you seem spiteful. If something bad happens with the kids during the other parent's parenting time...think first: could that also have happened during my parenting time? Is it simple human error? If so, don't complain about it, be merciful if you bring it up in court. So I focused my testimony on the truly negative: the mother's acts of violence against me, her anger management problems, her pulling knives during arguments, her suicidal threats...all the things that would also have a seriously negative impact on raising an emotionally healthy child.

@@pbaldwin2943 I did get primary custody of our son, yes. Largely because I saw my judge was incompetent and gender biased against dads...so a lot of my testimony was designed to overcome the judge's shortcomings.

Don’t do it! Don’t ever go against the other parent. If they’re truly at all high conflict, they will most likely be able to out crazy you in intensity and time. Speaking away that your child or children if they decided they wanted to look at the court records which they can do once they turn 18 in most places from what I understand, you know who in terms of wanting what’s best for them and not two parents bickering.

The mother of my child is in jail for drugs and our child was sent to foster care in another state. I have a great career and a home and our child have a room in my home. I took parenting classes before pre trial which is coming up soon. I hope i get full custody because our child shouldn't be in foster care because of the mother's misuse and improper supervision when I've been trying so hard to get custody of our child.

I am going into a contempt hearing that I filed for. I am self representing. How does testimony work for myself? Does the judge ask me questions? As well as nex's lawyer?

Anthony, Thanks for your knowledge. When you are a beginner any suggestions or tips are helpful. In my case, I have been dealing with an attorney that does not care and doesn’t know my case, unfortunately, I have not had the money to fire her and get another professional, so I need to look for resources to help me out in this situation.

Have you noticed during remote hearings that opposing counsel will turn their volume up and unmute their mic? And it messes up the audio. Granted they may just be trying stay on top of their objections, but it almost feels deliberate as a way to mess up the record. I had to stop several times. I would just stop mid sentence and say, “are you able to hear me?”

Ok so I'm pro se for a grandparents visitation case a lawyer took me on pro Bono the case got dismissed and the judge vacated his order I now am trying to prepare evidence I am from Maine and could use any directions or video as to watch he has given me 2 hours to present my side due to many factors is what he said its been 3 years the judge said he has never vacated an order like this ty even just foe this video my should I give you my email ty for all of your hard work

Question: my son has autism and has a multidisciplinary team which is daily and requires a parent to be organized and able to keep up with his schedule. It took almost 2 years to establish all his therapies which are helping. How do I explain without directly saying it that a change of custody or any time away from his therapies and change in routine would not be in my child’s best interest as father lives in KS and my children and I in AZ?

How can I ask for a jury trial in a custody case? How can I ask for Supervising Judge to be present, because the current Judge is biased and siding with the narcissist attotney ex.?

What issues can be brought up against one's spouse to win a favorable custody judgement, do you think tax fraud or a love triangle can show lack of judgment of the other parent ?

I think the things you mentioned would be ignored my most judges. Issues should be around this: if this parent behaves this way, commits these actions, would it negatively impact a child's emotional and psychological development? Children don't understand tax fraud, so it doesn't impact them. Children DO understand a parent's anger management problems, depression, or other serious mental health issues. Children do understand being neglected, emotionally or physically. Always link the parent's flaws to the impact on the child's development. That's the whole point.

@@armando9395 Sorry you had to deal with domestic violence against you, as well as suicidal threats. In my experience courts love to punish men for alleged DV. But then courts turn a blind eye towards a mother's acts of DV. So when you testify about the mother's DV, be extremely detailed, so that the judge cannot hide from it. Don't just say "she hit me". Instead, testify about the details. For example, "she threw 7 punches at my head. I blocked 5 of them but she landed 2 on my cheek. Here are pictures of the bruises. And my child watched the whole thing." Basically, you are making the judge stand in your shoes so they can see what the mother is truly like outside of court. That's a big part of how I won my custody trial. Good luck to you.

@@FatherX2022 i am very happy that you got custody of your child. It never crossed my mind to consider the amount of times being punched would add to the descriptive nature of DV. Again thank you for this. And i agree, the courts do turn a blind eye to DV against men since it's taboo. At any rate Im glad you don't have to go through DV anymore or your child and happy some justice was served

So if the mother has been keeping you from the kids for two year but prior to that you were the one doing everything then it doesn't matter cause since she's kept you from them she's the good guy doing it all and you're just nothing and never involved. The methods used are idiotic and seem a bit engineered to create a one sided case making this whole process pointless.

I went to trial and lost my judge was biased he gave my 5 children to the dad whom i have a restraining order on along with his mother whom i also have a restraining order on as well...tbe judge denied me visitation to guardians discretion allowed them to move out of state and didnt even give me a reunification plan..horrible experience at trial!

I’m sorry to hear this. Anyway you could enlighten me on your experience? What grounds/evidence did your child’s father have on you? My son’s father is trying to get custody of our 18 month old. His dad lives in TN! Almost 4 hours away from us!
