Squatter's Rights in California

Who Is Considered a Squatter in California?
A squatter is someone who uses or occupies someone else's property without permission or knowledge of the property owner. They have no lease, no legal agreement, and they are not paying any rent; they are just living free on someone else's property or under someone's desk. This property can be land, a home, a commercial building, or any type of real estate.
Now...Can a squatter gain ownership of a property simply by squatting simply by occupying somebody’s property?
Yes, it is very rare but in California. A squatter can claim rights to a property after living on or caring for the property for 5 continuous years. This is called adverse possession. But before you all go out and start searching for abandoned homes to go occupy there are some rules to follow:
- The Squatter must occupy the property for 5 years
- They must possess the property by caring for it and maintaining it. Any respectable squatter should be at least mowing the lawn right?
- The squatter must be paying the property taxes for the last 5 years. Nothing is free my friend, not even squatters' rights!
- The squatter's possession of the property must be “Open & notorious” which means that the squatter is not attempting to hide their occupation of the property. It must be obvious to anyone that they are squatting there (including any property owner who makes a reasonable effort to investigate).
- Exclusive possession, They cannot share possession or occupation with strangers, other tenants, other squatters, or even with the owner.
Has this happened before? Yes. Some Squatters have been able to take people's property through adverse possession.
Is it common? No, it is very rare. Squatters rarely can meet all the criteria and their use of the property is typically short-lived if the property owner is periodically visiting the property, or if neighbors report suspicious activity.
These simple steps can protect your property from potential squatters:
- Visit or inspect your vacant properties
- Properly secure your property with gates, locks, doors and windows locks. Makes sense if you don’t want people coming into your property don’t leave the doors and windows open.
- Use a property management company to rent it out and periodically inspect your property.
- Put up “No Trespassing” signs, especially if the property is currently vacant or unoccupied
And if you have a squatter in your property right now and you need to get rid of them, what should you do?
Call the police in some instances people will leave if or when the police come out to the property. If the squatter claims that they have a right to be in the property the police will not remove them from the property. So if they will not leave the property then...
You can offer them money to move. This can be the cheaper and faster way to get possession of the property back.
If your efforts are unsuccessful in getting the squatters out you will need to post a three-day notice and begin the eviction process similar to a non-paying tenant. An eviction, also known as an unlawful detainer will be a civil case held before a judge and if you get the judgment in your favor the court will order that the possession of your property be restored back to you. The whole process can take between 45-60 days before you get a sheriff lockout.

    Like with most things, it's who you know. An inlaw of a Bro had this problem. The squatters decided to move out when a dozen or so of us rode down the driveway alongside their cars, pulled into the yard, parked our Harleys, unlocked the back door, carried our beer into the house and made ourselves comfortable.

    It's ridiculous the squatters have more rights than the landlord. Our justice system needs to change the rules asap to protect the owner.

    They don't have more rights. And regular tenants who don't pay rent can be evicted again. Every court has a Self Help Resource Center that will guide both landlords and tenants.

    I was able to get renters out, who stayed beyond our contract, I just turned off the water. They could not get gas or electric because I would not relinquish my interest in the property. They figured out after about a week that, though a single woman, I wasn’t about to give up or give in.

    I helped a friend get rid of two squatters in his small rental house he was trying to sell. they were making a filthy mess inside even though he cut off the power and water.we bought a block of sulfur put some in a coffee can and lit it on fire then we put in in the airduct of the house at night while they slept the fumes were so strong it drove them out in 20 minutes but the smell lasted a week

    I found out how easy "I live here" can be backed up. My caretaker allowed his granddaughter to receive mail at the caretaker house. When he suddenly took ill, I was lucky to have him hand me the house keys. I changed all the gate locks and house key and put all the new keys on his keyring. When the granddaughter couldn't get in she called the cops and described her grandpa's keyring and asked the cop to compare the keys to hers. I had the cop follow me into the house and we "found" the keys on the hook as the granddaughter had described. The keys didn't match.

    What I told my friends and neighbors: First: call police for a report and to get illegal occupants names. 2nd: call probation and parol a copy of the police report with the names of the illegal occupants. 3rd: file a complaint with parole/probation against the illegal occupants who are probably on probation and or parole. If they get a probation or parol violation it can be almost instantaneous. “Breaking/entering”, “vandalism”, t petty theft….

    Our squatter took a job on our ranch helping with chores in exchange for a place to part her trailer. She came and after plugging in her trailer she 'changed her mind and didn't want the job. Then she wouldn't leave. Stayed 5 weeks before leaving with NO help from the police to get her off the property

    @@spice1960 that is true… as far as it goes… another term to use is: “gratuitous guest”. Those non paying guests can be instructed to leave upon request! Ask the police to have her produce a title to the trailer..! If the “guest” cannot show title to the trailer you could claim it as yours. And, still instruct the guests to be removed. 🤔 if you”admit” that the squatter has been there for a “long time” Like more than 14 days… that might require some paperwork. If they cannot prove their stay was longer…(?), then they are guests. Get them out fast… remove the trailer…. Look up the legal terms for guest. Squatters won’t hesitate to lie…. So, I guess that homeowners should play with the same “rules”. 🤔

    @@user-ty1rz7nn5c I have personally had to get illegal occupants out of homes that they did not legally occupy. So far, those occupants were on parole or probation. After the police identify those occupants, I called the parole/probation office. The parole/probation came over verified the identity and then arrested the illegal occupants for criminal trespassing, breaking/entering, and parole/probation violations on the spot. Parole/probation can authorize the responding officers to detain or arrest for violations of their release. So…. It has worked so far.

    A colleague of mine said his single male friend asked a family to move out and they tried to 'squat' in his house. He simply moved in with them and walked around naked, hung out on the sofa. They called law enforcement on him. When officers heard the story they told the family it was his house and he could do what he wanted. The family moved out the next day. No vandalism to the house.

    Back in the day my dad and his partner had rented out a house. they learned shortly after that the girls were whores and tricking out of the house. they gave the girls a shotgun eviction and the local gang came by in a couple cars to grab the girls & their possessions.

    Well said...for most of the video I was thinking that alot of land or property owners upon encountering squatters would not just be content wagging their finger and saying "we'll see about that buddy I'm gonna sue you" no...     My father-in-law moved to Arizona, so he rented his house to a family in Los Angeles to pay the note at his new home. He didn’t think about the fact that he needed to protect himself by accumulating a large money cushion. He also didn’t list major appliances, crystal chandelier and other major possessions in the rental property as specifically belonging to him. The renters paid for 3 months and then stopped…. At that point, as far as I’m concerned, they became squatters. Apparently these pos “people” knew the laws and it took several months to get the Sheriff’s order to vacate. Those people trashed the house, the guest house, broke the toilets and took everything out of the house that belonged to my father-in-law. They even took the chandelier. The Sheriff deputy could not stop these sh💩t stains because there was no list of what couldn’t be removed. My father-in-law being extremely naive, didn’t do his homework and paid the price. He lost his house because he could not sustain two house notes for that long and he didn’t have the funds to repair all of the extensive damage in order to sell it at cost. I have a childhood friend that encountered slightly different situation when her mother died and she took possession of the house. My friend’s intent was to sell it. BUT…..Her mother let someone live at the house in Los Angeles for a few months to let the woman recover financially and eventually move. The woman didn’t pay rent, but she also didn’t want to move. My friend was more fortunate, as she is an attorney. But living in Pennsylvania, the process of ejecting the squatter in Los Angeles was a year long process. Fortunately, the house was already paid off. My friend was finally able to sell the house. All’s well that ends well, I guess.

    How about selling the house when moving? That way he's not hording property and subject to non-paying tenants... Also a renter does not become a squatter even if not paying for there is a signed lease. To be a squatter there has to be no payment, paperwork, and the squatter must upkeep the land.

    People in the comments seemed confused. This only applies to Abandoned properties. Not owned properties. Once a renter signs a contract they agree it’s not theirs. A landlord serving an eviction is definitely paying the property taxes. If a property is abandoned and you pay the taxes and care for it, it’s yours. An old law for settlers. This law also made properties abandoned by banks in 2008 the legal property of “squatters” who moved in, payed taxes, revived mail, and cared for it

    The courts are backed up now. It’s a criminal matter that gets a civil matter resolve. Trespassing is trespassing it’s not squatting. Here’s an idea don’t buy them out schedule the house to be termite tented. Pay extra to have the tent stay up a week or more.

    Squatters next door to me finally died. Tweeker drug addicts. I been cleaning up the property and boarded it up. It's owned by the county. It's a fire Hazzard and health Hazzard. I'm on 1 year taking care of the property now. I love California but it's turning into a real shit hole.

    I just finished paying someone to leave a rental house I own She was there initially as a temporary guest of a paying tenant but she had no lease and paid no rent She was fighting with the paying tenants and refused to leave - only by paying her did she leave - It was faster than doing a formal eviction Still took me 3 weeks and a lot of grief (threats broken windows etc)

    A friend of mine tried this and hes right they have to evict you except james got woke up to the smell of propane because the owner of the house sat a propane tank open under the floors crawl space from outside .he didnt die but said it was a vicious head ache and was scared to keep stayin there threw the eviction .

    Well my landlord did alot of illegal things to me while i was paying rent. I had to call the Police so many times I can't even keep count now.😴🚓🚔👮‍♂️👮‍♀️📞📲📱🤳📶🔋 Illegal lockout. Changing the locks while I was paying rent. Broke into my room and through out my furnished room I was paying rent for. And now she is trying to break into my room yes we are roomates and she is a real scum crappy person I am looking for another place. I have not paid rent in 3months and I won a restraining order and she did not like that riding the wave until I find another place to re locate also her Eviction/Unlawful Detainer she did not pursue it and tried to have someone best me up. Yeah I am going to ride this until I can't anymore. #TennantRights

    I had someone ask to rent a room. When I discovered she was a drug addict, i immediately said you need to move. She agreed and I immediately offered to pay 3 months storage at a facility of her choice IF she left by end of month. Yeah it was a bit pricey BUT I MADE SURE TO GET EVERYTHING OUT & into that storage unit in HER NAME (even when she stopped packing), I continued to. Thank God - Covid hit less than a month later and the shut down began and telling people they didn’t have to pay rent and forcing property owners to just “deal with it.” I would have been so screwed had I not gotten her out when I did!

    The last owner was harassing me so I sued him! 😂 He turned off the water and hit me with a rock. I pressed charges for assault! lol I love California! I moved here from Texas 10 years ago and I’ll never go back! God bless California!

    In Pennsylvania please make sure you have a good property manager and good attorney. It. Still takes time. Paying them to leave was one thing we would not do. They had plenty of time to get out. By the way to avoid seeing property manager they kept saying they both had covid 5 times and live to talk about it.

    They took over my home when I was out of town so badly, I was forced to move. The police didn’t remove them. My house was trashed, they kept bringing more people in. There was so much damage done there was no way I could repair or live in it.

    Abandoned properties. Not owned properties. Once a renter signs a contract they agree it’s not theirs. If a property is abandoned and you pay the taxes and care for it, it’s yours. An old law for settlers

    Pay your taxes and you don't need to worry about adverse possession. This law can actually help the community. An abandoned property can become a drugs house with transients passing through and no tax money being paid. On the other hand a family could move in to the house, maintain it, pay the taxes and eventually get ownership.

    If you wanna get rid of squatters there’s a simple solution. Go up to the San Gabriel mountains trap a few rattlesnakes and dump them in front of the squatters and watch them run the hell out of the house. Then you change the locks on the doors and bolt the windows shut.

    5 years is a LONG time. I would think an owner would notice his/her property taxes being paid by someone else. Additionally, I’m not paying someone to leave property they are in illegally. No, should that ever happen, it’s a walk out or get carried out situation.

    When a person who owns a home dies without an heir or will their home just sits there deteriorating until the state auctions it off for 5 years back taxes. It is much better for the community if someone moves in when the house is still in liveable condition and pays the taxes.

    Not my property I guarantee that the squatters would leave soon no question about it. They had a professional squatters in my neighborhood but the cops got them out within two hours the law does protect the property owner in California, I saw this with my own eyes..

    We had a person come to our ranch with their 5th wheel to do farm labor in exchange for rv hookup. They decided in the 1st hour they didn't want the job but refused to leave. Took us over 5 weeks to get her off property. Sheriff's dept. Was no help.

    Given how many abandoned properties the Chinese have taken over in SF, I see no issue. I say go for it. Take care of the property and don’t raise issues, but generally speaking: take over those abandoned homes but take care of them and pay your taxes

    i would never pay a penny to a thief (squatter). They are encouraged and protected to ignore any laws - so I'm sure I would get the same protections - equal under the law, right? Wait until they're gone - go in with a crew - remove everything and take it to the dump - and move in and start repainting and doing the floor, etc. Just claim to authorities you've been there all along - here's proof of ownership - sue me.

    This happened to us in June 2008 we were in the process of buying a home in the city of Norwalk California. My realtor called me and said we have a problem we have a squatter in the house and Wells Fargo bank call the police to get him out he said he had right on so the bank offers $1,000, $5,000 it when all the way to $25,000. The Asian guy wanted $50,000 dollars that’s how he made a living he was known to do this from 2006 to Wells Fargo bank, Bank of America and few other banks. We lost interest in the home November 2008 and move to another property to buy

    Sounds like a sensible plan! Claim your squatters rights and do very obnoxious things like poohing in a bucket and fake coughing all over and eating things to make you fart like crazy. Concentrated Apple juice with whip-cream is a good concoction to drink for that. Then play so much awful music and never leave. Though the person squatting may harm or destroy property themselves.

    Upon a successful claim of adverse possession, what is the tax basis of the property once it is considered property of the squatter? How does the title get transferred to the squatter? Once the title is legally in the squatter's name, what is the tax basis upon which they owe property taxes? If the squatter decides to take out a loan using their new property as collateral, what value would be used for this collateral? If the squatter decides to sell the property to a new owner, what would their tax basis be for any capital gain tax calculation?

    Its the property owners own fault..If they were not so greedy..and jack the rents so high..that people can't afford to rent..and vacate..well thats what they get. A human needing to get off the streets. They see your vacant property..and out of survival necessity..squat.     So my friend had somebody try that with his vacation rental when they wouldn't be reasonable and he said great and he moved his stuff in and even though they were over their objection the screaming started setting up house and taking a bedroom and playing Israeli radio really loud they left very quickly

    Make sure to pay the property tax, including any back taxes, or the state will auction it once the back tax is 5 years past due. Once you have paid the property tax on time for 5 years you can file something with the court to get ownership of the property.

    We never even got close to court..the squatter called the cops on me for towing his car out of the yard with a chain and my truck. He came outside as I was ba king up to get his other car,he took a swing at me as the sheriff was coming down the road and I beat his ass in self defense of course. The sheriff told me to go sit in my truck as he proceeded to help the squatter remove his belongings from the property. There are many ways to get them out...without costing you money. #FJB and everyone who voted for him!!
