Supreme Court hears arguments on dispute over Idaho abortion ban

The Supreme Court heard arguments Wednesday in a dispute between Idaho's near-total abortion ban and a federal law involving emergency care. The law, Emergency Medical Treatment and Labor Act, requires Medicaid-participating hospitals to provide necessary care, including emergency abortions, if the mother's health is at serious risk.

    1:12:30 I don’t see any way a woman who loses her ability to have future children or who must undergo the horror of birthing their own brother will get any kind of “action & equity” to recover damages in a forced birth. People who think forced pregnancy and forced birth doesn’t do irreparable harm simply do not care about the pregnant person at all.

    @@ASDFUIL What baby? A fertilized egg? A fetus with terminal birth defects? A fetus that has died in utero? A woman whose water has burst with no chance of the fetus surviving? A fetus inside a ten year old girl? Putting living human beings in danger because of a religious conviction about developing cells, cannot be the law, that's the bulk of these arguments.

    They not only don't care about the pregnant women, they don't care about the embryo/fetus either. This has nothing to do with life. It's about control. Many of these judges and lawmakers are unapologetic supporters of the death penalty. They also support the idea of parent's rights, even when parental decisions increase the chance of a minor commiting suicide, or suffering other harmful effects from their parent's choices. These judges and lawmakers are all hypocrites

These same judges and lawmakers are almost all unapologetic supporters of the death penalty. They also support parental rights, even when parent's choices increase the risk of childhood suicide and other serious potential harms. This is only about calus control. They are all hypocrites.

    No one likes too much bureaucracy but citizens want protections too. Everyone in the US should have the same legal rights. We all should be protected from unscrupulous corporations that would create monopolies. We all deserve protection from discrimination. There are some rights that should be available to you regardless of which state you live in. But states should be able to manage many of their own laws that are unique to them. Opinions on abortion vary according to religion, and religion is always a source of argument. The abortion laws in this nation will always be in flux. I fully expect them to change again within the next 10 years, but then I’m sure they’ll change again. Scientists are working on an artificial womb so that doctors can save premature babies earlier. I don’t see abortion laws stabilizing until fetuses can spend most of their development in artificial wombs. Don’t think it can’t happen. Look at AI.

    I'm from Texas & when I was a kid I had a relative who gave birth in the 6th month, but sadly the child didn't live long because their organs weren't fully developed. My relative later found out that she had a blood condition that she was prescribed medication for & was able to have another child. Ever since then before I even knew what Roe V. Wade was my thoughts on being "pro-life" vs. "pro-choice" have always been abortion is fine in the 1st & 2nd trimesters since it's likely the child can't survive outside the womb on their own, but in the 3rd trimester it depends on if the birth will effect the life of the mother.

    In Pennsylvania the law for preterm (22-24 weeks) aborted babies born alive (breath, purposeful movement, pulsating umbilical cord) will be resuscitated. Preterm abortions are required to have a separate team just for the baby in event the child is alive at the time of induction and delivery. You can stabilize the mother and save the child in Pennsylvania. Pennsylvania has hospitals that have fetal hospice units for mothers to bond with their babies for these unfortunate scenarios.

    We're going about this wrong. We're trying to appeal to the Supreme Courts better nature. What we need to do is point out the HIGHER COST to INSURANCE COMPANIES for a doctor to try and save a woman's life. Risking septicemia, possibly losing limbs, being in the ICU trying to stabilize her life, has to COST a LOT MORE than having an abortion as soon as a problem is noticed. Get an insurance adjuster to work the cost comparison, and the Republicans will finally listen.

    Idaho is telling hospitals to follow state law when federal law says they need to provide treatment. In many of the parts of Idaho there is no ob GYN, now the ER cannot treat you either. Idaho sure loves the unborn and doesn't respect the women that birth those kids.

    This is what happens when lawmakers make laws for healthcare instead of medical professionals making decisions about healthcare, if you dont have an MD (doctor of medicine) you have no business making decisions about anyone's healthcare, way to make lawmakers are simply out of touch with laws they write and are pushing, hence, why I vote in every election

Unrelated to EMTALA, the full spectrum of quality and necessary medical care is absolutely dictated by the federal government through the spending clause and is unavailable to people lacking cash to pay directly.

    Alito's comment about "unborn child" being in emtala = judicial overreach and activism of the highest order, and it's based not on rational thought, or concern for the health of all parties involved, but rather on dogma and a disregard for a women's right to receive appropriate medical care to save her life and/or preserve her health. What a callus and misogynistic opinion to hold.

    It’s a hypothetical, a hypothetical I’d used to test the logical structure, consistency of structure, and validity of robust argument construction. They may seem pedantic, but they work to test the arguments provided. If they can’t stay consistent it can be assumed they are acting in bad faith, and can be dismissed. You have to also consider proportionality in comparison of abortion to antidepressants, and determine if the answer consistency follows their logic in proportion to, in this case, antidepressants.
