Supreme Courts 8-1 Decision Changes California's Mag Ban Case, Duncan v. Bonta

The 9th Circuit Court of Appeals had been waiting on the SCOTUS decision before deciding California's "Mag Ban" case Duncan v. Bonta. After the decision came down both parties, "appellants" and "appellee's" submitted briefs to the court. The plaintiffs briefs completely overturned certain arguments the 9th had brought up.

    There should be a certain amount of "misinterpretations" you are allowed until the moment you are disbarred because clearly you don't know what you are doing as a judge. If a forklift operator keeps crashing into product, they get fired because they clearly can't do the job. We need to be able to fire government officials easier.

    California has a magazine disconnect requirement. Without a magazine, a pistol cannot fire. Therefore a pistol magazine is absolutely unquestionably an incorporated part of the firearm and therefore 2A applies.

    I say this every time, but the courts are addressing this backwards. The issue is not about "large capacity magazines." It is about "limited capacity magazines. In other words, the burden is not on the People to prove that large magazines are constitutional, it is on the state to prove that limited magazines are constitutional. Magazines" themselves are self-evidently required for the functionality of constitutionally-protected arms. The question is wether or not the state can ARBITRARILY limit the capacity of those magazines and therefore the associated arms. Per Bruen, this is a cut-and-dry "NO" unless the state can find a historical tradition of laws limiting the capacity of arms, which by this point, we all no there is none.

    I’ve been saying this all along. We should have one case, direct to the SCOTUS, that ALL gun laws/rules are unconstitutional infringements. Furthermore any new gun laws/rules passed are a deprivation of rights under color of law, a felony under 18 USC, Sec 242 & 243.

    ​@noncompliant209cali no they are standard capacity mags. Double stack 9mms come with 15+ round mags from the factory. They are standard capacity mags. A 30rd mag for an AR is a standard capacity mag because they are again what the factory sends with those rifles in most states. This 10rd mag bs is made up bs by politicians. The manufacturer of the firearms are in my mind the one who dictate what is standard capacity of their firearms not the government who is full of activists that want a communist state. These woke brain ded politicians are not firearms experts and therefore shouldn't be able to make up random bs without involvement of real experts I.E. people who actually know about firearms.

    Mark Smith, Four Boxes Diner has said the SCOTUS will not be taking any of these cases in the foreseeable future. The recent ruling from the SCOTUS on the three Illinois AWB cases and Antonyuk case from New York just put the 2A years away from being considered again being sent to the lower courts for review.

    The delay tactics employed be the courts should get a reprimand by the SCOTUS. This crap must stop. The magazine ban has been overturned and we should be able to have STANDARD capacity magazines which is whatever the manufacturer chooses to supply.

    FLAW: @4.20 With Magazine disconnects, the magazine *IS* needed for operation of the pistol. "In California, an “unsafe handgun” includes any handgun that does not have both a chamber load indicator and *a magazine disconnect mechanism*

    The simple response to the judges question is: where in the 2nd amendment does it say you can only bear arms if they're under a certain capacity? Why would the founder want less capacity if the whole point of the 2nd amendment was to provide security? So the founders wanted people to be under the capacity and outgunned in relation to equipment in common use?

    Where have I heard this before? Oh yeah, every time St. Benetiz writes a tome of how our rights are being trampled, we hear yet again how this is a "solid ruling" and a "slam dunk" that the 9th Circus...err... Circuit will just fawn, see the light and make amends for all their sins and we Californians will have our 2A rights restored in full. Dude, I wholeheartedly appreciate to the utmost your ability to explain these things in a common language, but I just cannot muster the same level of enthusiasm. The Nutty 9th, with it's comments of a coffee pot being comparable to an "arm" just says it all. Until SCOTUS has the balls to actually hear cases and rule on them instead of waggling their fingers at the lower courts for improper rulings and then kicking the can back to them "to get it right this time", nothing will change. Lastly - FJB!

    Yeah, during real magazines been out for many years so all of a sudden people that have them say they cannot use them. It does not make sense banning magazines at the capacity they want to control punishing low by being citizens

    By what reason did California's law makers decide on 10 rounds why not 8 or 12 ? Also what's so up setting is that they are saying that California's law abiding citizens are not responsible enough to have a magazine that holds more than 10 rounds. People in Arizona can have a magazine that holds more than 10 rounds with no problems but Californian can't.

    I got a 35 round magazine for my Glock, I love it. Can focus on plinking and training without so many mag changes! Yes, I purchased it as soon as I heard a nearby state was considering banning anything over 34 rounds.

    It essentially encompasses combat equipment. The purpose isn't just to protect a firearm it is ARMS in general, and the equipment necessary for combat, including Armor, medical kits, camo, kneepads, helmets, night vision, flashlights boots, whatever is needed and used in the pursuit of being an effective combatant in a fight for the security of your person, property, loved ones, AND our nation. The military is generally a good place to look to find what is combat essential.

    In California the firearm cannot fire if a magazine is not inserted into the firearm. By their laws a magazine is absolutely necessary.
