    Listening to the guy who argued with the 911 dispatcher.... all I can think of is the number of times I've had to break into my own house because I lost my keys, and the fact I never really introduced myself to my neighbors. If the cops show up, I can explain myself. If Mr. Shotgun over there gets on an adrenaline rush from his hard-on at the prospect of murdering me.... I'm dead.

    Last two weeks at 16 year old male was shot for knocking on wrong door, 20 year old woman was shot for driving in wrong driveway, Texas cheerleader shot for accidentally going to wrong car and a 6 year old girl (and her parents) shot at when she retrieved her ball that rolled on to neighbor’s property. Too many people feel threatened and pull out their guns in situations that are not threatening just simple mistakes. Law terminology should be changed from “stand your own ground” to “shoot first and ask questions later.”

    The man who shot the cheerleader is NOT a self-defense case nor did he even claim self-defense either. Reports state that when the cheerleader got into the backseat of the wrong car, he was in the front passenger seat, and she quickly got out when she realized she was in the wrong car. She then got into another car, the right car, with two other cheerleaders, and that's when the man exited his vehicle, walked up to the cheerleaders in their vehicle, some words were exchanged and that's when he pulled a gun out and opened fire on them. He then fled the scene but was later arrested. This case is still pending. But it's clear that this is NOT a self-defense case, this man is an obvious criminal, and will be charged and held accountable accordingly. And the 6 year old being shot while trying to retrieve her ball from a neighbor's lawn is NOT a stand your ground case either. The man who shot at her was already a convicted felon in possession of an illegal firearm, with a rap sheet of domestic violence too. This was clearly an open and shut case of a violent criminal shooting innocent victims. NOT a stand your ground case. The other two cases are extremely rare cases involving the accidental or negligent discharge of a firearm and then attempting to claim self-defense or stand your ground afterwards. I highly doubt that the courts will allow self-defense or stand your ground to be used in either of these cases as a credible defense in court. Just like that guy arguing over dogs or like that Salama Ra lady. This is the 1%'er club. One slip, and you're out.

    @@_BenJaminCroft_ They are all stand your ground cases if they use it as a legal defence. And whether or not the gunmen _ought_ to get away with it, they still CAN. The court CAN rule in their favour. Because this is a ridiculous law that has nothing but grey areas. The reason why the shooter of that cheerleader will go to jail isn't because it's not a SYG case. In all likelihood he won't even invoke that defence. But even if he did, he'll go to jail because his name is Pedro Tello Rodriguez Jr. In addition to that, his victim _lived_ - meaning she can testify. Her friend was also a witness. What if the victim was shot dead, and there were NO witnesses? There even _were_ witnesses when Nick Julian shot Garcia, contradicting his claim of self defence, but since that was word against word... the KILLER was believed. There is NOTHING good about Stand Your Ground laws, and a lot of things _demonstrably wrong._

  • @_BenJaminCroft_

    @itskarl7575 No. They are not _all_ Stand Your Ground cases. The cheerleader case and the 6 year old case are NOT stand your ground. Not even close. And they were proven in a court of law not to be. Also, what you failed to notice and mention, like John Oliver does, is that Julian had a witness that saw Garcia rush towards him in a threatening manner. Julian tried getting back into his house but couldn't get the screen door open in time. By then Garcia was already on Julian. In order to stop Garcia from physically harming him or worse, Julian turned and fired. If you think every case is stand your ground just because someone claims it aftwards, then you'll end up in prison like that guy arguing over dogs or like that Salama Ra lady. Self defense cases are taken very seriously and anyone who abuses it will be punished according to the law. This is the 1%'er club. One slip and you're out.

    This entire episode reminded me of when I worked at Walmart. Start of the pandemic, I had the lovely "easy job" of telling people they had to put on a mask. I got to see an altercation so stupid, I became a proponent for stricter gun laws. This lady swung into the lot going too fast and nearly hit a guy. He walked up after they parked and shouted "What the fuck!? You almost hit me!" And she immediately pulled a gun and said "I feel threatened!" Thankfully he ran, and the cops were called soon after. Nothing happened to her of course, and she then walked into the store like nothing happened. EDIT: Since people seem to be missing the point I will clarify. I don't think a man being rightfully angry, and shouting at someone, should be grounds to instantly draw a deadly weapon. Had he banged on the window, or acted violent, I would understand, but he stood a good distance from the door, and waved a hand to get her attention. He was upset, but not being an active threat. And if that is all it would take for you to draw a gun as well? Then you are sad, and shouldn't own a gun. Guns are a far bigger escalation than an angry shout.

And you can do this ex parte or third party as well, because the Non-Aggression Principle is universal. In Texas, *Texas Penal Code, Chapter 9, Subchapter D: "Protection of Property"; Sec. 9.41, 9.42, & 9.43* falls perfectly in line with this principle; and medical reports and bullet forensics show that they were shot in the torso; the off duty cop that witnessed one of them rushing towards Horn arrived just seconds before it happened, he was on his way home that night; and those two _criminals_ were illegal aliens too bty. Lethal force was never used or even threatened 2. The killer was not in any sort of danger. NEITHER WAS his neighbour, who wasn't even at home. So third party extension, my foot. 3. A principle being universal doesn't mean it extends to third parties, unless you WANT to for your own nefarious reasons. And when the third party in question isn't even THERE, it's already passed beyond ridiculous and is now firmly entrenched in Bizarro-land. If this was a case where the non-aggression principle could be used as a defence, then E V E R Y single case of murder could be defended the same way. All murders can be "justified". And every murderer believes himself to be justified. And if you can shoe-horn the "non-aggression principle" in THIS case, the sky's the limit. In no sane universe was Horn REMOTELY morally right. He used an exceptionally terrible law as an excuse to commit murder.

    @@Matt90Nine First of all, the government is under no duty or obligation to protect and serve any of us. Court case after court case has upheld this for decades. Second, Stand Your Ground and Castle Doctrine laws fall perfectly in line with the Non-Aggression Principle. Third, evidence clearly shows that an armed population does in fact keep violent crimes at low levels and John Oliver even reinforced this statistic by showing that 70% of Stand Your Ground cases are justified.

  • @_BenJaminCroft_

    @_BenJaminCroft_

    3 жыл бұрын

    @@Matt90Nine Morality _is_ violence. What I mean by that is not all violence is moral. All morality justifies the use of force. For example if your a woman and you have the moral right not to be raped, then of course you are perfectly legit in using force in order not to be raped. If you have the moral right not to be assaulted, then you have the moral right to use force to prevent yourself from being assaulted. If you have the moral right not to be murdered, to not be stolen from, you have the moral right to use force to prevent that. So whatever we define as the _moral_ is what we give permission to use violence in the pursuit of or the defense of that principle. Morality _is_ violence. It's not to say that the two are completely synonymous because you can have just self defense; which is the use of violence to defend your moral rights and that's perfectly fine. However! When people talk about morality, they're talking about _justified violence._ *Justified violence.* So what is the morality that reduces the amount of violence in the world? Clearly it has to be reactionary morality. And it has to be _case limited_ morality. The Non-Aggression Principle is _reactive._ It's not proactive. Thou shall not initiate force against others. But if force is initiated against you then you have the right to initiate force to defend your persons and/or property and that includes ex parte and third party too. It's a universal principle. So once we understand the morality, that which is used to justify violence, we have to be very sparing, tiny, case controlled and tight in our justifications for morality. Because whenever we justify morality, whatever we apply morality to, there is where we also justify violence. And if we want to keep violence down in the world we have to keep morality reactive, case specific and very very tightly defined. So if we say morality is the Non-Aggression Principle that bans rape, theft, assault and murder, we have a very powerful and very _limited_ justification for violence and it's reactive. If you don't want force involved then it's not morality. It's then aesthetics or politeness or social convention or something els; it's not morality. Morality is that which takes the safety off the gun and let's you point it at somebody. That's the foundation of morality. It's flicking the small domino (this is immoral) and the last big domino is the safety coming off the gun. Hence why we have these laws and this is what they are based on. Morally defending your person and/or property or someone else's person and/or property with equal if not greater force from theft, assault, rape or murder. Anything less would be considered aesthetic morality and laws based on aesthetic morality are obviously subject to change. But not laws based on true morality. Get it?

    I'm saying this as a gun owner, someone who has been around firearms since I was old enough to carry a 22 rifle: This is totally insane. I really don't understand how we can legally allow someone who was not under any direct physical threat to take it upon himself to grab a gun, leave the security of his home, and execute two unarmed human beings for a non-violent property crime. Since when do we execute people for burglary? Totally, totally in the wrong here. What kind of a coward shoots people in the back? "Stand your Ground" laws just enable people to legally comit homicide and create any justification they like afterwards. How the fuck do you legally codify "in fear for my life"? This guy had no reason whatsoever to believe that his life was under any kind of...I don't know...mortal peril.

I reality, both parties involved were at fault. The guy who killed Scott Beary and claimed self-defense was charged and sentenced guilty to involuntary manslaughter in the first degree. He was sentenced to prison for 5 years, where he currently resides, and he will never be allowed to legally own a firearm ever again. Remember that John Oliver is a comedian hosting a comedy show, *generalizing* information read from a teleprompter, in order for it to fit into his comedic act. But if you are the sort of person that falls for the propaganda, I'm sure America is better off without you. Simple math: 330 million Americans and about 30,000 gun deaths a year. It's known as the Non-Aggression Principle. If force is initiated against you and/or your property, you have a moral right to use equal if not greater force to defend your person/property. And you can do this _ex parte or third party as well,_ because the Non-Aggression Principle is universal. In Texas, *Texas Penal Code, Chapter 9, Subchapter D: "Protection of Property"; Sec. 9.41, 9.42, & 9.43* falls perfectly in line with this principle; and medical reports and bullet forensics show that they were shot in the torso, there was a cop there that witnessed one of them rush towards Horn, and those two _criminals_ were illegal aliens too bty. Horn was 100% morally and legally justified in his actions.

  • @portmantologist

    @portmantologist

     @_BenJaminCroft_ None of what you said contradicts my statement, even if I grant that all of the things you said are true, which I absolutely don't. First off, "morally justified" and "legally justified" are not remotely the same thing, because moral actions can be illegal and laws can be immoral. Second, the validity of the Non-Aggression Principle is an assumption that you're making, not a fact. Third, a shotgun is so far out of proportionality to a burglary that it violates the Non-Aggression Principle because it made Horn the aggressor. Fourth, the citizenship status of the burglars has no bearing on whether Horn's actions were justified, as illegal immigration, much like burglary, is not a capital offense, nor is "Illegal" immigration even a criminal offense at all.

  • @_BenJaminCroft_

    @_BenJaminCroft_

    @portmantologist *First,* morality _is_ violence. What I mean by that is not all violence is moral. All morality justifies the use of force. For example if you are a woman and you have the moral right not to be raped, then of course you are perfectly legit in using force in order not to be raped. If you have the moral right not to be assaulted, murdered, assaulted, and robbed from then you have the moral right to use force to prevent yourself from being robbed, assaulted, raped, and murdered. So whatever we define as the _moral_ is what we give permission to use violence in the pursuit of or the defense of that principle. Morality _is_ violence. *Second,* clearly the NAP has to be reactionary morality. And it has to be _case limited_ morality. (fyi theft, assault, rape, and murder) The Non-Aggression Principle is _reactive._ It's not proactive. Thou shall not initiate force against others. But if force is initiated against you then you have the right to initiate force to defend your person and/or property and that includes *ex parte and third party too.* It's a universal principle. *Third,* just because you think a shotgun is too big or too much to defend yourself and others with, doesn't mean nobody else can't use one to defend themselves and others with. That's ignorance at its finest. I won't tell you what you can and can't use in order to defend yourself and others with; and neither should you. How dare you. That's messed up. *Fourth,* if our borders were more secure then this whole situation might never have took place.

  • @portmantologist

    @portmantologist

    2 ай бұрын

    @@_BenJaminCroft_ First, it is completely psychotic to suggest that morality and violence are necessarily intertwined. It's generally considered immoral to cheat on your spouse, but few people (much less the laws of a civilized society) would say that cheating on one's spouse justifies lethal violence against them. You're conflating laws with morality, and they are not only not the same thing, but are only tenuously connected. You've also got causality backwards: it's not that women (and men, and children, etc.) have a right not to be raped, but that people have the moral obligation to not commit rape. Morality constrains actions, not consequences. Second, nothing you say about the NAP matters, because no matter how "universal" you think it is, it is neither an established fact nor the basis for our laws and morality. You can believe in the NAP as much as you want, but it's not a blank check to commit murder. Third, it's not that I think that a shotgun is "too big" for self-defense, it's that shooting someone with a shotgun is far out of proportion of the "violence" of property theft, especially property that is not yours. Nobody's life was in danger until Horn inserted himself into the situation with a shotgun. As far as telling others how they can and can't defend themselves, THAT IS WHAT LAWS DO . If someone rear-ends your car, and you shoot them to death, you are both legally and morally in the wrong because the violence you inflicted on that person is far out of proportion to the "violence" that was committed against you. "An eye for an eye" is meant to be a limiting principle, not a permission slip: if someone takes your eye, you take theirs, AND STOP THERE. Fourth, it is incredibly well-documented that immigrants, "legal" or otherwise, commit fewer crimes than native-born citizens, so the fact that some immigrants commit crime is hardly an argument against immigration when non-immigrants commit more. As I stated before, illegal immigration is not even a criminal offense, much less a capital offense. Furthermore, the problem with immigration is not the "security" of our border, but our broken immigration system. Integration is a two-way street, and it's not only the responsibility of immigrants to integrate into our society, but our society's responsibility to facilitate their integration. Illegal immigration can only exist in contradistinction to legal immigration, so if we have a problem with illegal immigration, then definitionally we have a problem with legal immigration.

    "Man that shot the people on the next door house, he wasn't concerned for the neighbours" How do you know that? How can you possibly know what another person is thinking? By his attitude and his tone? Since you are always 100% accurate in your assessment of what people are thinking and how they are acting, you should sit in on police interrogations. Because of your special talent you could immediately tell if a suspect is lying or not, saving time and money in our court systems. Please consider this. The way I look at it is...He had his neighbors back. No one has the right to steal your property. When does it end? Let's say you needed to lose a few pounds, so you bought a bicycle. It was stolen and you called the cops. They wrote down the information because they arrived too late to stop the theft. What are the chances of you getting that bike back? So you buy another bike and it was stolen right out of your garage. When does it end? People will argue "A bike is just an object that can be replaced, it is not worth a human life". Well, how many times do I need to replace that bike? How much money do you think I have? Why is there so much sympathy for a thief that doesn't give a damn about you or your property? That thief doesn't care about me, my property or my family, he doesn't care how long I had to save to buy that bicycle, or if I'll ever be able to replace it. So why should I care about him? I'm not saying go hunt the man down, I'm saying that if a man comes onto your property to steal your belongings, you have a right to stop him from doing so. In the case of the man who shot his neighbors thieves, the same logic applies. He knew his neighbor, he knew the men who were next door didn't belong there. He protected the man's property.

"No problem with stopping a thief, but bringing a gun is guaranteed misery" What if the thief doesn't wish to be stopped? What if he has an accomplice? I ended up at a dead end and had to do a 3 point turn, of course that required the edge of a nearby driveway since the street was so tiny. Within seconds, a man with a shotgun started coming out the house (good thing it wasn't pointed at me) but I knew he thought that I was trying to "trespass" I just wanted to go the fuck home.... that memory still haunts me because this was a little bit before the Trayvon Martin case. I wasn't even aware such a law existed in that God forsaken state. To think, that I was almost a statistic because I got lost. I wasn't even lingering on the property, I was just shifting gears. These laws just enable Batman wannabes and police academy rejects to go out and shoot someone because they want to feel validation for owning a gun and exercising a 'MURICAN right.

A friend of mine was sitting in the passenger seat of his brother's car and a third man walked up to the passenger side window and pointed a gun at my friend's brother. My friend, obviously fearing for his life, fired one round through the door and hit him. The man who had been shot survived, and managed to get back to his car and drive away. My friend and his brother called the police and filed a report, including the license plate of the man's car. When the police found the man, he had gotten rid of his gun, so the police didn't charge him. Instead, my friend is serving eight years for felonious assault and improper handling of a firearm, because as far as the police are concerned, he shot an unarmed man without provocation. The craziest thing? If the man had died, his gun would have been lying next to his body, and my friend would have been found not guilty for reasons of self defense. Yeah. You read that right. My friend is in prison because he *didn't* kill a man. Hooray for America's gun laws.

And you can do this *ex parte or third party as well,* because the Non-Aggression Principle is universal. In Texas, *Texas Penal Code, Chapter 9, Subchapter D: "Protection of Property"; Sec. 9.41, 9.42, & 9.43* falls perfectly in line with this principle; and medical reports and bullet forensics show that they were shot in the torso and there was a cop already there that witnessed one of them rush towards Horn. I am so grateful that Iowa tries to account for that. If you are out in the open or not in the building where the threat is present (ie. if you're out at the pumps when the cashier is held up inside the station) you aren't allowed to legally claim you were protected under SYG if you drew your gun and went into the building. Now if they pull the gun on you or the cashier when you're inside and can't reasonably get to the door or exercise a duty to retreat in a way that wouldn't endanger yourself? Then its a different story. It isn't perfect, but I do support Stand Your Ground and Castle Doctrine. Secondly, he put himself in the situation, and while he may no longer have a duty to retreat, he certainly doesn't have to right to start a conflict. Lastly, even if that reporter said "they came towards you", the investigation found that he shot them in the back, which belies the "i felt threatened" response. What is lacking, and desperately needed, it a standard by which to judge. "I felt threatened" is far too vague of a concept. There should be no excuse, ever, to shoot an unarmed person. Let's value innocent people of course, but remember criminals are vermin. Humanity is a brutal species and we cannot rely on the kindness of our enemies. If you are not armed there is NO self-defense against a physically superior or armed assailant. That's reality too. Dead innocents matter but let's not pretend dead assailants matter. The vast, VAST majority of American firearms disturb no one. When we had better citizens we could have high school shooting clubs. Marion Hammer and friends are not the problem. BTW if ever involved in a self-defense situation the first person to call is your lawyer because laypersons cannot navigate the incredibly complex legal system. @@_BenJaminCroft_ According to the Pew Research Center, "Though they tend to get less public attention than gun-related murders, suicides have long accounted for the majority of U.S. gun deaths. In 2020, 54% of all gun-related deaths in the U.S. were suicides (24,292), while 43% were murders (19,384), according to the CDC." (1) So, you are correct for 2020. Since it is from 2020, your comment is outdated. Until new statistics reports come out, your claim cannot be verified. Within the Pew Research Report, graphs using CDC data demonstrate a marked increase in gun related deaths since 2016. (2) That Said, your comment could be considered a red herring fallacy given it detracts from the original argument made by John Oliver. Furthermore, your claim fails to address my original statement. By referencing recent gun related violence, I am pointing out that John Oliver's original monologue is just as important to be discussed today as it was when it originally aired. As such, your reply comes across as an attempt to shut down discussion. Despite, interestingly enough, the majority of Americans wanting gun laws to be addressed.(3) 1. I'm reminded of the murder of Jordan Davis, shot while he sat in the back seat of a car in a fuel station. Instigating factor was supposedly loud music. Ultimately, the murderer's "stand your ground" defense failed completely, although factors working against him included that he never called 911, and that his own girlfriend (who was a witness to the crime) testified against his claims that Jordan might have had a gun. Subtract his girlfriend, and add in a 911 call in which he reads from the script, and it's easy to see this murderer evading his life sentence.

    That's not how stand your ground laws work. You need an objective reason of great bodily harm and a subjective reason. He may have thought that he was in danger or fear for his life which would be subjective. But objectively his life was not at all in danger. Unlike how John Oliver would have you believe he would not be able to get away with it whith just a subjective reason. The reason the man in the video wasn't charged could be because of jury nullification. Where the jury found him not guilty even though he was very much guilty.

    @@thereckoner30 If that's the case, how did the guy get off who left his home and went to go shoot a couple guys in the back? He was safe in his home, not in any objective danger. I think you're ignoring that the way the law is actually enforced is not the same as the way it's written or how a reasonable person would enforce it.

    @@schloughed Upon its inception the Black Panther Party's core practice was its open carry armed citizens' patrols ("copwatching") to monitor the behavior of officers of the Oakland Police Department and challenge police brutality in the city. In 1967, the Mulford Act was passed by the California legislature and signed by governor Ronald Reagan. The bill was crafted in response to members of the Black Panther Party who were copwatching. The bill repealed a law that allowed the public carrying of loaded firearms. So it was only when they started to arm themselves that the government decided to act and not when there were people killing black people for no reason (such as lynchings) and police brutality being rampant.

    17:48 "Applied unevenly" is incorrect. The facts of each circumstance were fundamentally different. One occurred driving in traffic on a public road, the other the shooter's own fenced private property. One occurred in Michigan, the other in Texas. One involved road rage, the other involved criminal trespass and theft. One involved brandishing a weapon and pointing it as a threat while in public, the other involved aiming and shooting with no danger to the public or persons off the property. The Michigan case showed the woman's actions were seen by others as a threat to public safety, whereas the Texas man's actions were a benefit to public safety. It's an apple and orange comparison.
