Taking Western leaders to court for Gaza War | Tayab Ali | The Big Picture S3E10

Can Western leaders be held to account for their role in the Gaza war?
This week on The Big Picture Podcast, we sit down with one lawyer determined to do just that, and who has already put many of them on public notice.
Tayab Ali is Solicitor Advocate, a partner at the London Law firm Bindmans LLP and the director of the International Centre of Justice for Palestinians (ICJP).
For years, Ali fought to bring Israeli politicians before British courts on charges of war crimes. These included former Israeli Prime Minister Ehud Barak.
In 2009, he successfully applied for UK court to issue an arrest warrant for Israeli foreign minister Tzipi Livni following the brutal Operation Cast Lead, which killed more than 1000 Palestinians in Gaza.
In 2011 the British government controversially issued diplomatic protection for Livni to allow her to visit London on a speaking tour.
Following the Hamas attack on October 7 which led to Israel’s war in Gaza, killing more than 18,000 people including 7000 children, Ali and his team published a public letter to British politicians, informing them of their intent to prosecute any lawmakers “aiding and abetting war crimes in Gaza”.
They’re also supporting groups mounting a case at the High Court against the UK government over its arms exports to Israel.

    Fact: You’re mistaken. My friend has an old Bible (1600s or 1800s) and it contained a map of the land now called Israel. The name written across it was “Palestine” and also referred to as, “The Holy Land.”

    This is very encouraging to hear - that those in responsible positions actually CAN be prosecuted for complicity in war crimes. I am so relieved to hear this work is going on. Thank you. Can I just suggest also that personalities producers and editors across all media outlets have been just as complicit in some cases, and I believe it would be of value to our democracy and following to international law and human rights for these bad actors to also be put on notice, and if necessary prosecuted. These abuses of power have got to stop. Are there any plans to do this?

    Some English parents were upset because a group of students sent money abroad to support kids´health in a war zone. Do those parents know that a big part of the money that comes into England from ABROAD is taxes paid by the Commonwealth citizens of the world.     I personally believe this man would stand for anyone in Court. This is the epitome of a Lawyer, the true advocates that used to exist. One who believes in equality of Law for everyone. Id be very interested to hear interviews, experiences and an assesment from people who were represented in criminal cases by this man. I believe he would be a fighter. Much like that typical dashing lawyer series that used to be popular that would fight regardless of whether he approved of the particular criminal act.

    Tayab Ali, thanks for your honesty but you should know better. To say the UK (3:15) “United Kingdom to some degree.” The British started this mess during the late 19th Century occupation of Palestine and sealed the deal with the Balfour Declaration in 1917. What we need is hold countries accountable for breaking international laws in the international Court of Justice, promulgate world peace by refraining from building more weapons, justice, and equality for all. That’s how we stop worldwide terrorism.

    A local synagogue permanently had a giant banner on the outside that says “we stand with Israel.” I was confused. But it was more like, ‘of course, makes sense, why the need to broadcast?” Since a few weeks ago, in the midst of the worst attacks on Gaza, they replaced the banner with an even better one that read, “We PROUDLY stand with Israel. Celebrating 75 Years.” I physically felt the pain. I have always loved Jewish people. And it grew as I got older. I didn’t know there were deeply rooted divides like this. How do we unite after this? Where is the space for me to approach for a dialogue? How am I to take the exponentially increasing “we stand with Israel” signs popping up in a daily basis? What do those signs say to me?

    International humanitarian laws were created- but Israel, the US, and UK have been disregarding them. Excellent point to bring up, about consumer accountability.     Law on its own is influenced by powerful lobbyists who influence the legislators and Govts. Take AIPAC or its sister institutions as an example in the US nominees for local, federal election. None will go through the competition if not verbally or in writing an article express their devotion to Israel interest! These powerful, well funded lobbyists like AIPAC and its branches are also backed by arms, defence and tech industries that also pressurise politicians, legislators to millitary solutions than political solutions. Their members could even be the founder, paid politicians or stakeholders. War is a business. We just saw a few days ago how the CEO of Lockheed Martin, Raytheon, Boeing, BAE, etc, etc, ALL welcomed warmly Zelensky in one room!! He is not just a US puppet, president of Ukr, he is possibly a resident in their pockets. It's the same story with the head of NATO, EU, Nathanyahu and literally all leaders, including party leaders in waiting. They have them compromised inhumanely before. Rarely can we have a leader uncompromised and that won't be allowed to win, serve people or complete the full term of his/her leadership. They would smear, assassinate the character, forcibly remove or physically assassinate them. History is full of them.

    My forefathers fought for the rights that I have had all my life, not only in the last 2 world wars but (in my opinion) they fought against the very people who were treating them as slaves and refused to allow (at great cost) there grandchildreen to be treated as they had been. This is why since also listening to my Dad telling me about Palestine and the 2 years he spent there from 1946 to 1948 having fought in WW2, I am very pro Palestine and have been all my life (now in my 60s), and I have never knowingly bought anything produced in Israel for over 50 years.     The commentators that ignore the past 75 years, deliberately so, have lost all credibility to me. Switching from BBC news to Al Jazeera (English) broadcasts was one of the first changes I had to make. Boycotting more deliberately now too.     1:30:17 I’m so glad to hear you’re challenging the analysis that Britain do not recognize Palestine as a state and therefore the war between Palestine and Israel is a civil war. It makes no sense to me when the British clearly recognized Palestine as a country with a people even in the early 1900s in private memos written by Mr. Balfour during development of Versailles treaty and is available in British archives online, the Sykes-Picot agreement and even in the Balfour Declaration itself. There are also letters between Britain and Arab representatives for Palestine and other Arab regions wherein the British not only recognized Palestine but recognized it as belonging and to continue to belong to the Arab world. Palestine appeared on world maps before 1947. So, when Britain has, in the early 1990s acted in accordance and in their writing of treating Palestine as a country with recognized borders that was previously occupied by the Ottoman Empire,, how can it suddenly decide later that it is not? This all predated the United Nations and League of Nations. How can they just say “well, you’re not in this club so we don’t recognize you as a country…even though we’ve been working with you as a country up until we just decided ourselves not to”? This makes no sense to me. If they recognized Palestine before, and then they recognized in the Loan and UN the state of Israel, then how else do they regard the lands of Gaza and West Bank and East Jerusalem? They didn’t just disappear or stop existing with a people on them…so, how can Britain say they recognized it existed before but now they don’t? It makes no sense to me. Also, the repeated use of veto to prohibit Palestine becoming a state recognized in the UN is an abuse of veto. They cannot fairly say we can’t recognize you cos you’re not in our club, and also we won’t let you in our club. So, sorry, that’s the international law that we made up for justice and peace. I hope there are legal grounds for this argument because just on the face of it, using logic, applying principles of fairness, the British position makes no sense. The British position does remain as it always was, completely contradictory, not only in the legal framework , but with itself, and I believe this is absolutely intentional now as it was back in the early 1900s. This is what was written in the secret memo by the British to their allies when trying to reach agreement on the Versailles treaty: “This brings into clear relief what I fear is the unhappy truth, namely, that France, England,and America have got themselves into a position over Syrian problem [definition of Syria encapsulate Palestine at this time] so inextricably confused that no really neat and satisfactory issue is not possible for any of them. The situation is affected by five documents, being with our [british] promise to the ruler of the Hedjaz [arabs] in 1915; going on to the Sykes-Pivot Agreement with France of September 1916; followed by the Anglo-French declaration of November 18 and concluding with the Covenant of the League of Nations of 1919; and the directions given to the Commission sent out to examine the Arab problem on the spot; - directions which, it must be observed, were accepted by France, Britain and America, though the Commission itself was, in the end, purely American in composition. These documents are not consistent with each other; they represent no clear-cut policy; the policy which they confusedly adumbrate is not really the policy of the Allied and Associates Powers…” This is an excerpt down the Memorandum by Mr. Balfour (Paris) respecting Syria, Palestine and Mesopotamia” dates August 11, 1919.

    We have just learned that Samer Abu Daqua an experienced AJ cameraman was killed by an Israeli drone while filming the bombed out Farhana school in Khan Younes. Samer was only 45 years old with young children. He carried no weapon, only his camera to record the truth. The International Criminal Court (ICC) relies on the amount and quality of high level evidence to decide acts of genocide and to charge those guilty of such crimes. Since October 8, Israel has deliberately prevented/destroyed the collection of high level evidence by killing and imprisoning people, including cameramen, professional journalists, medical personnel, and observers. They have also deliberately caused blackouts, relentlessly bombed buildings, homes, schools, hospitals, infrastructures …leaving only rubble, and have barred outside unbiased investigators into Gaza. The ICC and/or other international high courts need to be informed- the intentional prevention/destruction of data is just as important as evidence at hand.

    Destruction of evidence is a crime in normal criminal proceedings, I don't see it is going to protect them. Everyone knows what is happening. We just don't know the exact details.

    They’re also suppressing hostage testimonies and burying the cars burned on Oct 7. They have the only weapons powerful enough to melt metal car frames, a fact concurrent with witness testimonies. What continues to gall me is they’ve still produced no evidence of any of the worst atrocities, those that were used to garner public support for what they’re doing now. No 40 babies, only one caught in crossfire. No testimonies of sexual assault much less rape kits. Add in witness testimonies and Haaretz reporting and the story sounds much different than what we’ve been told.

    I live near Munich. Maybe it is unnoticed outside of Germany but the vice president of the Bavarian local government, Hubert Aiwanger, has been accused of being complicit of distributing (and maybe even authoring?) flyers with antisemitic tropes at the age of 16/17 which even before October 7 was quite an issue. Sad to say, it had no consequences for him in the upcoming election, many people stepped in saying it was an error of a teenager who just did not know what he was doing. I repeat: at the age of 16 or 17. I have been this age once too and like Tayab I started forming my political opinion back then. Sorry for the spam but I can't help shining a light on that.

    I need to add one other aspect of this apartheid system which I find so bizarre. If a Pakestinian is charged with a crime by Israel, their family can have their home taken from them...not just their immediate family but also their extended family's homes, and their neighbour's homes. Of course no such actions are taken against settlers, and the law is used and applied to ethnically cleanse the territory...obviously. There have been multiple resolutions in the UN condemning the settlements and the countries voting against them were de facto giving a green light to this practice.
