Supreme Court ruling: What now for Boris Johnson? - BBC Newsnight

Boris Johnson's decision to suspend Parliament for five weeks was unlawful, the Supreme Court has ruled.

Judges have said it was wrong for the prime minister to suspend parliament and stop MPs carrying out duties in the run-up to the Brexit deadline on 31 October.
Boris Johnson, who has faced calls to resign, said he "profoundly disagreed" with the ruling but would "respect" it.
In the studio Emily Maitlis is joined by Dinah Rose QC, a barrister specialising in public law and human rights, and the SNP's Joanna Cherry QC.

    The main 'opposition' party now has a policy of extending EU membership, negotiating a 'better' deal although they won't explain what 'better' means, then offering a referendum choice between remaining in the EU or chosing the 'better' deal (assuming the EU27 have agreed to it) ....er, and they won't say what they'd do if the UK has already left the EU or what the referendum would ask if they hadn't reached a 'better' deal.

    frost1129 - there is a very nasty smell in our parliament! I bet if they have a thorough clean out, they find some horrible rotting bull or even tons of shot with maggots crawling in them.     @@SeanJamesDocherty Tough, they voted knowing the two possible outcomes, if they really wanted to suck the big EU so badly they shouldn't have taken part, but they did, because they're in the United Kingdom. All this nonsense about another referendum is as good as going back to the shop and asking for another lottery ticket because you didn't win. That's the result of the WHOLE country, deal with it, it needs to happen or the government that decides to go against it and cancel will face a horrendous backlash and the leaver MAJORITY that have up until now been fairly reasonable, won't be so reasonable at the next clash. The Irony is it'll be the remainers that show up with faces covered looking like terrorists.

    Parliament won't let us have an election. They won't let us leave without a deal. They won't decide on a deal.     Courts have shown time and time again that they will intervene even when statute sought to preclude judicial review. This is a safeguard to the rule of law and courts will step in when the executive overreaches. Brexit is a massive deal, and parliament MUST continue to work on it before we exit whichever way you look at it.

    In Germany the Nazis never broke a single German law written by Nazies, laws are made behind closed doors in small rooms to suit situations. If the rule of law was worth anything then we are already out of the EU with no deal, Lawyers for Britain have stated the small print of article 50 that if no impediment is submitted by the leave date in March then the UK leaves the EU by default , when this was submitted to the high courts the judges refused to acknowledge it. The judges and the Lords along with our elected MPs have now stated that if Boris does not discount no deal then he will be jailed and as no deal Brexit is the only Brexit on offer that is anything like what the people voted for, then we are told the leaving the EU is now an illegal act. In context they are now willing to jail a serving PM enacting the will of the democratic vote of more than half the country, a move endorsed by another PM who stated if we vote to leave the EU we will be leaving the single market the customs union and everything else, leave means leave. Not since the English civil war has our parliament acting is such a disgraceful way and we are now at the point the army needs to step to end this coup

We also need pragmatism, common sense, militarism, organisation, a party system, democracy, legislation, negotiation, collaboration and political thought. If you have been involved in court cases you will know that the law is a joke because it ultimately depends on a judge who may be biased or incompetent and lawyers who are often childish and dishonest.

    Should just hold a revote for the referendum with the option either being remain or leave with a no-deal brexit. See how many people vote leave then, then either way the British Public are getting what we want. The first leave referendum was built on nothing but lies and false promises with no plans to actually deliver anything.     Unlawful? What law was broken? When the Courts decide to make political decisions then judges need to be elected, and I doubt any of them want to go down that road. We had an independent judiciary, it needs to be restored. A first step would be the resignations of the eleven who came to this decision.

    @rdmo83 So John Major's prorogation and possibly previous ones were unlawful? I think not. It is clearly public policy for a Prime Minister and Cabinet to propagate when they deem it reasonable and necessary. Adding a week to the length of the normal 'Conference Season' to prepare for a Queen's Speech was, in my opinion (which doesn't count) reasonable.

    read the actual judgment - the crux is that (a) Parliament was not actually prorogued at all and (b) the PM's advice to HMQ was of "no effect". That's why no sanction was imposed - just a declaration that Parliament was not prorogued. Seems to me to be a bit of a fuss about nothing...

    If you are not aware, the Queen can only make decisions based on the Government's advice. Even if she watches the news and read the papers, she cannot use that information to form her decision during anything related to giving permission such as permission to prorogation. Would the Queen privately be angry or show some distaste, she can. But she most likely won't make that public.

    Julian Malins OC isnt even a Judge he was a British barrister and the Supreme Court Judges not only were QCs and but also had to take exams to be lower Court judges then high court Judges then where they are now in the highest Court in the Land I know witch one I would want defending me in court and its not Julian Malins OC and all of this is before taken in to account he works for Cambridge Analytica

    @A hc a Judge who sits in the ECJ are appointed to sit there on behalf of the Country they are judges from so what is your point that the Uk Judiciary sends like every other eu member state send to the ECJ they are still serving the UK and the Crown or would you like the ECJ not to have British judges but hear cases from the uk also none of the Supreme Court Judges have sat in the ECJ en.wikipedia.org/wiki/List_of_members_of_the_European_Court_of_Justice

    I mean he would have prorogued parliament with a declaration signed by an official representative who has the power to grant that sort of thing with permission granted for the appeal process, so it wasn't unlawful. It would have allowed him to be able to leave on the 31st of October with relative ease but now Parliament is going to push him out of office and push back the date even further to the point that they'll vote for another referendum (hopefully with a super majority required this time).

    PMs must have weekly meetings with the Queen so that-if required, she can 'advise and warn' as she is constitutionally permitted to do drawing on over 60 years of experience of many PMs and range of political circumstances. It must be expected, therefore, that HM would have asked Boris about the length of the prorogation and after finding his answer satisfactory issue the order to prorogue. In 1975 HM had the PM of Australia dismissed from Office-now that's political. Also, HM is bound by her coronation oath to 'govern' according to the 'laws and customs' of the UK. Obviously HM is on the aid of the People and the Supreme Court is an ally of a renegade Parliament and its masters in Brussells.

    I heard this for the first time today 08/03/23. At time frame 1.35 Chuka Umunna liberal MP makes a statement to the interviewer that is staggering. The MP doesn't get what just happened in court, because he states in the interview that what Boris did was against government's sovereignty. THE POINT IS THAT THE GOVERNMENT IS NOT SOVEREIGN. The law is what is above us all. MP's who don't understand this need to know that if they are going to be an MP that they are a man or women just like every one else. Furthermore, that they are servants of the people, not on accent to a high throne hoping one day to become the greatest dictator of the world, no, leave that to the son of perdition.

    Eleven judges and one Gina Miller who are all remainers decided to stop brexit. Not very democratic since these 12 people aren't elected by the British people to make political decisions on our behalf.     As a lawyer would you agree that these judges are most likely protecting there jobs in european courts? I do not see how they can be at all impartial in this matter. Courts stand to lose alot of big money European court work.

    The court discussed the 1688 Bill of Rights and rightly pointed out it says "proceeding in Parliament", prorogation is not a proceeding in Parliament, it takes place in the House of Lords. So this QC is as is typical for politicians, interpreting the law for their own benefit.

    @@MomentousGaming They were incorrect, Dr David Starkey the eminent history professor and constitutional expert has stated the judges read that but did not understand its context which did not apply in this case, the judges are not constitutional experts and did not understand the 1688 bill of rights. This ruling is invalid and against our constitution as shown by history.

    Separation of powers? All but one of the supreme court justices supported remain. Surely it underpins their vested interest and this meddling in the the work of the executive. Judge made law should follow the intentions of the executive and I cannot believe that the judiciary would hold themselves superior to parliament, else it is the tail wagging the dog. The rule of law is supposedly always applicable... except when it is not and does not suit. Astonishing! Alfred Thompson Denning, we denizens of the UK need your fearlessness and clarity of thought now. Every trick in the book has been used to frustrate and overturn the referendum vote. The people must keep voting until we get the 'right' answer. Our European 'friends' have done everything they can to frustrate and impede the referendum result, in a truly shocking display of self-interest. How does a UK government find itself unwilling to follow the democratically expressed wishes of the governed?

The majority of the public can see what's going on here, and I hope every politician who tried to block the result of the referendum gets held to account. That means voted out as soon as possible.     I'll explain how it's legal. The referendum was advisory only, meaning there was no legal obligation to invoke article 50, they did anyway because as you said it was "the will of the people". This means though that the future of the country is still dictated by parliament, it is their duty to scrutinise the government and also it's policies. Also your comment assumed that it is still "the will of the people" when the tide of polls disagrees with that entirely.

I do find it interesting though how people claimed to vote leave in order to "return sovereignty to parliament" but only as long as parliament agrees with them. They're quite happy to allow Boris to illegally suspend parliament as long as it gets them what they think they want.

    The essence is not an election, the essence is a second meaningful referendum is what is due, voters be told that, are they seconding UK to leave without a deal? So far clear that Europe will not give UK a divorce agreement that UK wants. So, UK has to leave without a deal and the deal follow afterwards or not. Otherwise, UK should stay in the European Union if a no deal divorce would seriously harm UK than achievement of good. Let the first referendum be considered irresponsible democracy, that Socrates the initiator of the doctrine of democracy was sceptical about. Voters were lied to, with bluffs that 340 million a week will be saved if UK left the European Union. Total lies. I know someone would say politicians always lie anyway, but this was a blatant lie, Farage and Boris knew that they were telling a lie. Do you want to rubber-stamp campaign-lies, a wise person having a proper IQ functioning would say no. So, second referendum is the appropriate responsible democracy needful to be adopted as the remedy to resolving the Brexit question. Easy movement of UK people, exemption from import tax will all be lost. Exporters will find it difficult to having their products in other European markets. Companies or businesses will migrate from UK mainland to other European markets. The economy will slump, inflation will rise, unemployment will rise and pound sterling's value will drop. Products from European countries will become rare to find in UK or become expensive if found. That is fact known by anyone who studied and understood economics. After all, voters who think that foreigners will be ordered to leave UK, that shall never happen. Because foreigners are the ones running UK, go to dentistry clinics, GP clinics, hospitals, labour jobs such as cleaning or construction, the UK natives are very lazy, tea-cigarrette people in work-time. Foreigners fold their sleeves and work their skin off tirelessly. Working 40 hours and plus more per week. Foreigners owning houses or shops or businesses in UK is through hard work. They pay taxes upon which the natives of UK unemployed feed on. They pay into pension funds and leave that money here. Because of they retire in their motherland country.

    Pipi Cax Okay so first off, another referendum would be unconstitutional as we have already begun talks in leaving to the point that all we need to do is leave, secondly even if we did do another referendum there's a very popular poll that shows people would vote to leave in an attempt to hurry this up and get it over with. Thirdly, these foreigners you speak of aren't from the EU, they're from the Middle East and Asia and are migrants of war torn lands and illegal immigrants who shouldn't be here in the first place. Finally, the reason why we have so many unemployed is because the EU has been throwing their unwanted Migrants over our borders meaning we focus on putting them to work and giving them everything for free without bothering to help our own because otherwise it would be "unethical" by the rules of the EU.     No. I wish people would understand that all that noise about being underneath the EU etc.. was rubbish. The UK is a sovereign nation. The Supreme Court is as high as this case can go. 11 out of 11 agreed, with zero reservations, that Boris acted illegally. I should add that JRM also was involved in this act.

    The MPs were elected by the people since the result of the advisory referendum. Why did the people elect them if they didn’t agree with their politics? And we would have left the EU months ago if the vote on the agreement for leaving the EU had been passed. Why wasn’t it passed? Because a group of pro-Brexit MPs voted against it, whereas many pro-remain MPs voted in favour. Blame the pro-Brexit MPs who voted against the agreed Brexit deal for the current situation.

    I didn't like Boris before, but I think he's doing a great job at being PM he's really trying and everyone is against him. I voted remain but he should just go HARD BREXIT afterall that's what got the majority vote. I'm all for fairness and democracy. However I think since Scotland and Northern Ireland didn't vote leave they should stay in. Rather like Scandinavia, Denmark Sweden and Finland are part of the EU but Norway and Iceland are not. Scandinavians can work travel and live in these countries without passports, work permits or visas they just need to register their address. We could have a system the same here.

    Divorces are so ugly. One thing is agreeing to call it quits. Another entirely different thing is agreeing on how much the split is going to cost us all. It seems the initial mandate from voters was to split, without fully understanding at what cost. But now that the price tag has been assessed, remorseful members of the family want to rescind the decision to split. --- My heart goes out to Britain! Both sides have very compelling arguments. Tough impasse, mates. Good luck!

    At the moment it's all still theory, something like this has never happened before we won't truly know the cost or reward until it's happened and we can fully assess, peoples inability to debate properly like grown ups have caused the simmering pot in the UK to blow, we now have an outcome of a government who want to ignore a majority vote and one of the most important votes this country has seen, or leaving the EU and seeing what happens, making our own, new trade deals...... it won't be pretty either way but this country is in a LOT of trouble if extremely left liberals get their hands on the wheel......

    @@blancablanco1762 It's been years, a majority of people in the UK want to rip the plaster (band aid) off and just get it done with then begin dealing with the fallout, unfortunately the minority seem to be digging their heels in throwing tantrums at every corner and prolonging the process even longer, and STILL want to make it last and last until t hey can find some sort of loophole whilst STILL preaching as democracy incarnate..... it's quite sad, the UK is at a point of inner turmoil, this could have all been remedied long before the referendum if they were willing to sit down with the UK and make a feasible workable deal, even after the result they saw (from a business comparison) they're losing one of their best customers and their attitude (certainly juncker) was "pack your bags and leave, why are you here!, you voted to leave!".

    @@raivedarkstone7378 , no doubt the situation is extremely frustrating. When the only way is to go through something difficult, resistance is to be expected. In today's reality, convincing anyone to sacrifice for the greater good is virtually an impossibility without a leader to inspire and unify the people. Such leadership is hard to find these days of "what's in it for me". Still, we shall not lose hope, mate.

    What nonsense - this ruling is supporting OUR democracy. It ruled that an egomaniacal liar like Boris who only 0.13% of the population voted for, can't shove OUR elected representatives aside like a 10 year old rugby player when he finds it inconvenient. Just 26% of the eligible population were persuaded to vote to Leave foe various reasons - and not one of them voted on HOW... that was left to Parliament, which the Supreme Court reaffirms is Sovereign. Be angry instead at the lies you were told and the empty impossible promises.

    Not according to the Attorney General who advised Boris Johnson that it would be lawful under Parliamentry laws it was legal, and it has been said that Supreme Courts laws are different to Parliaments rules and laws therefore BJ did not break the laws of Parliament, and BJs lawyer should have mentioned this to the court in defence

    Parliament has it’s own mechanisms in place to deal with ‘a rogue’ PM misusing the prerogative power and they chose not to utilise them for political advantage, one of the judges even alluded to them not going for a GE or vote of no confidence because of this so please embittered remainers don’t tell me this decision wasn’t politically motivated. I’m getting really sick of being nice about this remainers are seeking to disenfranchise me.
